REQUEST: The City Manager presents to the Commission the request of the IDC Calhoun,
Inc. (JDC) to modify the special exception approval granted October 22, 200 I,
addressing design conditions and locations for two (2) Town Center decorative
entry signs, located on SR 434 and Tuskawilla Road.
PURPOSE: JDC is requesting the City Commission consider the following:
This special exception approval shall constitute approval and authorization for
two (2) entry signs at the locations depicted on Exhibit "A" (Attachment C)
attached hereto, subject to the following conditions. The entry sign identified on
IDC's original Conceptual Site Plan and depicted on Exhibit "B" (Attachment C)
attached hereto is with drawn by IDC and shall be deemed stricken from the
Conceptual Site Plan. The copy area of each face of the two (2) entry signs shall
be a total of eighteen (18) square feet, including (I) an area eighteen (18) inches
by six (6) feet dedicated to Publix copy area and configured as shown on Exhibit
"c" (Attachment Ctattached hereto and (ii) and area comprising nine (9) square
feet devoted to copy area for up to four (4) additional tenants/users within the
IDC Property. Each entry sign may be configured in a free form manner tailored
to the configuration of the location as an alternative to two (2) faces, but the total
square footage of each entry sign shall not exceed thirty-six (36) square feet. The
lettering for the Publix copy shall be reverse channel lit letters
The final design shall be mutually agreed upon by the City and IDe.

APPLICABLE CODE/AGREEMENT:

D. Site Development Agreement Option:
The City may enter into a Site Development Agreement with the user or
developer of a property, relating to development of a particular parcel or tract of
land, and such an agreement may address such issues as impact fee credits; a
specialized or negotiated concept of design or site plan development authorized or
sanctioned by this ordinance; infrastructure service credits or public-private
participation in funding, design or construction; or other incentives based upon
strict compliance with requirements of this ordinance. The Agreement will be
mutually acceptable to all parties. Considerations for the City in deciding
whether to participate in such an agreement will include compliance with the
objectives and design criteria specified in this ordinance; demonstration of a cost
benefit to City and developer; consideration of development amenities provided
by the developer. Such a Site Development Agreement shall be adopted and be in
conformance with the requirements of the Florida Municipal Home Rule Power
Act or Sections 163.3220 through 163.4243, Florida Statutes, as to effect
duration, public hearing requirements and other issues.
Section VIII
*.. .Free standing monument signs are permitted by special exception along State
Road 434 frontage.
* . . . Signs shall be externally lit. Individual letters and symbols may be internally
lit or back-lit.
Subsection VIII (F) - Examples of signs that are not allowed include:
Monument signs fit within the deep setbacks of suburban strip development to
direct motorists to stores set too far back. [statement on p. 33, next to picture of a

CHRONOLOGY:
On October 22,2001 the Commission approved two (2) decorative entranceway
locations shown in attachment "A" subject to six (6) conditions provided here in
attachment "B".

On November 1,2001 the City Commission received a letter with attachments
from the mc Calhoun, Inc. attorney asking for approval of conditions and
location to the two- (2) entry signs.
FINDINGS:
The language requested by JDC does not go far enough to ensure that the signage would be
consistent with the Town Center concept, and could be interpreted to be a conventional double
faced monument sign.
RECOMMENDATION:
Staff recommends that the Commission deny the mc request of November 1, 2001 and
in the alternative approve the following stipulation in the special exception granted on
October 22, 2001 by the City Commission. The alternative stipulations provide greater
protection of the integrity of the Town Center design and theme while providing greater
flexibility for signage.
1. Signage for the purpose of identifying businesses in the Town Center may be
located in Architectural Focal Points where signage is designed to be
incidental to the main purpose of Architectural Focal Points.
2. Architectural Focal Points are defined to be focal points in the Town Center
including enhanced landscape and streetscape features to promote the beauty
and architectural quality and significance of the Town Center development
and to promote pedestrian friendly leisure activity in the Town Center.
Architectural features include seat walls, benches, enhanced planting
structures and associated plant materials, sculptures, fountains and artistically
significant kiosk and directional and business identification signs incidental to
the main purpose of the Architectural Focal Points.
3. The purpose of Architectural Focal Points is to encourage and enhance the
architectural integrity of the Town Center and pedestrian friendly leisure
activity. The number of Architectural Focal Points shall not be limited
provided they meet the intent of this purpose and the design requirements set
out herein and determined by the Development Review Committee.
4. For purposes of this special exception mc shall construct not less than two
Architectural Focal Points in the mc project area. Additional
Architectural Focal Points are encouraged.

