Section 20-359 of thc City Code statcs, "Any requcst for an alteration, revision, addition or
deletion to the final dcvelopmcnt plan shall be submittcd to the city clcrk for revicw by thc
planning cmd zoning board....the board shall rcvicw the proposal and thc stalT
rccommendations to determine ""hether or not thc proposed changc is substantially
consistent with the approvcd final development plan. If thc proposal is dctermined to bc
consistcnt, tllC planning and zoning board may approve or approvc with modifications thc

D. Purpose:.
The purpose of this request is to adopt City-initiatecrFuture Land Use Map
(FLUM) and zoning desigIlations for lwo (2) tracts totaling 1.24 acrcs and thus
incorporate them into- the "Tuscawilla PUD.
E. Site Information:
1. Parcc1s and PIN: Following the amendment of the FLUM, zoning map and
PUD devc1opment-plan, the subject properties would be combincd with
Lots 729 through 741 of Oak Forest Unit 7, as shown on Attachment G, in
a separate application for subdivision. Even though the properties have
ncver been ollicially subdivided, they are currently recorded by deed in the
Seminole Counly's Propcrly Appraiser's OfEce with the following Propcrty

3. Location: The subject properties are generally located west of Tuscawilla
Road, between Milky Way and Trotwood Boulevard.

6. DevcloDll1ent Trends: The subject properties, including both the 0.81 acre
parcel and the 0.43 acre vacated right-of.way, are undeveloped. With the
exception of single-family development to the south, the surrounding area is
either undeveloped or developed for agricultural uses. With the recent
adoption of the nearby Town Center future land use cU1d zoning
classifications, properties in and around the area cu'e expected to expericnce
greater development activity as supporting infrastructure for the Town
Center is constructed.
7. Petitions of Opposition al1{Vor Support: A petition by the property owners
of Lots 729 through 741 of Oak. Forcst Unit 7 was filed in the City Clerk's.
oflice supporting the application.
F. Considerations:
1. The subject properties are comprised of a 0.81 acre tract Ulat directly abuts
Lots 729 ulrough 741 of Oak. Forest Unit 7 to the norUl and a 0.43 acre
vacated right-of-way which directly abuts the 0.81 acre tract to Ule norUl.
2. Both tracts were annexed into Ule City in August 2000 but were nevcr
assigned City FLUM or zoning designations.
3. Following the vacatiol'l of the 0.43 acrc right-of-way in April 2001, half of it
reverted to the owner of Ule property norUI of its location rruscawilla
Office Park) anddle other half reverted to Ule owners ofthe 0.81 acre tract,
which abuts Tuscawilla Unit 7.
4. BOUl tract,> were acquired in May 2001 by UIe abutting propcrty owncrs of
Tuscawilla Unit 7 cu)d recorded by deed in Ule Seminole County Registry.
5. Following cumexation into UIe City and acquisition by UIe Oak. Forest Unit 7
projlerty owners, the subject properties were never otlicially subdivided or
recombined wiud.,oL,> 729 through 741.
6. The Scmino1c County Properly Appraiser's Oflice has assigned individual
property identification numbers for each portion of the 0.81 acrc tract that

has been partitioned by deed, as shown in Exhibit G and described under
IlE Site hl!0l111aliol1.
7. The incorporation of the sul~ject property into the Tuscawilla PUD would
be pursuant to the future subdivision and recombination of the sul~ject
properties into Lots 729 through 741 of Oak. Forest Unit 7 as hercin
described.
III. ANALYSIS
A. Justification for Amendments: -
The subject properties adjoin Lots 729 through 741 of Oak Forest Unit 7, which
are developed for low density rcsidential uses (approximately 1.2 to 3.5 units per
acre) and zoned PUD. The subject properties are depicted as Medium Density
Residential on Seminole County's FLUM and zoned A-I AgriculturalDistrict.
Now that both properties arc within the City of Winter Springs, the zoning and
future land use maps should be amended to City designations to eliminate UIe
inconsistency between adopted future land use and zoning.
The subject properties would benefit from the FLUM and zoning amendments.
The linear conliguration of bOUt properties is cUlTently preemptive to development.
The adoption of a low density residential future land use for lllese properties, along
wiUl their combination wiUlthc adjoining lots of Oak Forest Unit 7, would not
lower the density beyond that which is established for low density residential and
would Ulerefore be consistent with UIe FLUM established by UIe comprehensive
plan.
B. Public Facilities and Services:
The suqject properties would eventually be combined willt Lots 729 through 741 of
Oak Forest, which are already developed for low density residential use. Since no
other changes arc being proposed to those existing single-family developments, the
proposed amendment" would have no impact on public facilities and/or services.
C. Nuisance Potential of Proposed Use to Surr~~ding Land Uses:
The proposed amendments would not alter Ute character nor create Ute potential
for nuisances to sUlTouriding land uses, since no additional land uses would be
created.
D. Consistency with the Comprehensive Plan:
The proposed amendment" would make the FLUM and zoning map designations
consistent for the sul~ject properties, while allowing for llle continuation of UIe low
density residential futurc land use established by UIe comprehensive plan lor Oak
Forest Unit 7 of the Tuscawilla PUD.

IV. FINDINGS
A . The request is consistent with all applicable goals, objectives cU1d policies of the
City's adopted comprehensive plan.
B. Considering the type and location of uses involved cUld the general character of the
area, the request would not rcsult in any incompatible land uses, including such
factors as height, bulk, scale, intensity, traHic, noise, drainage, dust, lighting,
appearance, ;md other simil<u' applicable factors.
V. STAFF RECOMMENDATIONS
Stall believes the proposed amendment to the PUD development plan is substantially
consistent with the approved final development plan and recommends that the planning
and zoning board approve the proposed change, in accordance with City Code Section 20-
359.
Stall' further recommends that the plcUlning and zoning board approve the amerfdment of
the FLUM from (Seminole County) Medium Density Residential to (City of Winter
Springs) Low Density Residential and thc amcndmcnt of thc oflicial zoning map from
(Seminole County) A-I Agricultural to (City ofWintcr Sprin!,rs) PUD, subject to the
following condition:
A. Prior to the FLUM and zoning map amendments becoming eflective, the owners of
the subject properties must obtain approval for the alteration of the final
subdivision plan as stated in City Code Section 20-386, in order to combine the
subject properties with Lots 729 through 741 of Oak. Forest Unit 7 and legally
record the same.

We, the members of the North Cheoy Lee Circle Group, purchased extensions to our
property in May 2001. Shortly afterwards, a right of way was vacated by the City of
Winter Springs, giving each property owner an additional fifteen feet along the northern
boundary, We the property owners would like to request:
1. That the City of Winter .Springsannex into the city our property extensions,
including the vacated right of way, if it has not been done so to date.
2. That the City of Winter Springs change the zoning of this property; including ,
the vacated right of way, from agricultural to residential.
