CALL TO ORDER
The Code Enforcement Board Regular Meeting of Tuesday, November 18, 2008 was
called to Order at 7:00 p.m. by Chairman Mathew Matisak, in the Commission Chambers
of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708).

Chairman Matisak noted, "Board Member [Laura-Leigh] Wood has an Excused absence
for this evening. Alternate Board Member [Carole] Giltz will be in a Voting capacity."
Next, Chairman Matisak led the Invocation and Pledge of Allegiance.
Continuing, Chairman Matisak inquired if there were any "Agenda Changes". Deputy
City Clerk Danielle Harker replied, "Yes, Sir. Tonight - we will be hearing Agenda Item
502.2."
Deputy City Clerk Harker swore in the Winter Springs Code Enforcement Inspectors and
those who may be providing Testimony during the presentation of tonight's Cases.
Chairman Matisak welcomed the Boy Scouts who were in the audience. Continuing,
Chairman Matisak again led the Pledge of Allegiance.

Regarding a change that needed to be made to the Minutes, Deputy City Clerk Harker
mentioned, "If you look on the first page, under Roll Call, Alternate Board Member
Carole Giltz. It says she is `present [Excused]' and at the last Meeting she was -actually
`Absent [Excused]'."

Captain Glenn Tolleson, Code Enforcement Bureau, Police Department conveyed, "We
will be holding the Code Enforcement Training Class in January [2009]. So, those that
wish to attend, I'll get the date to Danielle [Harker] and she can get it out to you all."
Chairman Matisak asked, "Is that going to be the one that you do?" Captain Tolleson
replied, "Yes."

Deputy City Clerk Harker informed the Board that the Office of the City Clerk, instead of
the Code Enforcement Bureau, would now be contacting the Chairman/Vice Chairman to

Inspector -Jim Flannigan
Chairman Matisak asked, "Is the Respondent present for this Hearing?" With no
responses, Chairman Matisak continued, "Let the Record reflect that the Respondent is
not present."
Inspector Jim Flannigan, Code Enforcement Officer, Code Enforcement Bureau, Police
Department stated, "This residence was originally sited on June 23`d, 2008; I was
investigating another complaint when I was checking the backyard and observed that the
pool was stagnant -this property failed Re-Inspection on July l Otn, 2008; July 23`d, 2008;
and again on -October 10th, 2008; October 26t , 2008; and again, today, November 18cn _
2008. This property is still in Non-Compliance. We are asking for Finding of Fact and
Relief [Order]."
Next, Chairman Matisak asked, "Do you want to enter this PowerPoint into Evidence this
evening?" Inspector Flannigan replied, "Yes, Sir." Chairman Matisak continued, "Let the
Record reflect, this PowerPoint and all its subsequent photographs be entered in as `WS
1'. Do you have a Method of Service to submit?" Inspector Flannigan replied, "It was
done by First Class Mail and Posted; the Property was Posted." Chairman Matisak stated,
"We have an Affidavit of Posting for November Stn [2008] at 1704 Seneca Boulevard. It
will be entered in as ` W S 2' ."
Photographs of this property were shown.
Inspector Flannigan remarked, "The house is currently Vacant; it's been so for several
months."
Brief discussion.
Chairman Matisak asked, "How did you originally get this call?" Inspector Flannigan
replied, "The original complaint was of tall grass and when I checked, I was informed it
was a Vacant property; I went around - of the side of the property and through the
easement and saw that the pool was stagnant as well." Chairman Matisak continued, "So,
this was called in from aneighbor -some anonymous Complaint?" Inspector Flannigan
noted, "Anonymous Complaint."

Vice Chairman James B. Pitts asked, "Is the house in foreclosure?" Inspector Flannigan
replied, "I'm unaware; I believe it is, but I don't have that documentation." Captain ~~
Tolleson added, "It has not been filed as of yet."
Brief discussion.
Chairman Matisak reiterated, "So, there has been no les pendens that has been filed on
this property." Chairman Matisak continued, "We have not been able to contact -the
Homeowner at all -you have had no -communication with them, either written, verbal,
smoke signals, anything?" Inspector Flannigan replied, "Nothing, Sir."
Further discussion.
Inspector Flannigan said, "I know from just driving around normally checking and stuff, I
know it was probably around April [2008] or May [2008] was the last time that I noticed
the yard had been cut."
Continuing, Chairman Matisak asked Inspector Flannigan, "Can you testify for the Board
what the pool looks like from -what you experienced, what you saw through your eyes
because obviously looking at the picture, it does not tell us much?" Inspector Flannigan
replied, "It's stagnant; it's green with obvious mold growth on the side and inside of the
pool. Like today, when I checked, you could see tadpoles floating around the pool and
everything."
Discussion continued.
Chairman Matisak inquired, "Is there still a public safety risk given the fact that this - is
completely enclosed?" Captain Tolleson replied, "There is if someone breaks into it, falls
into it; you can't see them in the bottom of it. It's an inherent risk and it's an attractive
nuisance."
Brief discussion.
Regarding the overgrown lawn, Board Member Dale Kirby asked, "I am wondering if
someone maintained the place right now and who is maintaining it right now?" Captain
Tolleson replied, "We are." Board Member Kirby inquired, "The City is doing the
mowing of it?" Inspector Flannigan stated, "The grass is being cut by the City, yes."

