LAMOUREUX REZONING (REZ-1-2000) STAFF REPORT: APPLICABLE LAW AND PUBLIC POLICY: Sec. 20-57 of the City Code states "The planning and zoning board shall serve. . .to recommend to the City Commission the boundaries of the various original zoning districts, , ,and any amendments thereto, , ,act on measures affecting the present and future movement of traffic, the segregation of residential and business districts and the convenience and safety of persons and ) property in any way dependent on city planning and zoning." CONSIDERA TIONS: 1: SUMMARY OF APPLICATION APPLICANT: OWNER: Robert Lamoureux 400 West State Road 434 Oviedo, FL 32756 [ same] REQUEST: For a change of zoning designation from Seminole County's designation of A-I "Agriculture" to the City's designation ofC-1 "Neighborhood Commercial". PURPOSE: Applicant wants to eventually retire and sell his 2.5 acre parcel as a commercial property, with commercial zoning designation, since he already has a commercial enterprise operating on the property now, A. SITE INFORMATION 1. PARCEL NUMBER: 04-21-31-300-013A-0000 2. ACREAGE: 2,5 3. GENERAL LOCA TION: Approximately 112 mile east of the beltway (S.R. 417 "the GreeneWay") on the northside of S,R, 434 and adjacent to the Battle Ridge property and Winter Springs Executive Park property, 4. LEGAL DESCRIPTION: ) EAST ONE-HALF (1/2) OF WEST ONE ONE-HALF (1/2) OF NORTHWEST ONE-FOURTH (1/4) OF NORTHEAST ONE-FOURTH (1/4) OF SOUTHEAST ONE-FOURTH (1/4), SECTION 4, TOWNSHIP 21 SOUTH, RANGE 31 EAST, IN THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA. BEING SUBJECT TO ANY RIGHTS-OF-WAY, RESTRICTIONS AND EASEMENTS OF RECORD, 5. CHRONOLOGY OF SUBJECT PROPERTY: The property has been in the unincorporated area of the county, 6. DEVELOPMENT TRENDS: This general area along S,R. 434 in proximity to the beltway is experiencing development pressure, In recent years the McKinley's Mill residential subdivision was built on the south side of S.R. 434 just west of the subject property, Recently, the Battle Ridge property was approved for a 108 lot residential subdivision and conservation area. Just to the west of the beltway, Hess Service Station has been built, Kash-N-Karry Food Store was recently opened as well as the 252 unit Courtney Springs Apartment complex; and Burger King will be building adjacent on the east side of the Hess Station, The City has established a higher densitylintensity mixed use "GreeneWay Interchange District" modeled somewhat after the county's Higher Intensity Planned Development (HIPs) found around the airport, the 1-4 Corridor, etc, around a major transportation nexu s, On the east side of the beltway there is a property ) being prepared for commercial development at the southwest corner area, There has been small commercial enterprises along the north and south side of S.R, 434 just east of the beltway, 7. EXISTING LAND USE OF SUBJECT PROPERTY: The parcel has a single family residence and several sheds used for a car restoration and sales business, 8. LETTERS/PHONE CALLS IN FA VOR OR IN OPPOSITION No inquiries at the time of this report preparation. B. EXISTING LAND USES ADJACENT TO SUBJECT PROPERTY: North: vacant, treed area to Lake Jessup, South: S.R, 434 and south of that is vacant land. East: vacant, partially treed area (entrance to Battle Ridge), West: vacant partially treed area with an abandoned "hunting cabin". ) c. FUTURE LAND USE DESIGNATION OF SUBJECT PROPERTY: Existing: (county designation) "Suburban Estates" (maximum 1 DU/acre), Requested: (City designation) "Commercial", D. FUTURE LAND USE DESIGNATIONS ADJACENT TO SUBJECT PROPERTY: North: (city) "Lower Density Residential" (1.1 - 3,5 DU per acre). South: (Oviedo) "Lower Density Residential" (1 - 3.5 DU per acre). South: (Oviedo) R-l "Residential" (8,500 sq, ft, lot size) east of McKinley's Mill C-] "Commercial" west of McKinley's Mill. East: R-] AA "One Family Dwelling District", West: C-1 "Neighborhood Commercial", II. REZONING ANALYSIS: A. JUSTIFICA TION FOR REZONING: 1. The applicant wishes to sell or develop the property for commercial uses rather than for agriculture or residential, since it is a more appropriate use of the land due to its location on a major thoroughfare, S,R, 434 (an urban arterial), and its proximity to the transportation nexus of the beltway and S,R, 434, The county has the parcel zoned A-I "Agriculture", which allows for crop cultivation, grazing and pasturing of animals and related agricultural activities and for residential on minimum I acre lots per (Sec. 30,122 County Land Development Regulations page 30-61,62), ) 2. The applicant's proposed rezoning to C-l reflects similar zoning on the south side of S,R, 434 just to the west in Oviedo, There it is C-1 "General Commercial" , B. NUISANCE POTENTIAL OF PROPOSED REZONING TO SURROUNDING LAND USES: The nuisance potential of the proposed change of Zoning Map designation from (County) A-I "Agriculture" to (City) C-1 "Neighborhood Commercial" to the surrounding properties should be minimal in view of the following: 1. The applicant's proposed zoning change from (County) zoning designation A-I "Agriculture" to the (City's) zoning designation ofC-1 "Neighborhood Commercial" is the same zoning as Oviedo has on the nearby parcels along S.R. 434, just to the west on the south side, which is C-1 "General Commercial" ("intended to permit and encourage a full development of retail commercial uses") [ page IV -2 City of Oviedo Land Development Code ]. 2. The applicant's proposed zoning is compatible with the commercial nature of S,R, 434 urban arterial in terms of the existing commercial establishments in the area, on the west side of the beltway and of those on the east side, The adjacent ') ) III. FINDINGS: property to the west of the subject property (Wofford/Slappey propel1y) involves a professional office building, and just to the west of this property is an auto repair and salvage business, There is also a real estate office, bicycle repair, and antique business just beyond the Wofford/Slappey property, On the south side to the west a parcel has been cleared and leveled with fill dirt in preparation for a new commercial establishment. 3. The City has development standards in its land development regulations to ensure minimal impacts on surrounding properties, such as buffering, The City's land development regulations and the site plan review process of the Development Review Committee can ensure the prevention or minimization of any potential nuisances, 4, Although the S,R. 434 Corridor New Development Overlay Zoning District regulations do not include the subject property, the applicant, in his note dated February 15, 2000, has indicated his willingness to abide by the spirit of the City's S,R. 434 Corridor Vision Plan New Development Area regulations and will cooperate with the City to ensure the parcel meets or exceeds existing development and aesthetic standards, 5. The commercial development that would occur on the 2.5 acre parcel is not expected to generate a significant amount of traffic that would lower the Level of Service of S,R, 434, . The applicant's proposed zoning change from (County) zoning designation A-I "Agriculture" to the (City's) zoning designation ofC-1 "Neighborhood Commercial" is the same zoning as Oviedo has on the nearby parcels along S,R, 434, just to the west on the south side, which is C-I "General Commercial" (intended to permit and encourage a full development of retail commercial uses") [ page IV-2 City of Oviedo Land Development Code]. .
