SUBJ: Bart Phillips
Please find attached two items relative to Agenda Item 500.
1. Changes recommended by Commissioner Gilmore resulting from a meeting with Mr. Phillips
this past Friday. It is my understanding that both parties are in agreement to these changes.
2. Changes provided to you in an August 7, 2008 memorandum from the City Attorney. It is my
understanding that all parties are in agreement with these changes.

ATTACHMENT "1"
Amend 20.252(34) Outdoor storage facility specifically designated for parking and storage
of vehicles, equipment, goods, and materials, provided said storage
occurs on real property located adjacent to a state collector road, and
within and adjacent to an electric transmission line right-of-
way/easement, and railroad track right-of-waXeasement.
Amend 20.256.1b Over the Road Semi Tractor/Trailer Units
No more than twelve (12) spaces shall be allowed for over the road
type semi tractors and or tractor trailers designed with fifth wheel
attachment components, loaded or un-loaded, attached together or
unattached, in any of the twelve (12) spaces. No more than one (1)
attached or unattached over the road semi tractor/trailer unit shall be
allowed in any one (1) space.
ADD 20.256.1e Dump Truck/Trailer Units
No more than six (6) spaces shall be allowed for dump trucks and dump
truck trailer units designed with spindle hitch type attachment
components loaded or unloaded, attached together or unattached, in anv
of the six (6) spaces. No more than one (1) attached or unattached unit
shall be allowed in any one (1) space.
ADD 20.256.1d Unlimited Dual Wheel Single Axle Truck/Trailer Units not exceeding
26,000 gross vehicle weight (G.V.W.)
Amend 20.256.3a More than twelve (12) over the road semi tractor/trailer units as
described herein.
ADD 20.256.3b More than six (6) dump truck/trailer units as described herein.
Amend 20.256.3f Except as otherwise provided herein, heavy construction vehicles and
equipment including, but not limited to, dump trucks, motor graders,
bulldozers, front end loaders, cranes, derricks, and other earth and
material excavating, hauling, grading and lifting equipment over 26,000
pounds of gross weight.

On August 6, 2008, the City Manager and I met again with Bart Phillips and his consultants to
discuss the proposed revisions to Ordinance 2008-10. In general, Mr. Phillips and his consultants found the
revised ordinance to be acceptable for their proposed business needs. However, they recommended two
additional changes:
1. Because of two public streets which are internal to their property (Old Sanford Road /Wade
Street, amend Section 20-256(1) to prohibit visibility from any "public collector road," rather than "any
public street."
2. Amend 20-256(2) to allow the storage of "(g) construction vehicles and equipment stored
on a trailer, provided the construction vehicles and equipment do not violate the express prohibitions in
subsection (3)."
If the change in paragraph 2. above is acceptable to the City Commission, a conforming amendment
to subsection (3)(f) will be required to add the language "unless stored on a trailer pursuant to subsection
2(g).,,
Mr. Phillips would like the City Commission to consider these changes.
