REQUEST: The Community Development Department requests the City Commission
consider adopting Resolution 2001-45 revising its schedule of filing fees
and permits for development services and other related applications and
licenses and consolidating said fees into one single resolution.
PURPOSE: The purpose of this agenda item is to request consideration of an updated
fee schedule for the City; increasing some fees, adding new fees and
consolidating the current six rate resolutions into one resolution.
APPLICABLE LAW:
Florida Statutes
166.201 Taxes and charges. A municipality may raise, by taxation and
Licenses authorized by the constitution or general law, or by user charges
or fees authorized by ordinance, amounts of money which are necessary
for the conduct of municipal government and may enforce their receipt
and collection in the manner prescribed by ordinance not inconsistent with
the law.
166.222 Building code inspection fees. The governing body of a
municipality may provide a schedule of reasonable inspection fees in
order to defer the costs of inspection and enforcement of the provisions of
its building code.

CONSIDERATIONS:
. The City is operating under Resolution 600 adopted July 25, 1988 dealing
with fees for annexation, development plans, zoning and engineering
applications and permits.
. Resolution 600 as amended by Resolution 2001-07 March 12, 2001 to
establish requirements for reimbursement of consultant fees.
. Resolution 679 adopted April 13, 1992 establishing fees and service charges
for Fire Department services.
. Resolution 456 adopted August 1984 establishing the fee to be charged to
developers to fund the cost of maintenance and service charges for street
lights.
. Resolution 771 adopted November 13 1995 establishing fees for plan review
and various building permits.
. Fees for reproduction of public records memorandum dated November 20,
1995.
. Resolution 762 adopted July 24, 1995 establishing occupational license fees.
. All affected departments and divisions have participated in the preparation of
Resolution 2001-45.
FINDINGS:
. The city departments are operating under six (6) separate resolutions most of which were
adopted several years ago.
. It is felt that there is a need to update the' fee schedule to reflect current costs associated with
processing and handling development fees and building permits and to consolidate all fees
under one single resolution.

FISCAL IMPACT:
It is anticipated that additional annual revenue in the amount of approximately $160,120 will be
generated for the General Fund as follows:

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA AMENDING AND
REVISING ITS SCHEDULE OF FlLING FEES AND PERMITS
FOR DEVELOPMENT SERVICES AND OTHER RELATED
APPLICATIONS AND LICENSES;
WHEREAS, the City of Winter Springs has the authority to amend and repeal resolutions
and to establish fees to adequately recover the costs of services~ and
WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined
that it needs to update its fee schedule,
NOW, THEREFORE, BE IT RESOLVED THAT THE FOLLOWING FEES ARE HEREBY
ESTABLISHED AND ALL PRVIOUSLY ADOPTED RESOLUTIONS RELATED ']['0 FEES
INCLUDING BUT NOT LIMITED TO 600, 456, 771,762, 679, 2001-07 AS AMENDED ARE
HEREBY REPEALED.

Fees are as shown plus actual costs incurred for advertising or notification and for reimbursement
for services required from the City's Consulting Engineer, Planner, Architect, Landscape Architect,
and Surveyor and other related technical and professional services needed in connection with the
review, inspection or approval of any development, based on accounting submitted to City with
letter of approval (payable prior to approval of the pertinent stage of development) + Actual Cost.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA AMENDING AND
REVISING ITS SCHEDULE OF FILING FEES AND PERMITS
FOR DEVELOPMENT SERVICES AND OTHER RELATED
APPLICATIONS AND LICENSES;
WHEREAS, the City of Winter Springs has the authority to amend and repeal resolutions
and to establish fees to adequately recover the costs of services; and
WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined
that it needs to update its fee schedule,
NOW, THEREFORE, BE IT RESOLVED THAT THE FOLLOWING FEES ARE HEREBY
ESTABLISHED AND ALL PRVIOUSLY ADOPTED RESOLUTIONS RELATED TO FEES
INCLUDING BUT NOT LIMITED TO 600, 456, 771,762, 679, 2001-07 AS AMENDED ARE
HEREBY REPEALED.
