CITY COMPREHENSIVE PLAN AMENDlVIENT TO THE LAND USE ELEMENT VOLUME 2 OF 2 GOALS, OBJECTIVES AND POLICIES DERIVED FROM THE S.R. 434 CORRIDOR VISION PLAN (LG-CP A-2-97) STAFF REPORT: APPLICABLE LA \V AND PUBLIC POLICY:.. The provisions of 163.3174(4) Florida Statutes which states "Be the agency (Local Planning Agency) responsible for the preparation of the comprehensive plan or plan amendment and shall make recommendations to the governing body regarding the adoption or amendment of such plan. During the preparation of the plan or plan amendment and prior to any recommendation to the governing body, the Local Planning Agency shall hold at least one public hearing, with public notice, on proposed plan or plan amendment." The provisions of Sec. 2-57 of the City Code which state in part ". . .the planning and zoning board shall serve as the local planning agency pursuant to the county comprehensive planning act and the local government comprehensive planning act of the state. . ." I. BACKGROUND: APPLICANT: City of Winter Springs 1126 East S.R. 434 Winter Springs, FL 32708 (407) 327-1800 REQUEST: For the local Planning Agency to review and recommend the requested changes to the City's Comprehensive Plan Land Use Element Goals, Objectives and Policies (Volume 2 of2). October 21, 1997 1 LG-CPA-2-97 PURPOSE: \, The City Commission held a joint workshop with the Planning & Zoning Board/Local Planning Agency concerning the Town Center and State Road 434. The Commission directed staff to hire a consultant to prepare a S.R. 434 Corridor Vision Plan. The Plan was to recommend ways to improve the corridor between U. S. 17/92 to Hayes Road, to ensure that development that will occur along those presently undeveloped areas of the corridor is done in a manner that emphasizes aesthetics, efficiency of land use, and economic benefit to the City and its residents. EXISTING CONDITIONS: REDEVELOPNIENT AREA: The area along State Road 434 between U.S. 17/92 and Hayes Road is a commercial district that developed through the years without Land Development Regulations that promote integrity of design and attention to aesthetic considerations. As a result, this commercial district has experienced the problems of many older commercial areas with loss of business brought on by lack of identity, visual clutter, etc. This developed area is currently characterized by overhead utilities, lack of street trees and landscaping, and excessive asphalt. NEW DEVELOPMENT AREA: This area currently has a rural character with considerable vacant land, scattered residences, and some environmentally sensitive areas. Traffic flow is fairly unimpeded throughout this area. The recent widening to four (4) lanes of S.R. 434 as a divided urban arterial has increased the ease of traffic flow which is fairly unimpeded throughout this area. TOWN CENTER: This area has extensive vacant land, part of which is a county enclave near the intersection of S.R. 434 and Tuskawilla Road, but also includes the City Hall, the 59 acre Central Winds Community Park, the Winter Springs High School and the U.S. Post Office. The intent of the City is create a focus (as indicated in the Traffic Circulation Element Objective A Policy 3 c.) "of a primary civic, business and service focus for the City." CHRONOLOGY: * The S.R. 434 Corridor Vision Plan was presented to the May 20, 1995 Visioning Workshop with representatives of the City Commission, Planning & Zoning Board, other boards, and the public in attendance. At the workshop a graphic depiction of the three subareas of the S.R. 434 Corridor was presented showing the "Redevelopment Area", the "Town Center", and the "New Development Area". There was agreement on the need for division into three (3) areas. I\: The City Commission at its June 9, 1997 meeting adopted Ordinance 661 creating a "Town Center" Overlay Zoning District. October 21. 1997 2 LG-CPA-2-97 * The City Commission at its September 8, 1997 meeting adopted Ordinance 676 instituting the Town Center Overlay Zoning r:\~rict Regulations (Design Guidelines). * The Planning & Zoning Board!Local Planning Agency completed its review of the S.R. 434 Corridor Design Guidelines for the New Development Area on October 2, 1996. * The City Commission held workshops on the "New Development Area" Overlay District Regulations (Design Guidelines) of the State Road 434 Corridor Vision Plan on December 9, 1996, January 6 and 20, 1997. Additional workshops were held on February 4th, March 3rd, and April 21st, 1997. ' . * Due to substantial changes suggested by the City Attorney to the "New Development Area" Overlay Zoning District Regulations, the City Commission scheduled a first reading of Ordinance 675 on October 27, 1997. * The City Commission adopted Ordinance 670 at its July 28, 1997 meeting creating a "New Development Area" Overlay Zoning District, and to direct staff to develop a comprehensive plan amendment and zoning change that would be in accordance with the New Development Area Design Guidelines for the State Road 434 Corridor Vision Plan. * The City Commission adopted Ordinance 672 at its August 11, 1997 meeting creating a "Redevelopment Area" Overlay Zoning District, and directed staff to develop a comprehensive plan amendment and zoning change that would be in accordance with the Redevelopment Area Design Guidelines for the State Road 434 Corridor Vision Plan. * The Planning & Zoning Board!Local Planning Agency completed its review of the S.R. 434 Corridor Design Guidelines for the