LAKE IRENE INVESTORS REZONING (REZ-3-97) STAFF REPORT: APPLICABLE LAW AND PUBLIC POLICY: Sec. 20-57 of the City Code states "The planning and zoning board shall serve. . .to recommend to the City Commission the boundaries of the various original zoning districts. . .and any amendments thereto. . .acto on measures affecting the present and future movement of traffic, the segregation of residential and business districts and the convenience and safety of persons and property in any way dependent on city planning and zoning." 1. REZONING ANALYSIS: THE FOLLOWING SUMMARIZES THE DATA AND ISSUES WHICH STAFF ANALYZED IN REVIEWING THIS APPLICATION. A. JUSTIFICATION FOR REZONING: 1. The applicant has requested anoexation into the City of9.58 acres prompting a small scale comprehensive plan amendment. 2. The owners propose developing the parcel for neighborhood commercial as a'. Wino-Dixie Grocery Store and therefore have requested the City's C-l "Neighborhood Commercial" zoning designation B. NUISANCE POTENTIAL OF PROPOSED REZONING TO SURROUNDING LAND USES: 1. The applicant's proposed zoning change from county zoning designation PUD "Planoed Unit Development" to the City's zoning designation ofC-l "Neighborhood Commercial District" is the same zoning of the adjacent and nearby parcels along S.R. 434. 2. The applicant's proposed land use is compatible with the commercial nature of S.R. 434 and the existing commercial establishments in the area. III. ~ . The owners proposed land use is compatible with the commercial nature of S.R. 434. . The adjacent and nearby parcels are indicated as "Commercial" on the City's Official Future Land Use Map. * The county had the parcel zoned PUD, which allows for commercial development (Sec. 30.442 County Land Development Regulations page 30-231). * Nearby parcels are indicated as C-1 ''Neighborhood Commercial" on the City's Official Zoning Map. IV. STAFF RECOMMENDATION: Staff recommends the Planning & Zoning Board recommend approval to the City Commission the request for rezoning by Ken Leffler, representing the Lake Irene Investors, Inc., of the 9.58 acre parcel from county zoning designation PUD "Planoed Unit Development" to City zoning designation C-1 ''Neighborhood Commercial District", based on the findings above. The owners, known among themselves as the Lake Irene Investors, have contracted to sell this parcel for developmcnt of a new Winn-Dixie store. Hopefully your received a copy of the initial site plan and legal description which were delivered to your attention at the Winter Springs City Hall today. We anticipate that thc petition will be made in the names of one or morc of the owners whose names and addresses r shall provide when we meet to formally initiate the petition.
