REQUEST:
City Manager requesting the City Commission to approve the terms of a
solid waste contract with Waste Pro of Florida, Inc. and to authorize the City
Attorney to finalize a contract incorporating those terms.
PURPOSE:
To obtain Commission approval of the terms of a solid waste contract with Waste
Proof Florida, Inc. and authorization for the City Attorney to finalize a contract
incorporating those terms.
CONSIDERATIONS:
On September 19, 2005 the City issued bids for solid waste collection services.
On November 14,2005 the City Commission reviewed the results of the bid and authorized the
City Manager and staff to negotiate with the lowest bidder, Waste Pro of Florida, Inc.
Options:
The Commission has six alternatives:
1. Adopt the rate structure related to the continuation of the current residential rear loader
scenano.
2. Adopt the rate structure related to the provision of residential semi-automated service.
3. Adopt the rate structure related to the provision of residential fully-automated service.
4. Adopt some amended rate structure offer to Waste Pro of Florida, Inc.
5. Reject all proposals and authorize the City Manager to negotiate with the next lowest bidder,
Hewitt Environmental Systems.
6. Reject all proposals and authorize the City Manger to negotiate a temporary service
extension with the City's current solid waste contractor, and rebid.
Recommended Terms Include:
1. The City Manager is recommending the Commission choose from the following 2 options:
a. A 5 year contract term with a 4 year renewal option (upon mutual agreement) with the
rate structure related to semi-automated residential service of$15.85 (per residential
unit per month) for collection and disposal with a 2.5% maximum CPI factor, or
b. A 7 year contract term with a 2 year renewal option (upon mutual agreement) with the
rate structure related to semi-automated residential service of$15.76 (per residential
unit per month) for collection and disposal with a 3.0% maximum CPI factor.
2. A new fine schedule for inadequate service.
3. Approval of an Interlocal Agreement with Seminole County committing the City's waste
stream to the County in return for a $3.00 per ton reduction in disposal rates and share in
recyclable revenue estimated at $20,000 per year.
4. All new vehicles and equipment restricted to Winter Springs.
5. Disposal waste generation rate will be fixed at 1.54 for year one of the contract and trued-up
at the end of the year. If the rate proves to be higher, the City will reimburse Waste Pro for
the difference. If the rate proves to be lower, Waste Pro will reimburse the City.
6. New 10% Franchise Fee on commercial service, estimated to generate $40,000 in annual
revenue to the City.
7. Contract transfer fee of $25,000 for the first transfer and $100,000 thereafter.
8. $500,000 bond as opposed to a $1,000,000 bond.
9. Required community event participation of not less than $5,000 per year.
FUNDING:
The new contract will be funded from the new customer rate structure.
RECOMMENDATION:
The City Manager recommends the Commission take the following action:
1. Approve the rate structure related to semi-automated residential service as presented in
Table 1.
2. Choose either:
a. a 5 year contract term with a 4 year renewal option (upon mutual agreement), or
b. a 7 year contract term with a 2 year renewal option (upon mutual agreement).
3. Approve all other terms and conditions related to the contract.
4. Authorize the City Attorney to complete a contract memorializing the terms and conditions
of the contract for approval by the Commission at the January 23, 2006 commission meeting.