Redevelopment Area on August 20, 1997. * Due to substantial changes suggested by the City Attorney to the "Redevelopment Area" Overlay Zoning District Regulations, the City Commission scheduled a first reading of Ordinance 683 on October 27, 1997. II. COMPREHENSIVE PLAN AMENDMENT ANALYSIS: The following summarizes the data and issues which staff analyzed in reviewing this application. In discussions during the Visioning Workshop held on May 20, 1995, it was decided that a series of goals, objectives and policies for the three areas of the S.R. 434 Corridor would be October 21,1997 LG-CPA-2-97 3 developed along with an overall vision statement. The consultant developed the vision statement and the go~, objectives and policies from the results of the Visioning Workshop. These statements were then reviewed and revised by the City staff and the S.R. 434 Property Owners Committee, and are. presented below. CHANGES TO VOLUME 1 OF 2 CITY OF \VINTER SPRINGS COMPREHENSIVE PLAN 1990-2010, THE LAND USE ELEMENT DATA, INVENTORY & ANALYSIS. NOTE: There are no new'data and analysis that wil1 replace or be added to the existing data and analysis of the Land Use Element. CHANGES TO VOLUME 2 OF 2 CITY OF \VINTER SPRINGS COMPREHENSIVE PLAN 1990-2010, THE LAND USE ELElVIENT GOALS, OBJECTIVES, AND POLICIES. NOTE: The following Vision Statement, Goals, Objectives, and Policies will be in addition to the existing Land Use Element Goals, Objectives and Policies to form a separate section in the Land Use Element Volume 2 of2 and begin on page 25. S.R. 434 CORRIDOR VISION PLAN: VISION STATEMENT: Create and preserve a pleasant view while traveling along the corridor with the perception being a "Green Image" characterized by canopy trees (existing and planted), planted or natural landscape buffers, controlled signage and site access, reasonable parking and building setbacks and other site development standards. A. GOALS, OBJECTIVES AND POLICIES: 1. General: The fol1owing Goals, Objectives and Policies apply to all areas in the S.R. 434 Corridor: Goal I: High Quality Development Enhance the visual quality, promote design excel1ence, and build a distinctive image to the S.R. 434 Corridor. Objective 1.1 Provide a uniform basis to establish quality development along the S.R. 434 Corridor through the development of Design Standards and Guidelines that shall include all design elements necessary to ensure the desired appearance for the S.R. 434 Corridor through the City of Winter Springs. October 21, 1997 4 LG-CPA-2-97 Policy 1. 1.1 Adopt Design Standards and Guidelines as part of the revised Land Development Regulations of the City as required by 163.3202(3) F.S., which would provide the basis for subsequent adoption and implementation of recommended procedures and regulations. Objective 1.2 While recognizing that S.R. 434 Corridor through the City of Winter Springs is urbanizing, preserve and enhance the remaining natural environmental features. Policy 1.2.1 Review development proposals within the environmentally sensitive areas of the S.R. 434 Corridor in accordance with Policies 1-8 of Objective B and Policies 1-6 of Objective C in the Conservation Element of the City's adopted Comprehensive Plan. Goal 2: Landscape Corridor Ensure that the S.R. 434 Corridor through the City of Winter Springs is developed into a well-landscaped, scenic gateway. Objective 2.1 Develop landscaping standards for new development and encourage landscaping of existing property in the corridor. Policy 2.1.1 Adopt landscaping standards for the S.R. 434 Corridor. Policy 2.1.2 All commercial, office, and garden apartment development shall be required to plant trees within parking areas for shade and visual relief Objective 2.2 Work with the Florida Department of Transportation to install "green" medians between U.S. 17-92 and S.R. 419. Median openings shall be maximized to the greatest extent possible to promote economic viability. Policy 2.2.1 The City will develop an "Adopt-a-Median" program in cooperation with the Florida Department of Transportation. Policy 2.2.2 The manner of landscaping and the materials to be used for roadway medians shall be consistent with an urban theme planting. Objective 2.3 Develop a voluntary public/private cooperative effort for landscaping and maintenance involving the City, the business interests along the S.R. 434 Corridor and other interest groups. Policy 2.3.1 Present a public awareness/education program to the businesses and community concerning the landscapinglstreetscaping project for the S.R. 434 Corridor. October 21, 1997 5 LG-CPA-2-97 Goal 3: Visual Aesthetics Prevent visual pollution of S.R. 434 Corridor caused by unplanned and uncoordinated uses, buildings and structures. Objective 3.1 Develop a unifying "theme" to the S.R. 434 Corridor recognizing some measure of the existing diversity of character. Policy 3.1.1 Adopt architectural design standards for the S.R. 434 Corridor which are compatible with the surrounding area. October 21, 1997 6 LG-CI' A-2-97 Objective 3.2 Policy 3.2.1 Policy 3.2.2 Policy 3.2.3 Objective 3.3 Policy 3.3.1 Objective 3.4 Policy 3.4.1 Goal 4: Objective 4.1 The Development Review Committee shall serve as the Corridor Design Review Board for development in the S.R. 434 Corridor\nd shall review such developments for a unifying theme according to the architectural design standards and make recommendation to the Planning and Zoning Board. Review developments within the S.R. 434 Corridor for architectural appropriateness