REGULAR 01/08/2001 Meeting IDEPT REQUEST: The Parks and Recreation Department is requesting that The City Commission approve Resolution No. 2001-03, establishing fees to be paid by individuals or groups for the exclusive use of picnic pavilions. PURPOSE: The purpose of this item is to receive approval from the Commission for Resolution 2001-03, which establishes fee and charges for three (3) different size pavilions & repeals Resolution No. 787. CONSIDERATION: . The City Commission at the August 12, 1996 meeting, approved Resolution No. 787. . Upon completion of the Parks Improvement Program, the City has Sixteen (16) pavilions in three (3) different sizes available to the public. . The public desires to obtain exclusive use of these pavilions. . Parks and Recreation recommends a fee of $30.00 for a large pavilion (7-8 tables), $25.00 for a medium pavilion (3-4 tables), and $20.00 for a small pavilion (1-2 tables) for each four (4) hour use. . The proposed scheduling and fees are in line with other Local Government Agencies. 1 ~ ~~. .... I ... FUNDING: None required. RECOMMENDATION: The Parks and Recreation Department recommends the approval of Resolution 2001-03. IMPLEMENTATION SCHEDULE: January 9, 2001, New fees and charges in place, except for already scheduled pavilion usage. RESOLUTION NO.787 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA ESTABLISHING THE FEES TO BE PAID BY INDIVIDUALS OR GROUPS FOR THE EXCLUSIVE USE OF PICNIC PAVILIONS LOCATED AT CENTRAL WINDS PARK (1), SAM SMITH MEMORIAL PARK, SUNSHINE PARK, AND TROTWOOD PARK (1); PROVIDING FOR CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida has found it necessary to periodically review its fee schedules pertaining to activities and facilities within the City; and, WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined that it needs to establish those fees to be paid by individuals or groups for the exclusive use of the picnic pavilions. NOW THEREFORE, BE IT RESOL YED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT: SECTION 1- The Fee Schedule for the exclusive use of the picnic pavilions located at Central Winds Park (1), Sam Smith Memorial Park, SW1shine Park and Trotwood Park (I), by individuals or groups is hereby adopted as being established as a $25.00 exclusive use permit fee for each four (4) hour use. SECTION II -The twenty-five ($25.00) exclusive use permit fee is refundable only when written cancellation notice is received by the Parks and Recreation Department at 1126 East State Road 434 or hand delivered and received at 1000 East State Road 434, Winter Springs, Florida 32708, ten (10) calendar days prior to the approved use date. SECTION III-The exclusive use permit fees are applicable to exclusive permitted uses with the exception of non-profit, community based organizations which are community serving in purpose. Non-profit commW1ity serving and community based organizations may qualify their status by executing a Community Based Organization Verification Form-obtained through the assistance of the Parks and Recreation Department located at 1000 East State Road 434, Winter Springs, Florida 32708. WHEREAS, the City Commission of the City of Winter Springs, Florida has found it necessary to periodically review its fee schedules pertaining to activities, facility use and labor services with the City; and, WHEREAS, the City Commission of the City of Winter Springs, Florida has adopted Resolution Number 787 establishing fees and charges; and, WHEREAS, the City Commission of the City of Winter Springs, Florida has determined that it needs to implement a new picnic pavilion fee schedule. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT: SECTION I. Individuals or groups can reserve and obtain exclusive use of Park Pavilions on a first come, first serve basis, through scheduling with the Parks and Recreation Department and the payment of a fee. SECTION II. Three (3) pavilion sizes are available: Large, 6-8 tables under pavilion, Medium, 3-4 tables under pavilion and Small, 1-2 tables under pavilion. SECTION III. The fee schedule for an exclusive use permit for each picnic pavilion is hereby established as $ 40.00 for large pavilion, $ 30.00 for medium pavilion, and $ 20.00 for small pavilion. A permit shall be for a four (4) hour time period to be used for the day and time scheduled. SECTION IV. The exclusive use permit fee is refundable only when written cancellation notice is received by the Parks and Recreation Department at 1126 East State Road 434 or hand delivered and received at 1000 East State Road 434, Winter Springs, Florida 32708, ten (10) calendar days prior to the approved use date.
