highly by the Winter Springs Building officials and by RW Contractors regarding the
City of Daytona Beach Splash Playground.

will be expired and no extensions given.
IMPLEMENTATION SCHEDULE:
• The implementation schedule is as follows:
^ Notification of award September 10, 2008
^ Pre Construction meeting September 25, 2008
^ Notice to Proceed September 25, 2008
^ Project start date October 1, 2008
^ Project duration 182 Calendar Dates
^ Project completion March 31, 2009
^ FRDAP funding received ($200,000) April, 2009
^ Grand Opening April, 2009
FUNDING:
The funding for this project is provided under the Trotwood Park Improvement Fund, 315-
65000-70109.

Impact Fees for 07/08 and 08/09.
The BDG Construction Services, LLC contract plus contingency and CPH contract are fully
funded with the revision of the budget. Should the Parks Impact Fee revenue not materialize as
conservatively budgeted, the general fund would make a short term loan to the Trotwood
Improvement Capital Project Fund to be paid back when revenue is realised.

Re: City of Winter Springs Trotwood Park Expansion -Phase 1
Engineer's Bid Review
CPH Project No. W04132
Dear Mr. Pula:
At your request, we reviewed the references for the second lowest bidder for the above listed
project, BDG Construction Services, Inc. (BDG). It is our understanding the apparent low bidder has
asked to be removed from consideration, which was accepted by the City. As part of our review, we
examined the bid tabulation provided by your office. Upon our review, we found no mathematical
errors in the bid tabulation. There are no M/WBE requirements for this project.
CPH Engineers contacted the four references provided by BDG. A telephone review/check of their
listed references indicates that the references were for two main employees of the company and not
current or past work performed by BDG. The references we spoke with stated they had no
objections to either Kevin Guffee or Jay Brown and gave them both above average
recommendations. One reference stated they would hire the company based an past experience
with the employee. The references also mentioned both Mr. Guffee and Mr. Brown worked for other
companies on the projects listed and not for BDG.
According to the project specifications, section 00200, 1.16 and 1.17, the Contractor was to have
performed projects similar in work and size as the proposed work and provide references for this
work. There was no indication that the references provided by BDG was far similarwork as required
in specifications. This project requires installation of a splash pad including plumbing, piping, and
electrical work, which was not evident in the references submitted. We are attaching for the City's
use, a copy of the references and reference checklist.
Based on our review of the available data (bid tabulation and contractor supplied references), it is
our opinion that there was insufficient information submitted to evaluate the Contractor's ability to
perform the specialized construction activities for this project. tf this is also a concern of the City of
Winter Springs, we recommend that the City request that the bidder submit additional
documentation and references addressing the specialized construction of the splash pad, pump
equipment room and other structures.
Engineers • Surneyors • Architects (AA26000926) • Planners • Lundscrrpe Architects < Environmental Scientisfs • Constnrctinn Manngemerrt * Design/Build
Should the City decide to accept the bidder, we recommend that the City proceed with caution and
verify the performance bond is in place prior to the Contractor beginning work on the project, As
noted above, the references we received were for individual pertormances and not the performance
of the Company. Please note that we have not reviewed any financial data as we are not
accounting professionals. If such a review is required, we recommend either a review by your
Finance Department or your financial adviserlaccountant.
Please contact us if additional information is needed concerning the above
Sincerely,

PRINCIPALS
Jay Brown's extensive construction experience began in 1994 designing new plant facilities for
Bellsouth in Memphis, Tennessee. From 1997 to 1999, Jay served as a project engineer for the
Arbor Place Mall in suburban Atlanta and Bonita Lakes Mall in Meridian, Mississippi. In the
years following he developed an impressive portfolio of projects ranging from $1 M to $20M
including schools, enclosed shopping malls, retail out-parcels, stand-alone department stores,
and multi-use town centers throughout Georgia, Tennessee, and Florida with EMJ Corporation.
Jay's depth of expertise includes estimating, design plan review, permitting, project
management, budget preparation, site supervision and employee training. His relentless energy
and unwavering commitment to excellence has eamed Mr. Brown a reputation for delivering
projects not only on time but within budget without sacrificing quality. Recently, he managed
construction of the Winter Springs Town Center as well as The L.A. Fitness club in Florida. Jay
is a licensed Professional Engineer and earned a B.S. in Civil Engineering from Tennessee
Technological University, where he held leadership roles in the Sigma Chi Fraternity and
Student Government.
Kevin Gaffes began his professional career in 1998 with Exxon Mobil in Houston, Texas
developing oil and gas fields in South America and the Guff of Mexico. Over the next. five years
Kevin directed small teams of engineers and geologists exploring the economic and technical
feasibility of large oil and gas projects from the Middle East to Russia. In 2004, Kevin deepened
his understanding in business administration by earning an MBA from the University of
Tennessee with a concentration in marketing. His participation in Habitat for Humanity piqued
an interest in construction which led to a position as acquisition manager with a Tennessee
based firm. In 2006 Mr. Guffee managed the complete renovation of Cabana Key
condominiums in Casselberry, Florida and Avistele at Deerwood (apartment homes) in
Jacksonville. Kevin graduated with honors from the University of Tennessee with a B.S.

Re: Trotwood Park
Dear Mr. Pula,
After careful consideration we have decided not to accept the contract for the project of Trotwood Park.
Due to ever escalating costs for materials and labor, many of our Vendors have had to significantly
increase their prices. We have determined that the costs for completing this project have increased in
excess of $40,000. While we would be delighted to be able to construct this facility for the City of Winter
Springs, we are unable to do so without having the amount of our current contract increased. Proceeding
at the current dollar value without an escalation for current market increases would affect performance on
our part. We want to give the very best job possible.
Thank you for your consideration. We are hopeful that we will be able to work for you in the future.
Sincerely,