based on the architectural design standards in the S.R. 434 Corridor contained in Section 20-348. The City shall not issue building permits for any proposed development within the Corridor unless development proposals have been reviewed by the Corridor Design Review Board for recommendation to the Planning and Zoning Board. Any requests for variances to the development standards of the S.R. 434 Overlay District shall require review by the Development Review Committee for recommendation to the Board of Adjustment. Develop standards for the facilitation of underground relocation of utility lines, and relocation of street light standards and traffic signals. The City shall enter into negotiations with Florida Power Corporation to develop an arrangement to place electrical lines underground along the S.R. 434 Corridor. Improve the appearance of the S.R. 434 Corridor gateways at corporate boundaries to the City of Winter Springs with special "entrance to the City" signage and associated landscape arrangement. Work with the City of Long wood to improve the major gateway entrance to S.R. 434 at U.S. 17-92. Corridor Function Maximize traffic circulation functions of S.R. 434 through the City of Winter Springs from the standpoint of safety, roadway capacity, vehicular and nonvehicular movement. Coordinate/cooperate with Florida Department of Transportation in creating the most appropriate and desirable transportation design standards and controls for S.R. 434 Corridor and S.R. 419. October 21, 1997 LG-CPA-2-97 7 Policy 4.1.1 Policy 4.1.2 Objective 4.3 Policy 4.3.1 Policy 4.3.2 GoalS: Develop an Access Management Plan for the S.R. 434 Corridor that will balance the goals of promoting eco~rnic viability and protecting the carrying capacity of the roadway. Require cross-access easements between adjacent commercial or office properties. as applOpt iate at titHe of site plali appt 0 v al. Develop a system that utilizes various transportation modes in the S.R. 434 Corridor. Sidewalks shall be provided along both sides of S.R. 434 . Provide an appropriately located nonmotorized multi-purpose trail crossing point over S.R. 434 east of S.R. 419 linking to the proposed Cross Seminole Trail and Florida National Scenic Trail on the north side of the corridor. Property Values To maintain and enhance the property values along the S.R. 434 Corridor through the City of Winter Springs. Objective 5.1 Recognize that allowances must be made for existing uses, committed uses, existing buildings, existing structures and existing parcels that are unable to conform to new uniform design standards. Policy 5.1.1 The City shall recognize the existence of non-conforming uses and structures that existed prior to the adoption of the design standards and goals, objectives and policies for the S.R. 434 Corridor Overlay District. Objective 5.2 Accommodate the ever changing market demands and needs of the Corridor to the greatest extent possible. Policy 5.2.1 The Planning and Zoning Board/Local Planning Agency shall review the design standards and goals, objectives and policies of the S.R. 434 Corridor Overlay District and make recommendation to the City Commission for appropriate changes. 2. Redevelopment Area: The following Goals, Objectives and Policies apply to the Redevelopment Area only: Goal 1 To encourage high quality development that will strenghten the tax base and remove blighting influences. October 21. 1997 LG-CPA-2-97 8 \ Objective 1.1 Enhance and build upon the individual attributes and diversity of character of areas along S.R. 434 between U.S. 17-92 and Hayes Road. Policy 1.1. 1 Designate the portion of the corridor between U. S. 17-92 and Hayes Road as a Community Redevelopment Area with a Community Redevelopment Agency and establish Tax Increment Financing to support redevelopment activities, in accordance with Objective C under Goal 1 of the Land Use Element of the City's adopted Comprehensive Plan. 3. Town Center: The following Goals, Objectives and Policies apply to the Town Center Area only: Goal 1: Develop a Town Center that will become the identifying focus of the City of Winter Springs. Objective 1.1 The Town Center should be centered around the existing public facilities of the City Hall, the new Winter Springs High School, the Central Winds Community Park, and the Post Office. Policy 1.1.1 Revise the Future Land Use Map to include those parcels indicated in Objective 1.1 in the designation of "Public Buildings". Policy 1.1.2 Include all the parcels indicated in Policy 1.1.1 as well as those parcels in private ownership in the Town Center between Orange Avenue, S.R. 434 and Tuscawilla Road. Policy 1.1.3 Revise appropriate maps in the Future Land Use Map series to identify a "Town Center" . Policy 1.1.4 Develop specific land development regulations for the Town Center, incorporating streetscape measures to create the visual unity and sense of identity to the Town Center. C. CONSISTENCY/COlVIPATIBILITY WITH CITY AND STATE COMPREHENSIVE PLAN: 1. WITH THE CITY CO:MPREHENSIVE PLAN: This City initiated comprehensive plan amendment is intended to address the provisions of 163.3167(11) F.S. which states "Each local government is encouraged to articulate a vision of the future physical appearance and qualities of its community as a component of its local comprehensive plan. The vision should be developed through a collaborative planning process with meaningful public participation and shall be adopted by the governing body of the jurisdiction."
