REQUEST:
City Manager and City Attorney requests the City Commission to consider an Ordinance limiting
members of City boards or committees to service upon one board or committee at a time, and to
recommend a ~nd reading and public hearing on the Ordinance.

PURPOSE:
In order to provide as many opportunities as possible for interested and qualified individuals to serve
upon City boards and committees, this ordinance would limit each member to service upon a single
board or committee at a time; with the exception of appointments to ad hoc committees. The
ordinance acknowledges that current board or committee members may serve upon more than one
board, and provides that they may continue to do so until the expiration of their current term, they
resign, or are removed from the position by the City Commission.

City Ordinance No.: 2001-49 adopting Section 2-42 of the City Code.
Section 2(b), Article VIII, of the State Constitution.

CONSIDERA TIONS:
This amendment to the code will help to provide opportunities for interested and qualified individuals
to serve the City of Winter Springs.
STAFF RECOMMENDATION:
The City Manager and City Attorney recommends a second reading and approval of this Ordinance.

AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA AMENDING
SECTION 2-42 OF THE CODE OF ORDINANCES,
PROVIDING FOR A LIMIT A TION ON THE NUMBER OF
BOARDS OR COMMITTEES APPOINTED MEMBERS MAY
SERVE; PROVIDING FOR THE GRANDF A THERING OF
ANY EXISTING DUEL MEMBERSHIPS; PROVIDING FOR
THE REPEAL OF PRIOR INCONSISTENT ORDINANCES
AND RESOLUTIONS; PROVIDING FOR INCORPORATION
INTO THE CODE; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under S2(b), Art. VIII of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, the City Commission desires to establish uniform and consistent procedures
and requirements for appointing and removing members to City boards and committees; and
WHEREAS, the City Commission desires to provide an opportunity to as many qualified
individuals as possible to serve upon City boards and committees: and
WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this
ordinance to be in the best interests ofthe public health, safety, and welfare of the citizens of Winter
Springs.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by the
reference as legislative findings of the City Commission of Winter Springs.
Section 2. Code Amendment. Section 2-42 of the City of Winter Springs Code of
Ordinances, entitled appointments of boards and committees is hereby amended, as follows:
(underlined type indicates additions and strikeout type indicates deletions, while asterisks (* * *)
indicate a deletion from the Ordinance of text existing in Chapter 2. It is intended that the text in
Chapter 2 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the
language existing prior to adoption of this Ordinance).

Sec. 2-42. Appointments of boards and committees.

ill Multiple Board or Committee Membership. No member of any appointed board or
committee of the City of Winters Springs shall be allowed to serve on more than one such board or
committee at a time. with the exception of appointments to ad hoc committees oftemporarv duration.
Any board or committee member, at the time of the effective date of this Ordinance, who is a
member of more than one board or committee, may continue to serve on each such board or
committee until the expiration of the current term of each respective board. the member resigns from
such board or committee, or is removed, in accordance with this Chapter. from any such board or
committee.
Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior
inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances
and resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 4. Incorporation Into Code. This ordinance shall be incorporated into the
Winter Springs City Code and any section or paragraph number or letter and any heading may be
changed or modified as necessary to effectuate the foregoing.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this ordinance.
Section 6. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida.
