REQUEST:
The Community Development Department- Planning Division requests the Local Planning
Agency hold a public hearing and make recommendation to the City Commission for Ordinance
2007 -17, which establishes a new zoning district entitled "PF - Public Facilities".
PURPOSE: To establish a new zoning district, which specifically allows uses related to public
purpose facilities. The future land use categories associated with this zoning district are
Public/Semi-Public and Recreation and Open Space.
APPLICABLE LAW AND PUBLIC POLICY:
Florida Municipal Home Rule Powers Act.
Section 166.041(3)(c), FLorida Statutes.
Winter Sprines Charter Section 4.15 Ordinances in General.
Winter Sprines Section 20-57. The planning and zoning board shall serve... to recommend to
the city commission the boundaries of the various original zoning districts... and any
amendments thereto... act on measures affecting the present and future movement of traffic, the
segregation of residential and business districts and the convenience and safety of persons and
property in any way dependent on city planning and zoning.

CONSIDERATIONS:
· Winter Springs was founded as a bedroom community in 1959. In 1960, the community
had one public building, and it was not until 1965, that the first store opened, the North
Orlando Super Market
· The City's zoning district have historically been oriented to the establishment of various
housing districts.
· As the City has grown and diversified, additional districts have been added to support

other uses.
Currently, public facilities are located in almost every zoning district of the City. There
is not a zoning district that is specifically oriented to the use ofland for public facilities.
Land that is intended for a public purpose, should have that purpose conveyed through its
zoning. When it is not, it can add unnecessary confusion and cause the public to question
the government's long term intentions for the parcel.
Unique zoning challenges are created with regard to planning for the location of facilities
related to public services.

FINDINGS:
· Provision of public services is an integral component of municipal government.
· The establishment of the Public Facilities district will eliminate future confusion and
distrust relating to the zoning of public lands and will support uses that have a direct
benefit to the public.
· The zoning district is consistent with the City's "Public/Semi-Public" and "Recreation
and Open Space" future land use classifications.
STAFF RECOMMENDATION:
Staff recommends that the Planning & Zoning Board/LPA hold a Public Hearing related to
Ordinance 2007-17, and make recommendation of Approval to the City Commission regarding
the establishment of a new zoning district entitled "PF - Public Facilities"

ORDINANCE NO. 2007-17
AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY,
FLORIDA, AMENDING CHAPTER 20, ZONING, OF THE
CODE OF ORDINANCES; ESTABLISHING A NEW ZONING
DISTRICT RELATING TO PUBLIC FACILITIES;
ESTABLISHING AN INTENT AND PURPOSE,
ESTABLISHING PERMITTED AND CONDITIONAL USES,
ESTABLISHING BULK REGULATIONS; PROVIDING FOR
THE REPEAL OF PRIOR INCONSISTENT ORDINANCES
AND RESOLUTIONS; PROVIDING FOR INCORPORA TION
INTO THE CODE; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under S 2(b), Art. VIII of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, the provision of public services is an integral component of municipal
government; and
WHEREAS, unique zoning challenges are created with regard to planning for the location
of facilities related to public services; and
WHEREAS, the City Commission desires to create a new zoning district to specifically
provide for public service facilities; and
WHEREAS, the City Commission ofthe City of Winter Springs, Florida, hereby finds this
ordinance to be in the best interests of the public health, safety, and welfare ofthe citizens of Winter
Springs.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by
reference as legislative findings of the City Commission of Winter Springs.
Section 2. Code Amendment. The City of Winter Springs Code Chapter 20, Zoning, is
hereby amended as follows (underlined type indicates additions and strikeout type indicates
deletions, while asterisks (***) indicate a deletion from the Ordinance of text existing in Chapter

20. It is intended that the text in Chapter 20 denoted by the asterisks and set forth in this Ordinance
shall remain unchanged from the language existing prior to adoption of this ordinance):

DIVISION 6.5. PUBLIC FACILITIES DISTRICT
Sec. 20-214. Intent and purpose.
The provisions of this district are intended to apply to lands suitable for uses which directly
benefit the public, including the administrative activities of a municipal, county, state or federal
agency. educational facilities, public utility facilities. outdoor recreation and other public purpose
facilities generally providing a direct benefit to the community and which are consistent with the
City's "Public/Semi-Public" and "Recreation and Open Space" future land uses.
Sec. 20-215. Uses permitted.
Within the Public Facilities Zoning District. no building, structure, land. or water shall be
used except for one (1) or more of the following public uses:
ill Fire protection facility:
m Government administrative office;
ill Police facility:
m Public parking facility:
ill Post office branch or substation:

ill Public library, museum or other cultural facility:

Sec. 20-216. Conditional uses.
ill Telecommunications towers pursuant to the provisions of section 20-451 of the city
code.
ill Other public uses of land approved by the city commission in furtherance of a public
purpose.
Sec. 20-217. Buildinl: heil:ht rel:ulations.
No building or structure shall exceed fifty (50) feet in height. except telecommunication
towers regulated by 20-451 of the city code.
Sec. 20-218. Bulk rel:ulations.
Unless otherwise approved by the City Commission in furtherance of a public purpose, the
following shall apply:
ill Minimum front setback: twenty-five (25) feet.
.en. Minimum rear and side setback: fifteen (15) feet.
ill The total impervious surface area shall not exceed seventy-five percent (75%) of the
total site.

Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior
inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances
and resolutions in conflict herewith, are hereby repealed to the extent of the conflict.

Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the
Winter Springs City Code and any section or paragraph, number or letter, and any heading may be
changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like
errors may be corrected and additions, alterations, and omissions, not affecting the construction or
meaning of this Ordinance and the City Code may be freely made.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substanti ve, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this ordinance.
Section 6. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City
Charter.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular
meeting assembled on the _ day of , 2007.
