REQUEST:
Mayor John F. Bush in coordination with the Council of Local
Governments in Seminole County (CALNO) requests that the City
Commission review and approve Resolution Number 2007-03 related to
encouraging Land Developers to participate in the Seminole County Public
School District's voluntary Capacity Mitigation Program.
PURPOSE:
The purpose of this Agenda Item is for the City Commission to authorize
the approval of Resolution Number 2007-03 related to encourage Land
Developers to participate in the Seminole County Public School District's
voluntary Capacity Mitigation Program.
CONSIDERATIONS:
The City of Winter Springs is being asked to offer their support to
encourage Land Developers to participate in the Seminole County Public
School District's voluntary Capacity Mitigation Program, through the
approval of Resolution Number 2007-03.
FUNDING:
No funding is needed at this time.

RECOMMENDATION:
The City Commission is requested to review and approve the attached
Resolution Number 2007-03, requesting the City's support to encourage
Land Developers to participate in the Seminole County Public School
District's voluntary Capacity Mitigation Program.

RESOLUTION NUMBER 2007-03
A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA ENCOURAGING LAND DEVELOPERS TO
P ARTICIP ATE IN THE SEMINOLE COUNTY PUBLIC SCHOOL
DISTRICT'S VOLUNTARY CAPACITY MITIGATION
PROGRAM; PROVIDING FOR CONFLICTS, SEVERABILITY,
AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs recognizes that
quality public schools enhances the quality of life of City residents and the opportunities of
our children to be successful in life; and
WHEREAS, the Seminole County Public School District has a proven track record of
excellence in the provision of a quality education to children within Seminole County and the
City of Winter Springs, Florida; and
WHEREAS, land use and density changes, the State Class Size Amendment, scarcity
of adequate school sites, decreased PECO funding, infill development, and construction cost
increases continue to impose challenges to the School District in providing the necessary
public school facilities to meet the demands of residential development; and
WHEREAS, the School District has developed a voluntary School Capacity
Mitigation Program to augment funding for its Capital Improvements Program to construct
the necessary public school facilities to meet the demands of residential development; and
WHEREAS, said voluntary School Capacity Mitigation Program has been reviewed
and is supported by the Seminole County Educational Growth Steering Committee; and
WHEREAS, said voluntary School Capacity Mitigation Program establishes capacity
mitigation amounts of $2,674.00 per single family dwelling unit and $1,235.00 per multi-
family dwelling unit to be paid in addition to school Impact Fees collected for residential
development; and
WHEREAS, said voluntary Capacity Mitigation Program is temporary and will
remain in effect until completion of the School District's Funding Study and any resultant
changes are made to the School District's funding sources; and
WHEREAS, participation of land developers in the School District's voluntary
Capacity Mitigation Program will assist the School District in funding its Capital
Improvements Program to construct the necessary public school facilities to meet the
demands of residential development.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION 1. The City Commission of the City of Winter Springs hereby
encourages land developers to participate in the Seminole County School District's voluntary
Capacity Mitigation Program.
SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with
any of the provisions of this Resolution are hereby repealed.
SECTION 3. Severability. If any Section or portion of a Section of this
Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate
or impair the validity, force, or effect of any other Section of part of this Resolution.
SECTION 4. Effective Date. This Resolution shall take effect immediately upon
its passage by the City Commission of the City of Winter Springs, Florida.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a
Regular Meeting assembled on the 8th day of January, 2007.