Chairman Matisak asked, "Is this property in Violation of Untended Grass and Weeds,
Section [13-2.] - (a) and (b)?" Chairman Matisak continued, "Is this property in
Violation?" Captain Tolleson replied, "No, Sir, or you would be hearing it if it was."
Chairman Matisak inquired, "Then how is the City mowing it?" Captain Tolleson
answered, "Under [Section] 13-2. (a)." Chairman Matisak remarked, "So, in fact, it is in
Violation of [Section] 13-2. (a)." Captain Tolleson stated, "But it has no bearing on
tonight." Chairman Matisak commented, "But it is fact." Captain Tolleson noted, "It's
fact, yes." Captain Tolleson continued, "We provided Testimony that we are maintaining
the yard."
Discussion.
Chairman Matisak stated, "Again, the Respondent is not present to present Testimony
this evening."
Further discussion.
Regarding all the different databases that the Code Enforcement Bureau uses to find a
Respondent's current address, Captain Tolleson commented, "All of his still come back
to Seneca [Boulevard]." Captain Tolleson continued, "To include, there is no forwarding
address for him either." Chairman Matisak asked, "And all of the mail that we have sent
has come back?" Captain Tolleson replied, "Returned, unavailable address."
Much discussion.

CHAIRMAN MATISAK ASKED, "PAGE 5?" BOARD MEMBER WEISMAN
REPLIED, "YES."

CASE#08-0018432. AFTER HEARING THE SWORN TESTIMONY OF THE
CODE ENFORCEMENT OFFICER AND REVIEWING THE EVIDENCE
PRESENTED AT THIS HEARING, I FIND THAT THE CODE ENFORCEMENT
OFFICER HAS PROVEN HIS CASE BASED ON THE FOLLOWING:

Inspector Flannigan testified, "The fence only is on one (1) side of the property; you can
access it from the other side of the property. That's how I got the pictures. The screens do
not have locks on them, so it's just a matter of getting right into the screen."
Further discussion.
Captain Tolleson continued, "We've already been shocking the pool; we've been
throwing in the mosquito dunks -we're constantly are doing all of those things, but its
now at a point where we need to get that Lien established so we can place it on the
property, so once it comes into someone's hands, we can move forward with -recouping
-those Funds."

Chairman Matisak suggested that in the future, the Code Enforcement Bureau inform the
Board if the City has been taking any corrective action on the property during the ,~,
presentation to the Board on the Case. °'_

Board Member Kirby asked about putting chain link fences over pools to ensure no one
falls in. Captain Tolleson said, "We're now in the new Budget and we are looking at what
those -costs are going to be."
Board Member Kirby suggested in the future better photographs be taken for the Board to
view.

looking at summarizing expenses and including those as part of your request in your
Order of Relief."

Continuing, Chairman Matisak inquired, "Do you have a timeline in which you think you
are going to begin doing that or a goal that you want to try to hit that; to start that
process?" Captain Tolleson replied, "Two (2) or three (3) months."
Further discussion.

CASE#08-0018432 HAVING BEEN FOUND `GUILTY' FOR VIOLATING
SECTION 13-2. (STAGNANT POOL) OF THE CITY CODE, I MOVE THAT THE
RESPONDENT BE GIVEN SEVEN (7) DAYS AFTER NOTIFICATION TO
CORRECT THIS VIOLATION OF THE CITY CODE.
IF THE RESPONDENT -FAILS TO CORRECT THE VIOLATION WITHIN
THE TIME PROVIDED, A FINE OF TWO HUNDRED AND FIFTY DOLLARS

Informing The City Of Winter Springs Code Enforcement Board Of Its Authority
Of Appeals For Red Light Camera Infractions.
Captain Tolleson introduced this Agenda Item.
Much discussion.
Regarding how Winter Springs Police Department would determine whether there was a
red light infraction, Captain Tolleson noted, "The entire vehicle beyond the cross walk."

Regarding the process in which the Appeal Hearing will be run, Captain Tolleson ~
commented, "One (1), you're used to Property Owners. It may or may not be; we don't
know. Secondly is, there's no Fine assessed to it -there's not a Page 5 or a Finding `A'. It ,~
is, `Yes, it was a Violation' or `No, it was not'. Based on the Respondent, based on the ~''
video, based on the Officer Testimony -and that's where the Board has to make that '-""~
decision."

what you're looking at when you see it."

the future.