5. The design of Architectural Focal Points shall be in substantial conformance
with preliminary design concepts provided in exhibit "D" attached hereto.
6. At minimum, each Architectural Focal Point must include:
a) Enhanced landscape planting structures and plant material.
b) Enhanced landscape floor or street surfaces such as bench and stone
pavers.
c) Not less than one sculpture, water feature, or kiosk.
d) Seat wall-sitting areas for pedestrians. Seat-walls may be enhanced with
unattached benches.
e) Direction and/or business identification signs may be installed in, or
incorporated into the exterior surfaces of the Architectural Focal Points
provided the lettering is etched into the surface.
t) Metal lettering may be attached to exterior surfaces provided they are of
architectural quality consistent with the design and purpose of the
Architectural Focal Points as provided herein.
7. All signs must be designed as a sign panel including the name of only one
business per panel. Sign panels are vertical running from the floor ofthe focal
point to the surface of the focal point prohibiting stacking of signs vertically.
The size and copy area of each sign panel shall not be more than 10 square
feet, and shall not be more than forty (40) vertical inches from the floor of the
focal point. The total sign panel and copy area of a focal point shall not
exceed more than 50% of the exterior surface of the focal point. Polished
stone sign panels and architectural capstones are encouraged. The sign panel
design, materials, and lettering must be consistent on all sign parcels in
Architectural Focal Points.
8. The final design of Architectural Focal Points including the signage scheme
must be approved by the Development Review Committee.

CONDITIONS OF APPROVAL
SPECIAL EXCEPTION "B"
Decorative Entry Signagc
1.
The signs will be decorativesignage features, in lieu of monument signs,
integrated into an architectural feature whose purpose would stand alone,
regardless of signage. Possible architectural features may include, but are
not limited to, a clock or bell feature or public art depicting the logo or
motif of the Town Center, sculptures and/or water fountains. Typical wall
entrance features are inappropriate for these decorative entry signs.
2. The signs shall only be located at the following locations:
a. the south side of the site entrance from Main Street (adjacent to
building No.2) and
b. the east side of the site entrance by the proposed drive-through bank
(building No. 10).

3. The actual signage on Main Street is to be smaller than on SR 434,
although the actual architectural feature on Main Street does not need to be
smaller than on SR 434.
4. Both decorative entry signage features must meet applicable traffic
visibility criteria (e.g. not intrude into requisite sight triangle or otherwise
create a safety hazard).
5. Actual decorative entry sign design and size shall be subject to approval by
the City Commission.
6. The Development Agreement between JDC and the City shall be amended
to provide for this special exception contingent upon formal design
approval by the City.

Dear Ron:
I am attaching JDC's special exception application for the project entry signs. Once
again I am obliged to document that it is being submitted under protest and that IDC's position is
that the special exception is not required. JDC is hereby reserving its rights with respect to the
entry signs. Further, in no event shall JDC's submittal be construed as an acknowledgment by
IDC that a special exception is required for the entry signs under the Town Center Code or any
other City regulations.
Of course, at this time I believe we all continue to have a comfort level that this will be
. resolved through design. Finally, please coordinate staff DRC action right away so that this can
be considered by the commission at the next commission meeting.

I am attaching a copy of our special exception application for the project entry signs. It is my
understanding based upon our phone conversation today that since this application is one and the
same as the one submitted several weeks ago, the City agrees to process this application for
consideration by the Commission at its next Commission meeting. Further, I understand that we
are not being required to pay the $250 application fee since we paid it once already for this
application. If my understanding of our phone conversation is incorrect or incomplete' in any
respect or you have given this matter further consideration and are not longer comfortable with
this approach, please contact me at once. It is imperative that this application receive
consideration by the City Commission at its next meeting for purposes of our upcoming closing
with Kingsbury.
