REQUEST: Community Development Department requests that the Commission approve the
Dunlevy lot split, and authorize its recordation.
PURPOSE: The purpose of this agenda item is to approve and authorize recordation of the
Dunlevy lot split. The applicant wishes to divide an existing 3.21 acre platted lot
(Lot 3, Block F, North Orlando Ranches, Section 1; 235 East Panama Road) into
one 1.99 acre lot that will have access to the lake on adjacent property and one
1.22 acre lot.

CONSIDERATIONS: The 3.21 acre site is located on the south side of Panama Road,
between Fisher Road to the east and Hayes Road to the west. The site has a Rural
Residential Future Land Use designation (minimum 1 acre lots) and RC-I zoning
(minimum 1 acre lots). The site has an existing detached single family residential
structure on the portion of the site that will be the 1.99 acre lot; an existing barn is
located partially on both proposed lots, but will be demolished before the lot split
is recorded.

The property is configured as proposed to allow the owner or the larger lot to have
access to the lake on the adjacent property to the east.
Staff has reviewed the application and has determined that the application is
consistent with all of the criteria set forth in Section 9-10 (General Criteria for
Approval) and Section 9-11 (Lot Splits). No new streets are required for this
development. An 8 inch diameter potable water line presently extends along the
north side of East Panama Road and is already "stubbed out" to the parent tract.
Since no sanitary sewer line is "available," the existing septic system would be
allowed to remain and a new septic system for the 1.22 acre lot would be required
through the Seminole County Health Department. No off-site improvements
would be required.
The Lot Split Resolution is being provided by the City Attorney.
FINDINGS:
1. The lot split is consistent with the Comprehensive Plan and City Code.
2. The City staff has reviewed the lot split and recommends approval, subject to (1) the City
Attorney's review and approval of the surveys and title certification - applicant to make any
changes or provide any additional information required by the City Attorney, prior to execution
and recordation. The applicant pays for recordation and the City's copies of the plat and (2)
demolition of the barn before recordation.
RECOMMENDATION:
Staff recommends that the City Commission approve and authorize recordation of the Dunlevy
lot split, subject to (1) the City Attorney's review and comments and (2) demolition of the barn.

Dear Wayne,
Based on our recent telephone conversation. I understand that the City of Winter Springs has
requested that I prepare the following letter to descnbe the proposed development at the above
referenced lot. It is further my understanding that this is a pre-requisite tor the lot split.
Once the lot is purchased, we are planning for the construction of a single family residential structure.
The proposed residence will occupy an air-conditioned area of about 5,000 to 6,000 square feet and
about 1,000 to 1,500 square feet of covered patios to the rear of the residence. A pool house
structure will also likely be constructed towards the rear side of the lot. The residence will be
occupied by my family, consisting of four people. We are currently in the process of designing the
proposed residence. The drawings will not be available to submit to The City of Winter Springs until
sometime in January of 2006.
I trust that the information contained in this brief letter is sufficient for the time being. Please do not
hesitate to contact the undersigned, should you or The City of Winter Springs have any questions or
