REQUEST: The City Manager requesting the Commission, to review Cahill Enterprises,
Inc. request for special exceptions to the Town Center District Code for a project known as
Avery Park which is located on the southwest fringe of the Town Center west of Tuskawilla
Road.
PURPOSE: The 'purpose of this agenda item is to present to the Commission for their
consideration, the request of Cahill Enterprises, Inc. for special exceptions to the design of Avery
Park that are not in strict compliance with the code.
APPLICABLE LAW AND PUBLIC POLICY:
Town Center District Code, Section II (C) Special Exceptions:
The City Commission may by special exception waive strict compliance with provisions of this
code. In granting a special exception, the City Commission must find by substantial competent
evidence that:
I. The proposed development contributes to, promotes and encourages the improvement of the
Winter Springs Town Center and catalyzes other development as envisioned in the Winter
Springs Town Center regulations.
2. The proposed development will not have an unfavorable effect on the economy of the Winter
Springs Town Center.
3. The proposed development abides by all rules in this code other than those specially
excepted. Special limitations apply to Large Footprint Buildings (greater than 20,000 square
feet); see section V (L) for these limitations (page9).

4. The proposed development meets any reasonable additional conditions, restrictions or
limitations deemed necessary by the City Commission in order to preserve and promote the
intent of the Winter Springs Town Center Master Plan.
CONSIDERA TIONS:
I. Neighborhood Street - Special Exception
The Town Center District Code stipulates neighborhood lanes to be 50 feet in width.
Cahill Enterprises is requesting the width of the streets to be 47 feet to accommodate Town
Center concept on the site which has a difficult geometry.
2. Two Story Building - Special Exception
The Town Center District Code requires building heights to be not less than two stories and
not more than 4 stories.
Cahill Enterprises is requesting that they be allowed to build both one story and two story
models based upon market demand.
FUNDING: Not Applicable
RECOMMENDATION: Staff will provide recommendations at the Commission meeting.
