I. Call to Order
Chairperson Fernandez called the meeting to order at 7:04 p.m. in the Commission chambers,
Municipal Building.

Motion: Approve minutes as submitted.
Motion by Lein. Second by Stephens.

Motion carried.
Hoffinann stated a correction on page 2 of the minutes. 4th paragraph, second line, reads: Hoffmann
said that the minimum separation is 2000 feet which is five towers per mile. Correction: Hoffinann
said that the minimum separation is 2000 feet which is 2rJ,7~ towers per mile.
II. New Business

A) Sanlando (Button) Small Scale Comprehensive Plan Amendment SM-CPA-1-97
The Chair announced that the board will be recognized as the Local Planning Agency for Item (A).
There was no response from the members regarding ex-parte communications.
Sanlando is the applicant on the Button property, and they are requesting a small scale comprehensive
plan amendment involving a change of future land use designation from the County's Suburban
Estates to the City's Lower Density Residential. This is as result of the applicants request for
annexation. The applicants purpose is to bring the property into the city for water and sewer, and
to develop a single family residential subdivision as R- I A. The property is located at the SW corner
of Orange Ave and Tuskawilla Road.
Grimms gave his educatior.lllemployment background per the request of the Chair.

Grimms read the findings and staff recommendation from an agenda item attachment.
Lein wanted to know why the board is being asked to take a piece of property in the town center and
make it residential. Grimms said that he considered the land uses of the surrounding properties.
There is residential to the north, and a soon-to-be developed residential community adjacent to the
subject parcel. There are no plans for Tuskawilla Road to be widened to four lanes north of S.R. 434,
or for Orange Avenue to be upgraded. Lein asked if mixed use would be better instead of lower
residential. Grimms estimated that there isn't a lot that can be done with 9.9 acres in terms of mixed
use.
Stephens asked about the lnd to the north of the subject parcel. Grimms stated that the land north
of Orange Avenue is low density residential, and beyond that is conservation area all the way to the
lake. The subject property is presently designated by the County Suburban Estates which is one
dwelling unit per acre.
A couple of Orange Avenue residents have stated their opinions and objections to Grimms. PVD
zoning was also mentioned.
There aren't any wetlands, but the developer may have to bring in dirt for packing, and it's not within
the 100 year floodplain area.
Doug Maze, 308 Apair Avenue, Longwood, is applying for what he thinks is the best use for the
property. He is buying the property from the Buttons.
Motion: Accept the land use designation from it's current designation which is County Suburban to
Low Density Residential with the maximum of3.5 dwelling units per acre with the findings of the
land developer and the recommendations of this board.
Motion by Hoffmann. Second by Brown.
Vote: Lein, nay; Fernantlez, aye; Stephens, aye; Brown, aye; Hoffmann, aye.
Motion passed 4 to I.

B) Sanlando (Button) Rezoning REZ-1-97
Fernandez stated that this is the same parcel of property as in Item A. The applicant is requesting
a change of zoning from Agricultural to R-I A (single family dwelling district, 800 sq. ft. minimum).
Part III (Findings) and Part IV of the staff report are incorporated herein by reference only.
Grimms said he called FDOT, and they don't seem to have a problem with it.
Item II (D) of the staff report should be corrected to read: The proposed rezoning would be
compatible.. .
Maze said the homes are in the $150,000 to $190,000 price range, and similar to the homes in
Winding Hollow. He estimates that it will be 2.7 units per acre. The access will be off of Tuskawilla

Road. There will be a homeowner's association, and public roads. The portion of the development
along Orange Avenue will have a brick or landscaped wall in order to keep the rural character for the
neighboring residence. Maze said that he is not aware of any lake privileges. A large portion of the
buffer between the property and the high school is the retention pond, and the trees along the lot line
will be kept.
Motion: The Planning and Zoning recommends to the City Commission the staffs recommendations
for the LPA to recommend approval of the Sanlando Land Inc. for city zoning designation ofR-1A
on the 9.9 acre parcel based on the findings indicated in the submitted data for the P & Z Board
agenda item on REZ-I-97.
Motion by Brown. Second by Stephens.
Vote: Stephens, aye,- Brown, aye,- Hoffmann, aye,- Lein, nay; Fernandez, aye.
Motion carried.
Lein suggested having a moratorium on what is being done in the town center area until we find out
what direction the CommissIon is going. Brown agreed, but felt it was up to staff to determine when
these items are brought to the P & Z Board. Discussion.
The Small Scale Comprehensive Plan Amendment and the Rezoning will be presented for the first
reading at the January 27, 1997 Regular City Commission Meeting. The second reading will occur
on February 10, 1997 at the Regular City Commission Meeting.
Department of Community Affairs only reviews small scale amendments when there is a challenge
made.
Chairperson Fernandez said that he looks for leadership from the City Commission if they think the
P & Z Board is not in sync.
C) Review of Draft Telecommunications Tower Ordinance

(6) Lein expected the change regarding the revenue sharing as written in last month's minutes to be
made. Consensus to add: The fees shall apply separately to each antenna user on the tower or other
support structures. Fee rates shall be renegotiable annually.
(c)(1) First line, add "and antennas" after the word Towers.

(d)(I) Lein suggested including "Conservation Areas". Chairperson Fernandez said he is concerned
about preserving conservation areas.
(e) "or denied approval" should be shaded to signifY the boards recommendation.

(5) Question was raised whether to add the "Federal Communications Commission" to (5) and (6).

(c) Last line: Delete "super" from the word "superimposed", and change the word "from" to "by".
(d) Add at the end of the paragraph: "Tower owners shall make reasonable effort to accommodate
other antenna users on their towers".
(8) Change to read: For purposes of this ordinance, notice of any special exception request shall be
published in a newspaper of general circulation, and personal notification shall be given to all property
owners located within three times the height of the tower area.

(IO)(b) Change to read: Access to the tower through the fence or wall shall be through an automatic

something away or fine them. The third line from the bottom should two hundred and seventy (270),

that the city should not have to pay if the owner is in bankruptcy, and suggested a bond be required.
Hoffmann suggested adding a (3) to read as follows: "A performance bond to assure dismantling
costs shall be provided by the owner prior to a tower construction permit."

Consensus to make changes without the approval of the minutes. Grimms will present the ordinance
to the Commission on January 27,1997.
Lein requested that the P & Z Board revisit the Comprehensive Plan Amendment to eliminate certain
collector roads and transportation impact fees that were discussed at the August 16, 1995 meeting.
Chairperson Fernandez said the City Manager does not want to address the issue until after the
Conklin, Porter, and Holmes traffic report has been received. Grimms displayed a drawing involving
the Tuskawilla Bypass, the Bahama Extension, and a modified Winter Springs Loop. It encompasses
a concept of what the town center could be.
