The Public Works Department requests the City Commission validate the staff recommendation finding Orange Avenue to be built in substantial accordance with the Final Engineering plans, to accept the public infrastructure, and to authorize reimbursement to Levitt & Sons in the amount of $835,572 for the design and construction of Orange Avenue per the Developer's Agreement. REQUEST: PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding Orange A venue to be built in substantial accordance with the Final Engineering plans, to accept the public infrastructure, and to authorize reimbursement to Levitt & Sons in the amount of$835,572 for the design and construction of Orange A venue per the Developer's Agreement. CONSIDERATIONS: y At the March 27, 2006 City Commission meeting, the Commission appropriated funding in the amount of $821,382, plus a 10% contingency for a total of $903,520, to reimburse Levitt & Sons for the design and construction of Orange A venue from Tuskawilla Road to the proposed Jesup's Landing subdivision. The project is now complete and the total amount eligible for reimbursement is $835,572. y At the February 28, 2005 City Commission meeting, the Commission approved a Developer's Agreement with Barclay Woods II, LLC (Barclay Woods) for the development of the Jesup's Landing project, located on the south side of Orange Avenue, immediately east of Central Winds Park. Jesup's Landing is a 185-unit townhome development that is currently under construction. y After the Developer's Agreement between the City and Barclay Woods was approved, Barclay Woods sold the Jesup's Landing property to Levitt & Sons. The Developer's Agreement is bound to the property and therefore Levitt has assumed responsibility for Barclay Woods' obligations under the Developer's Agreement. 051407_ COMM _Regular _600_ Orange Avenue_Acceptance May 14,2007 Regular Agenda Item 600 Page 2 ')i> Under the terms of the Developer's Agreement, The City is required to reimburse or provide transportation impact fee credits to Levitt for the reasonable costs to complete the design, permitting, and construction of Orange Avenue from Tuskawilla Road to the western boundary of Jesup's Landing, a distance of approximately 3,000 feet. If the cost to design, permit, and construct Orange A venue exceeds the amount of transportation impact fees generated from Jesup's Landing, the City is obligated to reimburse Levitt the amount in excess of the transportation impact fee credits. The total cost to design, permit, and construct Orange Avenue is $1,194,322. The total transportation impact fees for the 185 townhomes proposed in Jesup's Landing are $358,750. Therefore, the amount the City is required to reimburse Levitt is $835,572 ($1,194,322 - $358,750). Reimbursement is required within 90 days of construction completion. Transportation impact fee credits will be issued to Levitt in the amount of$358,750. No townhome units have been permitted at this time. ')i> The project costs are summarized as follows: Task Cost Surveying $18,000 Geotechnical Engineering $7,630 Roadway Design Engineering $149,500 Archaeoloqical Survey $7,500 Subtotal $182,630 Construction - Tuskawilla to Jesup's Landing $997,502 Change Order #1 $14,190 Total Project Costs $1,194,322 Jesup's Landing Transportation Impact Fee Credits (185 units @ $1,939.19 each) $358,750 Total Reimbursement Due $835,572 FINDINGS: 1) Orange A venue has been constructed in substantial accordance with the final engineering plans. 2) All City agencies have found the work to be acceptable. 3) Record drawings have been submitted and accepted by Staff. 4) Levitt & Sons has provided a two-year, 10% maintenance bond to the City for the public infrastructure being turned over to the City for ownership and maintenance. 051407_ COMM _ Regular ~ 600 _Orange A venue ~ Acceptance May 14, 2007 Regular Agenda Item 600 Page 2 FUNDING: The funding source for the City's reimbursement is Fund 140 - Transportation Impact Fee Fund. The fund balance is sufficient to cover the requested funding of $835,572. RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding Orange Avenue to be built in substantial accordance with the Final Engineering plans, to accept the public infrastructure, and to authorize reimbursement to Levitt & Sons in the amount of $835,572 for the design and construction of Orange A venue per the Developer's Agreement.
