REQUEST:
In accordance with Emergency Ordinance 2006-08, the Community Development Department, Customer
Service Division, requests the City Commission consider an appeal of a staff decision to deny a building
permit on the basis of neighborhood compatibility and harmony involving a 1,024 square foot detached
garage at 932 Arabian Avenue.
PURPOSE:
The purpose ofthis Agenda Item is for the Commission to consider an appeal under Ordinance 2006-08.
The primary issue is whether a proposed 1,024 s.f. detached garage for 932 Arabian Avenue meets the
requirements of Ordinance 2006-08, particularly whether the proposed detached garage is compatible
and in harmony with existing single family homes in the surrounding neighborhood.
APPLICABLE LAW AND PUBLIC POLICY:
Ordinance 2006-08, Section 2. Interim Residential Compatibility and Harmony Regulations.
In general, the relevant standard of review under Ordinance 2006-08 is as follows:
Before any building permit is issued for the addition, modification, and expansion of any building or
structure on a residential lot, the city manager or his designee shall consider and review the plans and
specifications to determine whether or not the proposed addition, modification, and expansion is
compatible and in harmony with existing buildings and structures on the property and with the
surrounding neighborhood. ComlJatibilitv and harmony shall be determined based on reviewing the
setting. landscapinJ!. lJrolJortions. materials. colors. texture. scale. unity. balance. rhythm, contrast, and
simplicity of the lJrolJosed addition. modification, and eXlJansion. Nothing herein shall be construed to
prohibit a proposed addition, modification, and expansion that significantly enhances the established
residential character of other buildings and structures on the subject property and within the
surrounding neighborhood in accordance with the review criteria stated above and commonly accepted
architectural principles of the local community.

CONSIDERATIONS:
The owner of the property located at 932 Arabian Avenue has applied for a building permit to
construct a detached garage. The total area of the proposed detached garage is 1,124 square feet.
The proposed finish color and architectural elements proposed for the addition are compatible with the
existing house. It appears the property currently has two spaces in the original garage and three spaces in
the attached garage. In addition, there is an accessory building in the rear of the property that appears to
have been placed in a 100' utility easement. Staff is not aware whether or not this building contains any
parking vehicle storage spaces.
FINDINGS:
Staffhas reviewed the application for a building permit in accordance with the City Code and the review
criteria set forth in Ordinance 2006-08 and has denied issuance of the permit based upon the size of the
proposed addition. Most of the surrounding houses have no more than 4 garage spaces with the majority
having only 2 spaces. Staff denied the request on April 10, 2007 because the proposed detached garage
is not compatible nor in harmony with the existing single family homes in the surrounding
neighborhood.
ST AFF RECOMMENDATION:
Staff recommends the City Commission consider the applicant's appeal of staff s denial and render a
final decision on the compatibility and harmony of the proposed addition..

The permit application for additions to your residence at 932 Arabian Avenue was received on
March 21. 2007. This permit has comments from the plans reviewer. Also. there are items that
are Inconsistent with the Deed Restrlctlons for your sub-dlvlslon. Please can me at 407-327.1800.
ext. 306 to discuss this issue. Because of the inconslstency with the. deed restrictions and in
accordance with Ordinance 2006-08 as extended by Ordilance 2006-22. staff must review your
request for neighborhood compatibility. If you want to proceed with the plans. staff must take the
request to the City Commission for approval under the aforementioned ordinance. The permit
cannot be issued until after City mission approval.
