REQUEST: The City Manager requests the City Commission receive the recommendations
from the Negotiating Committee.
PURPOSE: The purpose of this agenda item is to reach a compromise regarding the Publix
streetscape on S.R. 434.

CONSIDERA TIONS:
1. On August 2,2001, the City Commission established a Mediation Team to
address the design of the Publix storefront.
2. The Mediation Team met on August 16,2001, with representation from JDC
Calhoun and Victor Dover.
FINDINGS:

I. The primary issues identified are as follows:
JDC Calhoun. Inc.:
a. bay windows;
b. full access median cut at S.R. 434 and the north-south extension; and
c. transportation impact fee credits.
City Mediation Team:
a. Publix S.R. 434 streetscape and
b. Phase IB development guarantee.
2. General consesus and recommendations:
a. Streetscape - JDC Calhoun will redesign the facrade to incorporate alternating
bay windows and spandrel glass, with bay windows at each end; the parapet wall
shall have varying design and color treatment to provide architectural diversity;
awnings are to extend 5 - 7 feet over the sidewalk; and bay windows are to be
accessible from the street for display purposes and be lighted.
b. Tuscawilla Road (Main Street) - The developer agreed to construct Phase 1 B of
the First Modification of [Development] Agreement.
c. Publix Liner Building - A Publix liner building will be constructed BY JDC
Calhoun, Inc. during Phase III; the developer will install all necessary "stub-outs"
as part of Phase 1A of the First Modification of [Development] Agreement; and
the developer's architect will provide minimum square footage and sketch
diagrams.
d. County and City Transportation Impact Fee Credits/Waivers - Transportation
impact fee credits/waivers were discussed. The Town Center Code, Section I D,
suggests consideration of impact fee credits in a development agreement; Staff
was directed to investigate.
e. Full Access Median-Cut Relocation - JDC Calhoun, Inc. requested the City
consider relocating the full-access median-cut currently in front of City Hall to the
proposed north-south extension road; City Hall would be left with a right-inlright-
out movement, only.
STAFF RECOMMENDATION:
Staff recommends the City Commission receive the design alternatives prepared
by the JDC Calhoun team and the recommendations of the Mediation Team.
