REQUEST: Utility Department Requesting Approval of a Quit Claim Deed conveying the Lift
Station Tract in Barrington Estates to the City
PURPOSE: The purpose of this Board item is to request approval of a quit claim deed conveying
Tract K of Barrington Estates that is used as a lift station to the City from TOUSA
Homes.
CONSIDERATIONS:
This agenda item is needed for the City to acquire the lift station parcel in Barrington
Estates. Lift Stations tracts are typically conveyed in the plat but the City Attorney has
indicated a deed is a more appropriate mechanism to convey real estate. TOUSA Homes has
provided the attached quit claim. They are ready to execute the quit claim upon approval from
the Commission and City Attorney concurrence.

FUNDING:
No expenses are anticipated at this time other than legal review.
RECOMMENDATION:
It is recommended that City Commission accept the quit claim deed for Parcel
04-21-31-506-OK00-0000, the Tract K lift station parcel in Barrington Estates, from
TOUSA Homes subject to City Attorney review and alteration as needed.
IMPLEMENTATION SCHEDULE:
The quit claim deed will be executed and recorded after approval.

OUIT CLAIM DEED
THIS QUIT CLAIM DEED executed the day of , 2008, by
TOUSA HOMES, INC., a Florida corporation, whose post office address is 11315 Corporate Blvd.,
Suite 250, Orlando, Florida 32817 (hereinafter referred to as "Grantor"), to CITY OF WINTER
SPRINGS, a Florida municipal corporation, whose address is
(hereinafter referred to as "Grantee").
WITNESSETH:
That the Grantor, for and in consideration of the sum of Ten and No/100 Dollars ($10.00),
in hand paid by the said Grantee, the receipt whereof is hereby acknowledged, does hereby remise,
release, and quit-claim unto the Grantee forever, all the right, title and interest, claim and demand
which the said Grantor has in and to that certain land situate in Seminole County, Florida, more
particularly described as follows:
Tract K BARRINGTON ESTATES, according to the Plat thereof
as recorded in Plat Book 62, Pages 77 through 80, Public Records
of Seminole County, Florida.
TO HAVE AND TO HOLD, the same together with all and singular the appurtenances
thereunto belonging or in anywise appertaining, and all the estate, right, title, interest, lien, equity
and claim whatsoever of the said Grantor, either in law or equity, to the only proper use, benefit and
behoof of the said Grantee forever.
