REQUEST:
Mayor John F. Bush in coordination with the Council of Local
Governments in Seminole County (CALNO) request that the City
Commission review and approve City of Winter Springs' Resolution
Number 2007-02.
PURPOSE:
The purpose of this Agenda Item is for the City Commission to authorize
the approval of Resolution Number 2007-02 related to supporting the
Seminole County Public School District's initiative to update School
Impact Fees and encouraging the Seminole County Board of County
Commissioners to adopt a School Impact Fee update.

CONSIDERATIONS:
The City of Winter Springs is being asked to offer their support, through
the approval of Resolution Number 2007-02.
FUNDING:
No funding needed at this time.

RECOMMENDATION:
The City Commission is requested to review and approve the attached
Resolution Number 2007-02 requesting the City's support of the Seminole
County Public School District's initiative to update School Impact Fees
and encouraging the Seminole County Board of County Commissioners to
adopt a School Impact Fee update.

A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA SUPPORTING THE SEMINOLE COUNTY PUBLIC
SCHOOL DISTRICT'S INITIATIVE TO UPDATE SCHOOL
IMPACT FEES AND ENCOURAGING THE SEMINOLE
COUNTY BOARD OF COUNTY COMMISSIONERS TO ADOPT
SAID SCHOOL IMPACT FEE UPDATE; PROVIDING FOR
CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs recognizes that
quality public schools enhances the quality of life of City residents and the opportunities of
our children to be successful in life; and
WHEREAS, the Seminole County Public School District (School District) has a
proven track record of excellence in the provision of a quality education to children within
Seminole County and the City of Winter Springs; and
WHEREAS, School Impact Fees assist the School District in funding its Capital
Improvements Program to construct the necessary public school facilities to meet the
demands ofthe County's growing population; and
WHEREAS, School Impact Fees were adopted in 1992 and have not been updated to
keep pace with the impacts of Seminole County's growing population; and
WHEREAS, the School District retained the firm of TischlerBise Fiscal, Economic &
Planning Consultants, Inc. to study the need to update the School District's existing School
Impact Fees; and
WHEREAS, the firm of TischlerBise Fiscal, Economic & Planning Consultants, Inc.,
has prepared a Technical Report that proposes a School Impact Fee Schedule of $5,342.00 per
Single Family Detached dwelling unit, $2,564.00 per Townhome dwelling unit; $2,340.00 per
Multi-family dwelling unit; and $2,005.00 per Mobile Home dwelling unit; and
WHEREAS, the City Commission of the City of Winter Springs has determined:
1) That the proposed Impact Fee Schedule is necessary to help offset the costs to the
School District associated with meeting the necessary public school service and
facility demand created by projected new residential development; and
2) That the amount of the proposed School Impact Fee Schedule bears a reasonable
relationship to the burden imposed upon the School District to provide the new public
school facilities by new residential development; and
3) That the expenditure of the proposed School Impact Fees will result in a beneficial
use to such new residential development reasonably related to the Impact Fees, per
dwelling unit; and
4) That an "essential nexus" exists between the projected new residential development
and the need for additional public school facilities to be funded via the proposed
School Impact Fee Schedule; and
5) That the amount of the proposed School Impact Fees is "roughly proportional" to
the fair share of the additional public school facilities needed to provide adequate
service to new residential development.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION 1. The City Commission of the City of Winter Springs, Florida
hereby supports the Seminole County Public School District's initiative to update School
Impact Fees.
SECTION 2. The City Commission of the City of Winter Springs, Florida
encourages the Seminole County Board of County Commissioners to adopt said School
Impact Fee update.
SECTION 3. Conflicts. All Resolutions or parts of Resolutions in conflict with
any of the provisions of this Resolution are hereby repealed.
SECTION 4. Severability. If any Section or portion of a Section of this
Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate
or impair the validity, force, or effect of any other Section of part of this Resolution.
SECTION 5. Effective Date. This Resolution shall take effect immediately upon
its passage by the City Commission of the City of Winter Springs, Florida.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a
Regular Meeting assembled on the 8th day of January, 2007.
