Meeting
REQUEST: The Community Development Department requests the City Commission review and
approve the updated official future land use map (FLUM) and official zoning map.
PURPOSE: To present the updated FLUM and official zoning map for consideration and adoption.
APPLICABLE LAW AND PUBLIC POLICY:
Section 20-102(c). Official zoning map update and annual approval.
The Community Development Department- Planning Division shall oversee the maintenance of the
official zoning map. It shall be the division's duty and responsibility to keep the zoning map up to
date. Maps shall be updated within ten (10) days following the adoption by the city commission of
an ordinance rezoning real property. In addition, the update shall include adding to the map's
database, a reference to the ordinance adopting the rezoning.
A copy of the official zoning map shall be presented annually to the Planning and Zoning Board for
review. During the review, the Board shall review the map for accuracy and situations where an
administrative rezoning may be appropriate. Upon completion of the review, the Planning and
Zoning Board shall issue a report to the City Commission pointing out any inaccuracies on the map
and any properties which maybe considered for an administrative rezoning. The City Commission
shall review the Planning and Zoning Board's report and make such decisions that are necessary to
update the City's official zoning map.
CONSIDERATIONS:
1. The City Code requires the annual update of the official zoning map in a permanent
fashion.
2. The City Code requires the updated zoning map to be presented to the Planning and
Zoning Board for consideration and recommendation each year, prior to approval by the
City Commission.

While not required by Code, the approval of a concurrent FLUM update provides
consistency between the future land use and zoning maps by ensuring that map
amendments affecting both future land use and zoning designations are properly
documented.
FINDINGS:
The updated zoning map incorporates all map amendments approved by the City Commission
from November 2007 through October 2008 and the updated future land use map incorporates all
map amendments approved by the City Commission from November 2007 through October
2008. These are shown below and graphically depicted in Attachment B:
CITYBOUNDARY CHANGES:
• Ordinance 2008-02; Annexation of 6.25 acres (Long property) located at 1379 West
State Road 434 (NE corner of SR 417 & SR 434); Adopted March 10, 2008.
• Ordinance 2008-17; Annexation of 7.5 acres (East Coast Believers Church Property)
located at 1072 West State Road 434; Adopted September 22, 2008.
URBAN CENTRAL BUSINESS DISTRICT BOUNDARY.•
Both the Future Land Use and Zoning Maps have been revised to include the Urban
Central Business District Boundary (UCBD), because special design criteria apply to
this area.
FUTURE LAND USE MAP AMENDMENTS:
• Ordinance 2007-24; Changed future land use designation of 7.54 acres (Tuscawilla
Golf Course Property) located immediately west of Chelsea Parc at Tuscawilla
Subdivision on Winter Springs Blvd. from (Winter Springs) "Recreation and Open
Space with Conservation Overlay" to (Winter Springs) "Medium Density Residential
with Conservation Overlay "; Adopted January 14, 2008.
• Ordinance 2008-03; Changed future land use designation of 6.25 acres (Long
property) located at 1379 West State Road 434 (NE corner of SR 417 c4c SR 434);from
(Seminole County) "Commercial with Conservation Overlay" to (Winter Springs)
"Greeneway Interchange District with Conservation Overlay "; Adopted Apri128,
2008.
• Ordinance 2008-18; Changed future land use designation of 7.5 acres (East Coast
Believers Church Property) located at 1072 West State Road 434 from (Seminole
County) "Commercial with Conservation Overlay" to (Winter Springs) "Greeneway
Interchange District with Conservation Overlay "; Adopted October 27, 2008.
• Ordinance 2008-23; Changed future land use designation of 2.6 acres (Richard E.
Roy and Kathleen J. Roy Property) generally located at 41 S Shore Drive from

