REQUEST: City Manager Requesting the City Commission hold a public hearing and
adopt Resolution #909 electing to use the uniform method of collecting non-
ad valorem special assessments levied within the incorporated area of the
City.
PURPOSE: The purpose of this agenda item is for the City Commission to hold a public
hearing and adopt Resolution #909 electing to use the uniform method of
collecting non-ad valorem special assessments levied within the incorporated area
of the City more specifically described as the Oak Forest development for
improvements related to the Oak F orest Wall and Beautification District.
CONSIDERATIONS:
The City Commission may consider the development of an assessment program to
fund neighborhood improvements for the Oak Forest development. Improvements include
construction and maintenance of a subdivision wall with entranceway signage and
amenities, and beautification and maintenance of rights-of-ways.
Section 197.3632, Florida Statutes states that the City may hold a public hearing
and adopt a resolution of intent to use the method of collection for any assessment
program in the calendar year prior to any such collections. The resolution, which does not
obligate the City to use the method or impose a special assessment, must be adopted by
January 1 st, and sent to the Seminole County Property Appraiser, Seminole County Tax
Collector, and the Florida Department of Revenue by January 10th.

FUNDING:
None required. This is projected to occur in the summer of 2000 subject to the
City Commission adopting the resolution creating the assessment district.
RECOMMENDATION:
It is recommended that the City Commission hold a public hearing and
adopt Resolution #909.
IMPLEMENTATION:
If adopted, Resolution #909 will be transmitted to the Seminole County Property
Appraiser, Seminole County Tax Collector, and the Florida Department of Revenue by
January lOth. GSG is continuing to work on the process of creating the assessment district
with the district creation resolutions projected for Commission consideration this spring.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
WINTER SPRINGS, FLORIDA ELECTING TO USE THE UNIFORM
METHOD OF COLLECTING NON-AD VALOREM SPECIAL
ASSESSMENTS LEVIED WITHIN THE INCORPORATED AREA OF
THE CITY INCLUDING THE OAK FOREST SUBDIVISION; STATING
A NEED FOR SUCH LEVY; PROVIDING FOR THE MAIUNG OF THIS
RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission (the "Commission ") of Winter Springs, Florida (the "City")
is contemplating the imposition of special assessments for the provision of neighborhood
improvements including building and maintaining an architectural wall with signage, and
beautification and maintenance of right-of-ways; and
WHEREAS, the Commission intends to use the uniform method for collecting non-ad
valorem special assessments for the cost of providing neighborhood improvements including
building and maintaining an architectural wall with signage, and beautification and maintenance
of right-of-ways within the incorporated area of the City including the Oak Forest Subdivision as
authorized by section 197.3632, Florida Statutes, as amended, because this method will allow such
special assessments to be collected annually commencing in November 2000, in the same manner
as provided for ad valorem taxes; and
WHEREAS, the Commission held a duly advertised public hearing prior to the adoption of
this Resolution, proof of publication of such hearing advertisements being attached hereto as
Exhibit A;
NOW, THEREFORE BE IT RESOLVED by the City Commission of Winter Springs, Florida,
as follows:
1. Commencing with the Fiscal Year beginning on October 1,2000, and with the tax
statement mailed for such Fiscal Year, the City intends to use the uniform method of collecting non-
ad valorem assessments authorized in section 197.3632, Florida Statutes, as amended, for
collecting non-ad valorem assessments for the cost of providing neighborhood improvements
including building and maintaining an architectural wall with signage, and beautification and
maintenance of right-of-ways. Such non-ad valorem assessments shall be levied within the
incorporated area of the City including the Oak Forest Subdivision. A legal description of such
area subject to the assessment is attached hereto as Exhibit B and incorporated by reference.
2. The City hereby determines that the levy of the assessments is needed to fund the
cost of neighborhood improvements including building and maintaining an architectural wall with
signage, and beautification and maintenance of right-of-ways within the incorporated area of the
City including the Oak Forest Subdivision.

3. Upon adoption, the City Clerk is hereby directed to send a copy of this Resolution by
"red States mail to the Florida Department of Revenue, the Seminole County Tax Collector, and
.ne Seminole County Property Appraiser by January 10, 2000.
4. This Resolution shall be effective upon adoption.
