REQUEST: The Community Development Department requests the Planning & Zoning Board/Local Planning Agency to recommend to the City Commission adoption of the updated official future land use map (FLUM) and official zoning map. PURPOSE: The purpose of this request is to present the updated FLUM and official zoning map for consideration by the Planning & Zoning Board and for a recommendation of adoption to the City Commission. The changes are highlighted below; the maps will be available Nov. 1. APPLICABLE LAW AND PUBLIC POLICY: Section 20-102(c). Official zoning map update and annual approval. The Community Development Department- Planning Division shall oversee the maintenance of the official zoning map. It shall be the division's duty and responsibility to keep the zoning map up to date. Maps shall be updated within ten (10) days following the adoption by the city commission of an ordinance rezoning real property. In addition, the update shall include adding to the map's database, a reference to the ordinance adopting the rezoning. A copy of the official zoning map shall be presented annually to the Planning and Zoning Board for review. During the review, the Board shall review the map for accuracy and situations where an administrative rezoning may be appropriate. Upon completion of the review, the Planning and Zoning Board shall issue a report to the City Commission pointing out any inaccuracies on the map and any properties which may be considered for an administrative rezoning. The City Commission shall review the Planning and Zoning Board's report and make such decisions that are necessary to update the City's official zoning map. -1- 110105 Planning and Zoning Board Regular Agenda Item 500 CONSIDERATIONS: 1. The City Code requires the annual update of the official zoning map in a permanent fashion. 2. The City Code requires the updated zoning map to be presented to the Planning and Zoning Board for consideration and recommendation each year, prior to approval by the City Commission. 3. While not required by Code, the approval of a concurrent FLUM update provides consistency between the future land use and zoning maps by ensuring that map amendments affecting both future land use and zoning designations are properly documented. FINDINGS: Staff has completed its review and update of the FLUM and official zoning map by incorporating all map amendments approved by the City Commission from January 2005 through November 2005, as shown below and graphically depicted in Attachment B: CITY BOUNDARY CHANGES: • Ordinance 2005-19; Annexation of 5.13 acres (Shull Property) at 820 E SR 434 by Richard Jerman; Adopted June 27, 2005 FUTURE LAND USE MAP AMENDMENTS: • Ordinance 2004-38; Changed future land use designation of (Schrimsher-ICI Homes) 40 acres across from Creeks Run on SR 434 from (Winter Springs) "Greeneway Interchange " to (Winter Springs) "Mixed Use "; Adopted Jan. 24, 2005 • Ordinance 2004-40; Changed future land use designation of (Highlander Investment) 11.028 acres on SR 434 from (Seminole County) "Office " to (Winter Springs) "Town Center "; Adopted Jan. 24, 2005 • Ordinance 2004-43; Created Urban Central Business District; Adopted Jan. 24, 2005 • Ordinance 2005-02; Changed future land use designation of (Chan) 1.95 acres at 1136 Orange Avenue from (Seminole County) "Suburban Estates "and "Conservation " to (Winter Springs) "Town Center "and "Conservation Overlay " (on those affected areas); Adopted Feb. 14, 2005 • Ordinance 2005-04; Corrective action changing future land use designation of (Gamble) 1.75 acres along SR 434at Parkstone Blvd. from (Winter Springs) "Low Density Residential " to (Winter Springs) "Commercial "; Adopted Feb. 14, 2005. • Ordinance 2005-07; Changed future land use designation of (Ondick) 10.65 acres on SR 434 and Tuskawilla Rd. from (Seminole County) "Office" and (Seminole County) "Commercial " to (Winter Springs) "Town Center "; Adopted Sept. 12, 2005 -2- 110105 Planning and Zoning Board Regular Agenda Item 500 • Ordinance 2005-20; Changed future land use designation of (Jerman-Schull) 5.13 acres at 820 E. These include the entire vacant parcel (located on the south side of SR 434 adjacent to Heritage Park parcel ID # 26-20-30-SAR-oD00-0210) that was purchased for mitigation credits and conservation areas on the Atcher Plat (located at Bahama Rd and Shore Rd). SR 434 from (Seminole County) "A-1 Agriculture " to (Winter Springs) "C-1 "; Adopted Sept. 12, 2005 STAFF RECOMMENDATION: Staff recommends the Planning & Zoning Board recommend approval of the updated Future Land Use Map and Official Zoning Map changes. IMPLEMENTATION: Following the adoption of the Official FLUM and Official Zoning Map by the City Commission, Staff will submit copies to the State and to Seminole County, and will post the updated maps on the City's Internet site. A certified copy will be available for public display (as outlined in Section 20-102), and paper and electronic copies will be made available for public purchase. ATTACHMENTS: A.