(Winter Springs) "Public /Semi-Public " to (Winter Springs) "Rural Residential;
Adopted October 27, 2008.
Ordinance 2008-24; Changed future land use designation of 7.64 acres (City
Property) located adjacent to the City's West Effluent Disposal Site, from (Winter
Springs) "Rural Residential with Conservation Overlay" to (Winter Springs)
"Public/Semi-Public with Conservation Overlay "; Adopted October 27, 2008.
Conservation Areas; FLUE Policy 1.1.7 states: "A change from Conservation
Overlay' to a `Conservation' land use designation will not require State approval if
the area is already shown as `Conservation Overlay' on the Future Land Use Map. '
Therefore, areas having a `Conservation Overlay' designation that are included
within a conservation easement, such as the conservation easements associated with
The Greens at Tuscawilla are designated "Conservation ".
ZONING MAP AMENDMENTS:
• Ordinance 2007-25; Changed zoning designation of 8.74 acres (Dittmer, Elsea, and
Florida Ave LLC Property) located at Florida Avenue and Lake Lucerne Circle from
(Winter Springs) "C-2 " to (Winter Springs) "PUD "; Adopted December 10, 2007.
• Ordinance 2008-04; Rezoned 6.25 acres (Long property) located at 1379 West State
Road 434 (NE corner of SR 417 & SR 434); from (Seminole County) `Agriculture-1 "
to(Winter Springs) "Greeneway Interchange District "; Adopted April 28, 2008.
Ordinance 2008-11; Rezoned 9.04 acres (Phillips property) located adjacent to State
Road 419 and on the east and west side of Wade Street under the FP&L transmission
line; from (Winter Springs) "C-1 Neighborhood Commercial " to (Winter Springs)
"C-2 General Commercial "subject to use and other restrictions; Adopted September
8, 2008; Applicant reguest for Restrictive Rezoning has not been executed by the
Applicant, so the map amendment has not been implemented. (Once received, the next
map update will include the C-2 zoning with an asterisk and notation indicating the
restrictive rezoning.)
Ordinance 2008-12; Rezoned 28.9 acres (SJRWMD Property) at 1900 DeLeon Street
from (Seminole County) "A-3 " to (Winter Springs) "R-CI Single Family Dwelling
District "; Adopted Octoberl3 , 2008.
Ordinance 2008-19; Rezoned 7.5 acres (East Coast Believers Church Property)
located at 1072 West State Road 434 from (Seminole County) "Agriculture-1 "

PLANNING AND ZONING BOARD RECOMMENDATION: At a regular meeting of the
Planning and Zoning Board held on November 5, 2008, the Board voted unanimously to recommend
approval of the official future land use map and official zoning map.

STAFF RECOMMENDATION:
Staff recommends the City Commission adopt the updated Future Land Use Map and Official
Zoning Map changes.
IMPLEMENTATION:
Following the adoption of the Official FLUM and Official Zoning Map, Staff will submit copies
to the State and to Seminole County, and will post the updated maps on the City's Internet site.
A certified copy will be available for public display (as outlined in Section 20-102), and paper
and electronic copies will be made available for public purchase.

Tennis Courts Combined Preliminary And Final Engineering/Site Plan For
Relocation Of The Tennis Courts From The Recently Approved Tuscawilla Greens
Condominium Site To Another Area Within The Tuscawilla Golf And Country
Club.
Mr. John Baker, AICP, Senior Planner, Community Development Department presented
this Agenda Item and added, "Staff has looked at this and recommend that you
recommend Approval."
Regarding the removal of the trees, Chairman Heatwole asked, "They are aware that they
need to replace?" Mr. Baker responded, "Yes sir, they are." Chairman Heatwole
continued, "And that is not going to cause a problem with Arbor?" Mr. Baker stated,
"No sir."

Requests The Planning And Zoning Board/Local Planning Agency Review The Updated
Official Future Land Use Map (FLUM) And Official Zoning Map And Make
Recommendation Of Approval To The City Commission.
Ms. Eloise Sahlstrom, ASLA, AICP, Senior Planner, Community Development
Department introduced this Agenda Item and displayed the Future Land Use Map
(FLUM) November 2008 and the Zoning Map November 2008.
Ms. Sahlstrom informed the Board Members that "The Applicant's request for restrictive
Rezoning has not been executed, so the Map Amendment has not been implemented. I
will track this and when it is implemented, the Map will be adjusted accordingly."

Regarding Recreational Lands, Ms. Sahlstrom displayed a Map indicating the locations
within the City.
Ms. Sahlstrom displayed a Map entitled, "Table VI-6 Existing and Future Park Acreage
Needs, 2000-2030".
Discussion.
Mr. Brian Fields, P.E., City Engineer, Public Works Department spoke briefly to the
Board Members on Lake Jesup.
Comments on a future hotel and convention center in the area was discussed.
Mr. Randy Stevenson, Director, Community Development Department spoke of the Jetta
Point Park project.
