FLORIDA 32708-2799 Telephone (407) 327-1800 Memorandum To: Date: Tuscawilla Lighting and Beautification District Advisory Committee Members I Andrea LorenZo-LU~rim City Clerk Amy LovinglOss, Clerk @U Tuesday, Apri113, 1999 Via: From: RE: Information from Board Member Linda TIllis I spoke to Board Member Tillis today and she advised me that she will not be attending tonight's Meeting. She did, however, ask me to pass along information regarding the clearance necessary for the Florida Power switchgear box on Vistawilla Drive. According to Board Member Tillis, Florida Power requires a clearance of five (5) feet encircling the box. Nothing "permanent" can be placed within the five (5) feet, although vegetation is acceptable, with the understanding they reserve the right to remove the vegetation, if necessary. They also do not permit any permanent structures between the box and the street. This is in the event that Florida Power would need to completely replace the box. Florida Power's easement is ten (10) feet and located on the property owner's side of the right-of-way. Board Member Tillis asked that I also convey her personal opinion on this matter. She feels that as long as tpe wall is constructed comp-Ietely within the right-of-way, as opposed to on the Florida Power easement, there should not be a problem. This is due to the fact that the wall is planned to be short in length and there would be access from either side. She also feels that the current plan for the design of the wall should not need to be changed and that a structure can be placed between the box and the street, as long as there are no permanent structures in the Florida Power easement and that there be the five (5) foot clearance encircling the box. She adds that Florida Power should not have a claim over the public right-of-way. This information will be elaborated on at the next meeting by Board Member Tillis, should you have any further questions. Thank YouT Copy: Ronald W. Mclemore, City Manager Kipton D.
