DISCUSSION ON ESTABLISHMENT OF AN ANNEXATION BOARD

APPLICABLE LAW AND PUBLIC POLICY:
The provisions of Section 2.03 of the City Charter which states "The commission of the
City of Winter Springs, Florida, may propose by ordinance to annex an area of
contiguous, compact, unincorporated land to the territorial limits of the municipality; or
upon petition by all landowners of real property which is contiguous, reasonably compact
and unincorporated, the City of Winter Springs, may annex said land to the territorial
limits of the municipality by ordinance. The procedure to be followed in the annexation of
territory shall be as set forth in Chapter 171, Florida Statutes as it now exists or as it may
be renumbered and amended."
The provisions of Sec. 20-51 of the City Code which states "There is hereby created a
planning and zoning board for the city."
The provisions of Sec. 20-57 of the City code which state in part ". . . .The board shall
recommend the boundaries of districts and appropriate regulations. In addition thereto,
the planning and zoning board shall serve as the local land planning agency. . . ."
The provisions of 163.3174(4) which states "The local planning agency shall have the
general responsibility for the conduct of the comprehensive planning program.
Specifically, the local planning agency shall: . . . .(d) Perform any other functions, duties,
and responsibilities assigned to it by the governing body or by general or special law."
The City Commission's expression of interest in annexation as stated at its August 14,
1995 meeting, adopting by consensus the proposed Joint Planning Area Map.

Staff has sent letters of interest and made phone calls to property owners in the
enclaves inviting them to consider annexation into the City.

Staff has prepared a Priority Property Annexation Map.
