REQUEST:
The Community Development Department requests that the Planning and Zoning
Board hold a public hearing for Ordinance 2007- 29, which shall amend the text of Section 20-
351 and Section 20-354 of the City’s Code of Ordinances with respect to Part “A” PUD density
calculations.
PURPOSE:
The purpose of this ordinance is to facilitate a text amendment to up-date the
PUD “A” sections of the code to provide for currently acceptable mixed-use residential
development trends.
APPLICABLE LAW AND PUBLIC POLICY:
1. Florida Municipal Home Rule Powers Act.
2. Chapters 163 and 166, Florida Statutes.
3. Chapter 20, Article IV. Planned Unit Developments, Division 2 (Specifically Section 20-
351 and Section 20-354).
4. Winter Springs Charter Section 4.15 Ordinances in General.
CONSIDERATIONS:
During the Winter Place PUD review, it became obvious that the
two separate PUD sections of Chapter 20 (Part “A” and Part “B”) had different criteria for which
an area’s residential density could be calculated. This regulation, which was adopted in the
1980s, is inconsistent with currently acceptable development trends. These current development
trends include, but are not limited to, higher density, mixed use, more unit type variation, multi-
modal options, as well as scenic and terminating vistas.
Development regulations and subsequently approved developments must be consistent with the
comprehensive plan. As set forth in Subsection 163.3194, FS, a development regulation is
consistent with comprehensive plan if the land uses, densities, or intensities and other aspects of
the regulation are compatible with the objectives, policies, land uses, and densities or intensities
in the comprehensive plan. Allowable densities may not exceed the maximum set forth in the
Comprehensive Plan for a specific Future Land Use designation. Staff will continue to review
residential PUD densities for compliance with the comprehensive plan.
STAFF RECOMMENDATION:
Staff recommends that the Planning and Zoning Board
consider the proposed PUD Part “A” code text amendment and recommend approval.

Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the
Winter Springs City Code and any section or paragraph, number or letter, and any heading may be
changed or modified as necessary to effectuate the foregoing. Grammatical,typographical,and like
errors may be corrected and additions, alterations, and omissions, not affecting the construction or
meaning of this ordinance and the City Code may be freely made.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction,whether for substantive,procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section 6. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to City
Charter.
