REQUEST:
The Community Development Department requests the City Commission consider the final
engineering/site plan for the Colonial Bank, located on the northern-most of two undeveloped out-
parcels at the shopping center located on the south side of SR 434, just west of its intersection with
Vistawilla Drive.
PURPOSE:
To review and approve the final engineering/site plan for the 1.208 acre out-parcel bank site, abutting SR
434, at a shopping center within the Tuscawilla Planned Unit Development (PUD). The site is subject
to the SR 434 New Development Overlay Zoning District regulations (sections 20-463 through 20-474)
and existing development agreement and settlement agreement. The applicant proposes an amendment
to the existing development agreement, a new development agreement, or whatever legal mechanism
would be acceptable to the City Attorney - to move the monument sign from the area to be dedicated for
an east-bound deceleration lane onto Vistawilla Drive.

CONSIDERATIONS:
The 1.208 acre site is located on the south side of SR 434 within one of the two (2) outparcels at the
shopping center. The shopping center is within the Tuscawilla.PUD and is designated for commercial
uses. It has a Commercial Future Land Use designation. Financial institutions, including banks are an
allowable use within the commercial portions of the Tuscawilla PUD. There is an existing development
agreement (DA) for the shopping center.

The plan proposes a 3,283 square foot bank building with four (4) drive-thru stations and 26 parking
spaces (2 handicap accessible). The drive-thru aisles are screened from Vistawilla Drive. Lighting is
planned to be consistent with the existing lighting at the shopping center. A dumpster is provided near
the southeast comer of the site and faces away from Vistawilla Drive.
An existing storm-water management pond for the shopping center is sized to accommodate the run-off
from the site.
The City desires to construct a future right-turn deceleration lane from eastbound SR 434 onto Vistawilla
Drive. The City previously performed an analysis of the SR 434 / Vistawilla intersection, which
concluded that the deceleration lane is warranted. In order to construct this future turn lane in
accordance with FDOT criteria, additional right-of-way along the north side ofthe Colonial Bank site is
required. A total of 1,714.09 square feet of the Colonial Bank property is necessary to properly construct
the future turn lane. The applicant has agreed to provide this additional land to the City in consideration
of an equivalent reduction in the transportation impact fees. Colonial Bank paid $612,850 for the
52,650.5 square foot parcel, or $11.64/SF. Applying the $11.64/SF price to the 1,714.09 SF area
necessary for the turn lane results in a total land value of$19,952 ($11.64 x 1,714.09). Staff
recommends as a part of this final engineering approval that Colonial Bank provide the 1,714.09 SF
required for the turn lane in consideration for a reduction in the transportation impact fees of$19,952. A
similar right-of-way acquisition is required from the adjacent Metro Church property (formerly Kash-N-
Karry) in order to obtain all of the land necessary to construct the turn lane in accordance with FDOT
criteria, which requires the turn lane to have a length of approximately 325-feet. Staffis currently
working with the Metro Church ownership on the possible terms for acquiring the additional right-of-
way.
The existing sidewalk and traffic signal pole will be relocated at City expense when the deceleration lane
is constructed. The existing DA depicts the monument sign for this site within the area that is being
dedicated for the deceleration lane. Staff has addressed this issue with the City Attorney and awaits his
decision as to how the re-Iocation should be addressed.
FINDINGS:
1. The site is located on the south side of SR 434, west of Vista willa Drive at the former Kash N Karry
shopping center, within both the Commercial portion of the Tuscawilla PUD and within the SR 434 New
Development Overlay Zoning District.
2. The Colonial Bank final engineering/site plan is consistent with the City Code and Comprehensive
Plan.
3. Approval ofthe Colonial Bank final engineering/site plan is contingent upon the City's approval of
the monument sign re-Iocation - to be adequately addressed through a development agreement
amendment, or as may be deemed necessary and/or appropriate by the City Attorney.
4. Colonial Bank has agreed to provide the City the land required to construct the future right-turn
deceleration lane from SR 434 onto Vistawilla Drive in consideration of an equivalent reduction in the
transportation impact fees.

PLANNNING & ZONING BOARD ACTION:
At its regularly scheduled meeting of March I, 2006, the Planning & Zoning Board voted 4-0 to
recommend approval of the Colonial Bank final engineering/site plan, subject to the findings, set forth
above.
RECOMMENDATION:
The Planning and Zoning Board and staff recommend approval, subject to appropriately addressing the
monument sign location, as referenced above in the considerations and findings sections of this staff
report.

Requests The Planning And Zoning Board Consider The Final Engineering/Site
Plan For The Colonial Bank, Located At The Kash N Karry Shopping Center, On
The South Side Of SR (State Road) 434, Just West Of Its Intersection With
Vistawilla Drive.
Mr. John Baker, AICP, Senior Planner, Community Development Department introduced
this Agenda Item and stated, "The Applicant is willing to donate the land for a much
needed right turn lane deceleration lane into Vistawilla [Drive]."
Committee Member Tom Brown asked, "When you present it to the [City] Commission,
take the 'Kash N Karry' out of there; nomenclature. Call it, the comer of Vistawilla
[Drive] and [State Road] 434." Mr. Baker said, "Alright." Committee Member Brown
added, "I would just call it by the location."
Regarding moving the lamp post at the comer of Vistawilla Drive and State Road 434,
Committee Member Brown asked, "Who would be responsible?" Mr. Baker said, "I
don't know the answer to that." Committee Member Brown stated, "I would appreciate
you take a look at that, John [Baker]." Mr. Baker said, "I think we paid for the upgrade
from a standard light to the fancy ones." Committee Member Brown said, "But, 1 meant
we could not move it if we wanted to." Mr. Baker said, "I do not know, but 1 can find
out." Committee Member Brown added, "It is real close to that sidewalk and if they do
widen the road, the bank people should be aware of that." Mr. Baker said, "Good point -
I will find out."
Mr. George Garrett, Professional Engineering Consultants, 200 East Robinson Street,
Orlando, Florida: briefly addressed the Board Members on this project.
