CALL TO ORDER
The Code Enforcement Board Regular Meeting of Tuesday, October 21, 2008 was called
to Order at 7:00 p.m. by Vice Chairman James B. Pitts, in the Commission Chambers of
the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708).
Roll Call:

Vice Chairman Pitts stated, "Ms. [Carole] Giltz and Matt Matisak are absent and Excused
Absences - so, Hugh [Fisher] will be a Voting Member this evening."
Next, Vice Chairman Pitts led the Invocation and Pledge of Allegiance.
Continuing, Vice Chairman Pitts inquired if there were any "Agenda Changes". Deputy
City Clerk Danielle Harker replied, "Tonight we will be hearing Agenda Item 502.11 and
Agenda Item 503.1."
Deputy City Clerk Harker swore in the Winter Springs Code Enforcement Inspectors and
those who may be providing Testimony during the presentation of tonight's Cases.
Captain Tolleson commented, "This evening we were going to hear [Agenda Item]
502.12, which was Case Number 08-0019277, 1211 Deer Run, William and Sonia
Triplett. Their Attorney, Mr. Justin [D.] Niznik was here this evening and he has asked
for apostponement - Mr. Triplett is in Houston and may not be back until -December at
the earliest. And I told him that I would ask the Board -the privilege to move that until
his Client would be available." Vice Chairman Pitts asked, "Do I hear any Objections to
Captain Tolleson's request?" No Objections were noted. Vice Chairman Pitts continued,
"If not, so be it."

Vice Chairman Pitts asked Inspector Jose Romero, Code Enforcement Officer, Code
Enforcement Bureau, Police Department, "Will you be using PowerPoint and any other
information and if so we will -identify it as data as `Winter Springs 1' and `[Winter
Springs] 2'." Inspector Romero replied, "Yes, Sir."
Inspector Romero remarked, "Was sited on August 5th, 2008 and issued a Notice of
Violation. The Property was inspected August 13`" [2008], August 28`h [2008],
September 2°d [2008], October 3`d [2008], October 4th [2008], October 5th [2008],
October 17`h [2008] and October 215L [2008]. The Property is still in Non-Compliance.
We are asking for a Finding of Fact and a Relief Order."
Photographs of this property were shown.
Next, Vice Chairman Pitts asked Inspector Romero, "Did you have an opportunity to talk
to the Homeowner?" Inspector Romero replied, "I spoke with him a number of times
various to this Case and others." Vice Chairman Pitts inquired, "His response?"
Inspector Romero answered, "He's going to take care of it; he's going to take care of it
and still in Violation."
Brief discussion.
Vice Chairman Pitts asked, "Do I hear a Motion for a -Finding of Fact using Page 5?"

PRESENTED AT THIS HEARING, I FIND THAT THE CODE ENFORCEMENT
OFFICER HAS PROVEN HIS CASE BASED ON THE FOLLOWING:

THE CITY CODE THAT A VIOLATION OF SECTION 13-2. (TRASH AND
DEBRIS) OF THE CITY CODE EXISTED.
1. THE RESPONDENT WAS PROVIDED NOTICE OF THIS HEARING AS
PRESCRIBED BY CHAPTER 162.12 OF THE FLORIDA STATUTES AND
THAT THE RESPONDENT WAS NOT PRESENT AT THIS HEARING.
2. THE RESPONDENT AS PROVIDED A REASONABLE TIME TO
CORRECT THE VIOLATION.
3. THE RESPONDENT FAILED OR REFUSED TO CORRECT THE
VIOLATION WITHIN THE TIME PROVIDED.
4. THE VIOLATION CONTINUES TO EXIST - UPON THE
RESPONDENT'S PROPERTY.

($100.00) and two [hundred and] fifty [dollars] ($250.00)." Vice Chairman Pitts
commented, "That sounds fair to me. Does anybody Object to that being the dollar
amount?" No Objections were noted.

ruled that any and all -future reoccurrences of this Violation would be considered a
Repeat Offense. The Fine was one hundred dollars ($100.00) per day for the Violation of
the Commercial Vehicle. Daniel White was not present at this Hearing. Certified Notice
