The City Charter provides that the City has all
powers possible for a city to have under state law.

The Florida Constitution provides that "[m]unicipalities shall have
governmental, corporate and proprietary powers to enable them to
conduct municipal government, perform municipal functions and
render municipal services, and may exercise any power for municipal
purposes except as otherwise provided by law." Art. VIII, §2(b),
Fla. Const.

Powers of the City
Florida Statutes provide, in accordance with s. 2(b), Art. VIII of the
State Constitution, that "municipalities shall have the governmental,
corporate, and proprietary powers to enable them to conduct municipal
government, perform municipal functions, and render municipal

services, and may exercise any power for municipal purposes, except
when expressly prohibited bylaw." §166.021(1), Fla. Stat.
Powers of the City
The State Legislature secured for municipalities the broad exercise of home rule
powers imposed by the constitution and removed any judicially or otherwise
imposed restrictions on limitations placed on the exercise of home rule powers.

Municipalities may not enact legislation in the following areas:
(a) The subjects of annexation, merger, and exercise of
extraterritorial power, which require general or special law
pursuant to the constitution;
(b) Any subject expressly prohibited by the constitution;
(c) Any subject expressly preempted to state or county government
by the constitution or by general law; and
(d) Any subject preempted to a county pursuant to a county charter.

Annexation
Florida Statutes set forth uniform procedures for municipal
annexations. A municipality may not adopt annexation procedures
that are inconsistent with the procedures set forth in Chapter 171,
Florida Statutes. See North Ridge General Hospital, Inc. v. City of
Oakland Park 374 So.2d 464 464 (Fla. 1979); Op. Att'y Gen. Fla. 04 -24
(2004).

Annexation
The purpose of the annexation statutes is to set forth
procedures for adjusting municipal boundaries and
criteria for determining when annexations may take place
to:
(1) Ensure sound urban development and
accommodation to growth.
(2) Establish uniform legislative standards throughout
the state for the adjustment of municipal
boundaries.
(3) Ensure the efficient provision of urban services to
areas that become urban in character.
(4) Ensure that areas are not annexed unless
municipal services can be provided to those areas.

Annexation
Florida Statutes provide three methods for
municipal annexation:
Voluntary Annexation
Annexation by referendum
( "Involuntary Annexation ")
Annexation by Interlocal Service
Boundary Agreement

VOLUNTARY ANNEXATION: The owner(s) of real
property may petition the governing body of the
municipality for annexation pursuant to §171.044,
Fla. Stat.

ANNEXATION BY
REFERENDUM:
A municipality may annex by initiating
the referendum process pursuant to
§ Fla. Stat. An ordinance
adopted by a municipality annexing real
property is not effective until after it has
been approved by a majority of the
registered electors in the area proposed to
be annexed. However, if the area proposed to
be annexed does not have any registered
electors on the date the municipality finally
adopts the ordinance, such a vote is not
required.

Annexation
The City Charter provides that the City Commission may
annex contiguous, compact land as set forth in Chapter 171,

Annexation
"Contiguous" means that a substantial part of a
boundary of the territory sought to be annexed by
a municipality is coterminous with a part of the
boundary of the municipality.

"Compactness" means concentration of a piece of
property in a single area and precludes any action
which would create enclaves, pockets, or finger
areas in serpentine patterns.
