Authorization REQUEST: The Parks and Recreation Department is requesting that the City Commission approve new fees for the Splash Playground and Senior Center through Resolution # 2007-51 which establishes new fees to be paid by individuals for use of city facilities. PURPOSE: The purpose of this item is to receive commission approval for new fees for use of the Splash Playground and Senior Center Therapy Pool through Resolution # 2007-51 which establishes new fees to be paid by individuals for use of city facilities. CONSIDERATIONS: . The City Commission at the November 13, 2007, Special Meeting approved increasing fees to be paid by individuals or groups for use of city facilities and Program participation for Youth Sports, Sports Camps, Adult Sports, Field Rentals, Civic Center Programs, Recreational Camps, Pavilion Rentals, and Civic Center Rentals. . At that meeting the City Commission directed staff to contact the CDBG office regarding: I. Not charging County Residents for the use of the Splash Playground and charging out of County Residents. 2. Establishing an income scale for new fees for the Senior Center and Therapy Pool. Agenda Item Regular 602 Page -2- . Staff contacted CDBG regarding the income issue. CDBG will support the following based upon their increase guidelines. A guest fee of $ 5.00 per person per day for use of Senior Center and Therapy Pool. Total estimated revenue $ 18,000 per year based on projected participation. Splash Playground Seminole County Resident Non-Resident $ 1.00 for a One (1) year Membership Fee $ 3.00 per day, per person Total estimated revenue $ 18, 000 per year based on current participation. FUNDING: None required. RECOMMENDATIONS: The Parks and Recreation Department recommends approval of new fees for the Splash Playground and Senior Center Therapy Pool through Resolution # 2007-51. Splash Playground Seminole County Resident Non-Resident $ 1.00 for a One (1) year Membership Fee $ 3.00 per day, per person RESOLUTION NO. 2007-51 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING AND REVISING ITS SCHEDULE OF FEES FOR VARIOUS PARK5 AND RECREATION FACILITY USES, ACTIVITIES AND LABOR SERVICES; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission has the authority to establish fees pursuant to section 166.201, Florida Statutes; and WHEREAS, the City Commission finds it necessary to periodically review its fee schedules pertaining to activities, facility use and labor services within the City; and WHEREAS, the City Commission desires to revise and amend certain fees as set forth in this Resolution; and WHEREAS, the City Commission of the City of Winter Springs finds that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by this reference. Section 2. Fees Established. The City Commission hereby adopts the fee schedule set forth in Exhibit "A," attached hereto and fully incorporated herein by this reference. The fees set forth in Exhibit "A" shall be effective January 1, 2008. Section 3. Repeal of Prior Inconsistent Resolutions. All prior inconsistent resolutions adopted by the City Commission, or parts of prior resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion City of Winter Springs Resolution No. 2007-51 Page 1 of 2 of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective date. This Resolution shall become effective on sanuary ] , 2,008.
