ORDER OF THE CODE ENFORCEMENT BOARD
VACATING FINDINGS OF FACT AND RELIEF ORDER
This cause initially came to be heard before the Code Enforcement Board of the City of
Winter Springs on February 16, 2010, for violation of section 20- 103(a) of the Winter Springs
City Code. The Code Enforcement Board, having heard the sworn testimony of the Code
Enforcement Officer and the Respondent, and after considering the evidence presented at the
hearing, entered an Order dated February 17, 2010 ( "Order ") setting forth Findings of Fact and a
Relief Order, which Order found Respondent in violation of section 20- 103(a) of the City Code,
gave Respondent 30 days to correct said violation, and imposed a penalty in the amount of Fifty
Dollars ($50.00) per day for each day the violation continued.
The Code Enforcement Board, subsequent to entering its Order, was made aware of
certain procedural deficiencies in the statutorily- required notices issued to Respondent and, sua
sponte, scheduled that its Order be reconsidered during its March 16, 2010 Code Enforcement
Board meeting.
Having heard and considered the information related to the deficient legal notices, the
Code Enforcement Board of the City of Winter Springs hereby vacates its Order of February 17,
2010 in all respects and said Order shall have no further force or effect.
