REQUEST: The Community Development Department- Planning Division requests that the Planning
and Zoning (P&Z) Board consider and approve a final engineering/sitep1an fora 1213 square foot ice
cream shop on a 1.36-acre tract on SR 434 at Costa Rica Dr.
PURPOSE: The purpose of this Agenda Item is to request that the P&Z recommend that the City
Commission approve a final engineering/site plan for an ice cream shop on this 1.36-acre site. The site
has a Commercial Future Land Use designation and is within the C-1 Neighborhood Commercial zoning
district.

CONSIDERATIONS: The presently vacant, partially wooded site along the south side of SR 434 is
located within the SR 434 Corridor Overlay District- Redevelopment Area. There are no wetland,
floodplain, specimen tree, or listed species issues associated with this site.
No traffic study was required for this use at this site. A 24-foot wide cross access-easement is proposed
to allow eventual connection of the properties to the east and south as they develop. The cross-access
easement must be recorded before a certificate of occupancy is issued for the building.
The Applicant has worked diligently with Staff to resolve any final engineering/site development plan
issues.
FINDINGS:
1. The proposed final engineering/site plan is consistent with the City's Comprehensive
Plan and Code of Ordinances.

2. Across-access easement, as depicted on the site plan, must be recorded prior to a
certificate of occupancy being issued for the building.
RECOMMENDATION: Staff recommends that the P&Z Board recommend approval to the
City Commission of the attached final engineering/site development plan subject to the
conditions set forth in the "Findings" section, above.
