REQUEST: City Manager requesting authority from the City Commission to enter into an
emergency contract with R.A. Rogers Construction Company to construct sidewalk
improvements in front of Building 3 in the Town Center in an amount not to exceed
$66,736.
PURPOSE: This agenda item is needed for the City to partner with the James Doran
Company (JDC) to change the scope of sidewalk construction on the Tuskawilla Road side
of Building 3, in the Town Center, in time for opening of Building 3.
CONSIDERATIONS:
· Town Center Building 3 is currently under construction at the northwest comer of
Tuskawilla Road and Tree Swallow Drive. Building 3 is expected to be complete
within the next 30-60 days.
· The original design plans for Building 3 maintained the existing angled on-street
parking in front of the building along Tuskawilla Road.
· The City desires to have the on-street parking in front of Building 3 converted to
parallel parking to create wider sidewalks along Tuskawilla Road, similar to the
existing sidewalks in front of buildings 1 and 2. In addition, the Building 3 finished
floor elevation has been set based on the planned conversion to parallel parking.
Based on this finished floor elevation, it would be difficult to maintain the existing
diagonal parking and still meet sidewalk design standards.
· The City had originally planned to complete the conversion to parallel parking in
front of Building 3 as a City project at a later date. However, with the ongoing
construction of Building 3 there is an opportunity to partner with JDC and complete
this conversion now by the same contractor (R.A. Rogers), who is constructing
Building 3. This approach expedites the project, minimizes the potential for

construction conflicts, and reduces the City's costs by eliminating items such as
demolition and mobilization fees.
· The change to parallel parking in front of Building 3 converts the 10 existing angled
spaces into 5 parallel spaces, for a net loss of 5 parking spaces.
EMERGENCY STATUS:
· The sidewalk area in front of Building 3 is a public safety hazard due to demolition
of public sidewalk that was required for construction of the new building.
· The James Doran Company has tenants scheduled to move into Building 3 within
the next 60 days.
· The sidewalk in front of Building 3 must be complete before tenants can occupy
the building.
· In order to meet the planned opening date for Building 3 it will be necessary for the
City to proceed immediately with construction under a negotiated contract with
R.A. Rogers Construction Company in order to coordinate building construction
with sidewalk construction in the most expeditious manner.
LEGAL AUTHORITY:
· Florida Statutes, Section 255.0525(a) allows municipalities to negotiate
construction projects in an amount less than $200,000 without bidding.
· City Code, Section 2-152(vii) allows the Commission to make emergency
purchases without bids when the Commission deems the purchase to be within the
best interest of the City.
FUNDING:
Funding for the Building 3 Sidewalk Project is the Road Improvements Fund (115-
65000-30011) in an amount not to exceed $66,736.
RECOMMENDATIONS:
It is recommended that the City Commission do the following:
1) Make a finding that an emergency condition exists to warrant emergency
authorization and funding for the Building 3 Sidewalk Project, due to the fact that
the time involved to publicly bid this project creates a hardship on the Developer
(JDC) and extends a public safety hazard.

2) Authorize the City Manager to enter into an emergency contract with R.A. Rogers
Construction Company to construct sidewalk improvements for the Building 3
Sidewalk Project in the amount of $66,736.

The cost to incorporate Starmer Ranaldi Planning & Architecture Inc. "Bldg. 3 and 4 Side~Walk
Re-Design" sheets A 1 and A2 dated August 17, 2006 $66,736. Please find attached the cost
breakdown your review. Please also consider the following when evaluating the numbers.
1. We have not included building permit costs as a part of this cost.
2. We have not included any electrical work to new tree wells or for Progress Energy.
3. We have not included any landscape work..
4. We have not included any work beyond the Building 3 limits. This cost is based on all work from
Tree Swallow Drive north up to and including the sixth tree well.
Additionally, you have requested an estimate for sidewalk only to tie in to the building and the
existing sidewalk and hardscape section. We've estimated this cost to be $3,329.
Please allow for 4 to 5 weeks for paver delivery and installation work will follow.
If this cost is acceptable, please sign the attached proposal and fax back to my attention.
