REQUEST: The Community Development Department- Planning Division requests that the
City Commission amend and revise its schedule of filing fees for Zoning and Planning Services
by adopting Resolution 2005-04.
PURPOSE: Resolution 2001-45 needs to be amended and revised to reflect new requirements
and procedures not previously included in the fee schedule.
APPLICABLE LAW AND PUBLIC POLICY:
Florida Municipal Home Rule Powers Act
Florida Statute 166.201 Taxes and charges.
A municipality may raise, by taxation and licenses authorized by the constitution or general law, or by
user charges or fees authorized by ordinance, amounts of money which are necessary for the conduct of
municipal government and may enforce their receipt and collection in the manner prescribed by ordinance
not inconsistent with law.
CHRONOLOGY:
Dec. 10,2001- Adoption of Resolution 2001-45 amending and revising fee schedule
Feb. 9,2004- Adoption of Resolution 2004-07 establishing an annual license fee for tree
removal and land clearing contractors.
CONSIDERATIONS:
Since the enactment of Resolution 2001-45 in Dec. 2001, the Commission has adopted the
Aesthetic Review ordinance and the Waiver provision ordinance. No fees have been associated
with these procedures.
Increasingly, developers are choosing (and encouraged by Staff) to bring conceptual
development plans before the Commission for approval. No fees have been allocated for this
procedure.

After receiving conceptual approval, developers are eliminating preliminary engineering and
moving into final engineering as a combined preliminary and final engineering. The fee
schedule needs to be clarify the fee associated with a combined preliminary and final engineering
submittal.
Currently the fee schedule does not define the number of reviews associated with an application.
This encourages developers to submit incomplete plans, because there has not been a limited
number of reviews. Both Altamonte Springs and Seminole County limit the number of reviews
included with the initial submittal and charge an additional fee for each resubmittal.
Resolution No. 600 included a per lot/unit fee for Preliminary Engineering and Final
Engineering. The per lot/unit fee was eliminated for Subdivision Plans (but retained for PUDs
and Site Plans) when the Fee Schedule was expanded in Resolution 2001-45. Subdivision plans
always include multiple lots and should be assessed accordingly.

FINDINGS:
There is a need to update the fee schedule to reflect new requirements and current costs
associated with reviewing plans and documents and to clarify the number of reviews included
before additional fees are charged.
FISCAL IMPACT:
Based on the proposed fees and development review activity for 2004, it is anticipated that
additional annual revenue of approximately $24, 000 will be generated for the General Fund as
follows:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
WINTER SPRINGS FLORIDA, AMENDING AND REVISING ITS
SCHEDULE OF FILING FEES FOR ZONING AND PLANNING
SERVICES, PERMITS FOR DEVELOPMENT SERVICES, AND
OTHER RELATED APPLICATIONS AND LICENSES; PROVIDING
FOR SEVERABILITY, REPEAL OF PRIOR INCONSISTENT
RESOLUTIONS, AND AN EFFECTIVE DATE.
WHEREAS, the City of Winter Springs,has the authority to amend and repeal resolutions; and
WHEREAS, a municipality may raise, by taxation and licenses authorized by the constitution or
general law , or by user charges or fees authorized by ordinance, amounts of money which are necessary
for the conduct of municipal government and may enforce their receipt and collection in the manner
prescribed by ordinance not inconsistent with law. See Fla. Stat. S 166.201; and
WHEREAS, the City Commission of the City ofWinte~ Springs deems that this Resolution is in
the best interests of the public health, safety, and welfare o,fthe citizens of Winter Springs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS.
Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are
hereby fully incorporated by this reference.
Section 2. Fees Established and Adopted. The fees set forth in Section 3 herein are hereby
established and adopted by the City Commission of the City of Winter Springs. Any fees in conflict with
the fees as set forth herein are hereby repealed.
Section 3. Fee Schedule Additions and Revisions. The following fees are as shown plus actual
costs incurred for advertising or notification and forreimbursement for services required from the City
Attorney, Consulting Engineer, Planner, Architect, Landscape Architect, Surveyor and/or otherrelated
technical and professional services needed in connection with the review, inspection or approval of any
development, based on accounting submitted to the City with letter of approval (payable prior to approval
of the pertinent stage of development).

Section 5. Severability. Ifanysection, subsection, sentence, clause, phrase, word, or portion of
this Resolution is for anyreason held invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the
validity of the remaining portion hereto.
Section 6. Effective Date. This Resolution shall become effective imrnediatelyupon adoption by
the City Commission of the City of Winter Springs, Florida.
