Bush at 6:00 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Mayor John F. Bush, present Deputy Mayor Donald A. Gilmore, present Commissioner Robert S. Miller, absent Commissioner Rick Brown, present Commissioner Sally McGinnis, present Commissioner Joanne M. Krebs, present City Manager Ronald W. McLemore, arrived at 6:01 p.m. City Attorney Anthony A. Garganese, arrived at 6:07 p.m. Mr. Randy Stevenson, ASLA, AICP, Director, Community Development Department briefly spoke regarding the Cell Towers and stated, "We will keep you all up to speed on that." City Manager Ronald W. McLemore arrived at 6: Ol p. m. Regarding a letter received from Seminole County Chairman Brenda Carey on Enclaves, Manager McLemore noted we had an Interlocal Agreement with Seminole County. Mayor Bush then asked Manager McLemore, "Would you get that Interlocal Agreement out and have Andrea [Lorenzo-Luaces, City Clerk] get it out so I can write her back and say we already have an Interlocal Agreement on this and we would like for you to pay attention to it?" Manager McLemore said, "We would be happy to get it out and try it again." Mayor Bush added, "Give it to me and we will send it to them; and maybe I will just go to their Commission meeting and ask them about it." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP -MARCH 3, 2008 PAGE 2 OF 7 Next, Manager McLemore suggested, "I think it is going to take some kind of phone calls to their Commission from the Commission to move this along." Brief discussion followed on the Joint Planning Agreement. • • AGENDA NOTE: THE FOLLOWING INFORMATIONAL AGENDA ITEM WAS DISCUSSED FIRST, FOLLOWED BY THE REST OF THE AGENDA, AS DOCUMENTED. • • INFORMATIONAL AGENDA INFORMATIONAL 101. Office Of The City Manager Discussion On S.E.E.D. (Seminole Economic Enhancement District) Program In Winter Springs. Mr. John Metsopoulos, US 17-92 CRA Program Manager, Seminole County, 1055 AAA Drive, Suite 145, Heathrow, Florida: introduced this subject for discussion. Mr. George Houston Ii, P.G., Brownfields Coordinator -Waste Cleanup, Department of Environmental Protection, 3319 Maguire Boulevard, Suite 232, Orlando, Florida; addressed the City Commission. City Attorney Anthony A. Garganese arrived at 6: 07 p. m. Discussion. Regarding Job Bonus Refunds, Mayor Bush spoke of a property and some contaminated land; to which Mr. Houston stated, "Does the State know? Does DEP (Department of Environmental Protection) know? Because we will actually make DOT (Department of Transportation) clean up their mess." With further discussion, Mr. Houston said, "We might know in our Solid Waste Division if we know where some of the closed dumps are. If we don't, somehow we get the data, well then, we will work on it." Discussion. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP -MARCH 3, 2008 PAGE 3 OF 7 Mr. Houston said, "Let me explain what `Perceived' means in the environmental field. When you are looking to redevelop a site, it is now called `All Appropriate Inquiry' -one of the first things you do is a Phase I Audit on your Property." Continuing, Mr. Houston said, "When you see a Phase I, sometimes a Phase I will say, `These are the potential environmental impacts'. That's the hook for `Perceived'. If you did a Phase I and it showed -that there was no environmental impact, then you're not even going to come into the program to sign a Brownfield Site Rehabilitation Agreement." Furthcr discussion. Mayor Bush asked Manager McLemore, "Would the property on south west corner of Hayes [Road] and [State Road] 434 be a potential..." Manager McLemore said, "...I would think so." Mayor Bush added, "We ought to let that -guy that owns that property know about this." With discussion, Manager McLemore asked, "Assume there is a real Developer there who wants to develop that project and it has a low rating, can it then be bumped up to a higher rating? Mr. Houston said, "No. Not by the Petroleum Program. The way you get around it is using my Program." Manager McLemore said, "Yes. I am asking through your Program. You could bump it up because you have a real Developer ready to write some checks." Continuing, Mr. Houston stated, "Well actually he is going to move out of Petroleum. He's going to come to me. He's going to start paying all that money and start going. And so we -start getting the clean up. So, the answer is `Yes'." Manager McLemore said, "Okay." Mayor Bush said, "We ought to let that Property Owner know about that." Commissioner Joanne M. Krebs stated, "Right." Further discussion. Mr. Houston added, "Anything I can do to help out, let me know." Continuing, Manager McLemore noted, "With the S.E.E.D. (Seminole Economic Enhancement District) program, there's two (2) different things going on. One are those non-environmental clean-up projects and from this sheet it tries to tell you what you can do with anon-environmental clean-up; and then those things you do with a potential Brownfield and sometimes they cross, and sometimes they don't, depending on the nature of the project." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP -MARCH 3, 2008 PAGE 4 OF 7 Mr. Metsopoulos explained, "It is two (2) separate programs. You do an area which the S.E.E.D. (Seminole Economic Enhancement District) area is and right away because it's a S.E.E.D. (Seminole Economic Enhancement District) area you get the two thousand dollars ($2,000.00); you get -twenty percent (20%) is for Affordable Housing; you get all the sales tax back on construction. That's for an area. Now, within my S.E.E.D. (Seminole Economic Enhancement District) area [US Highway] 17-92 - I' 11 give you an example. Lowe's bought or redeveloped the K-Mart site. Within the S.E.E.D. (Seminole Economic Enhancement District) area they discovered contamination. So, now they're getting all the benefits because they're in a S.E.E.D. (Seminole Economic Enhancement District) area, but now because they are building and they discovered contamination, now it becomes a Brownfield Site within the S.E.E.D. (Seminole Economic Enhancement District) area and then it trips open all of these other benefits. So, you can have two (2) going on at once..." Manager McLemore stated, "...Two (2) benefits..." Mr. Metsopoulos said, "...Correct. You can have both going on at the same time, but the Brownfield area benefits are not contingent upon it becoming a Brownfield Site." Manager McLemore said, "So, based upon this information, what we try to do is develop a map to bring to you tonight for discussion and see basically what your reaction to that is and you are certainly welcome to stay and comment." Next, Mr. Stevenson addressed with the City Commission areas of the map that Staff put together. Tape 1/Side B Manager McLemore asked Mr. Stevenson, "Why wouldn't we use or designate the north side of [State Road] 419 where we have the Industrial Park which over the years will probably be doing a lot of redevelopment? This area that is currently vacant in through here and why did we not include this?" Mr. Stevenson said, "Again, the reason we didn't include this initially is because we were trying to stick with the exception of this triangle piece which is a larger piece with the current boundary of the [State Road] 434 Overlay Area, there is no reason we couldn't include this area in here, where the church is and those commercial properties are, as well as going up into here." Manager McLemore stated, "I think that makes sense over there." Commissioner Sally McGinnis said, "I do too." Manager McLemore said, "Okay." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP -MARCH 3, 2008 PAGE 5 OF 7 Manager McLemore said, "What we need to do is, we need to go through the advertising Resolutions and then bring the map back to you for Final Approval - if you generally agree with these areas." Commissioner McGinnis stated, "I do." Commissioner Krebs asked, "Is there anything that will prevent us from adding to any of these in the future?" Mr. Metsopoulos said, "Let's say you do all of this and all of a sudden a year later somebody comes and says -you can declare that right then and there. So, nothing is set in stone. But, it's a good idea for your big areas like you are doing, to do it in one fell swop because then you got the program in place, people know it exists." With further discussion, Manager McLemore asked, "We don't need a separate Resolution for each of these separate areas?" Mr. Metsopoulos said, "No." Manager McLemore said, "We can all do it in one (1) Resolution and define it all by..." Mr. Houston said, "...Actually, you might. If they are not connected, then you're going to need to do one (1) for each area and I really recommend that because -you could call them something else." Manager McLemore added, "That property has to be described by map reference and by an actual survey?" Mr. Houston said, "It is the same Resolution -that part I am not positive about - I think it has to be described accurately. It can be surveyed or it can be a legal description - is adequate." Lastly, Mr. Metsopoulos noted, "If you attach the map and called it an area, that would then suffice for the description." Furthermore, Mr. Metsopoulos remarked, "I am here to help you with them if there are nuances as we move forward that need clarification, I am here as a resource to help you clear up those nuances." INFORMATIONAL 100. Office Of The City Manager Discussion On Impacts Of Constitutional Amendment 1. Mr. Kevin Smith, Director, General Services Department was introduced by Mayor Bush for the Record. Mr. Smith then presented this Agenda Item for discussion and displayed a PowerPoint presentation. Discussion. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP -MARCH 3, 2008 PAGE 6 OF 7 Mayor Bush said to Mr. Smith, "Going back to your on your very first on 2008, `City Strategy C' - `Failure to adopt a [Fire] Fee would cause a $1.98M Shortfall' in this year's Budget. And then for [20]'09, you don't have the $1.98M Shortfall." Mr. Smith stated, "We still have got to make that up." Mayor Bush added, "But you don't say it anywhere." Further discussion. Commissioner Krebs said, "In your original slides, you were talking about a Fire Fee, but aren't we looking at something new so do we really know what that is going to be? Aren't you just talking about getting the money that was there whether it comes through a Fee in a format of whatever amount it is? In other words, Ron (McLemore), don't we have our Consultants bringing back information to us? Aren't you working on that..." Manager McLemore stated, "...Absolutely." Continuing, Commissioner Krebs said, "So, we don't know if it's one hundred and ninety-three dollars ($ 193.00)?" Manager McLemore responded, "No, we don't." Further discussion. Tape 2/Side A Manager McLemore noted, "We sent up a recommendation today under the Mayor's signature which we will get a copy of and what we asked was that they allow this Referendum to be voted on separately in each County and each City." Discussion continued. In other City business, Manager McLemore asked the City Commission about meeting with their Labor Attorney on a Collective Bargaining issue. Discussion ensued on possible dates. Commissioner Krebs suggested March "17`", [2008]." Commissioner McGinnis added, `Works for me." Mayor Bush asked, "What time?" With comments Mayor Bush recommended, "Four o'clock on the 17t" [March 2008]?" No objections were noted. Regarding an alternative choice, Tuesday, March 11 `", 2008 was suggested. Commissioner Krebs stated, "I can do it, that is fine with me." Deputy Mayor Donald A. Gilmore noted, "Okay." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP -MARCH 3, 2008 PAGE 7 OF 7 Mayor Bush then asked, "Do you -want to make that the number one (1) priority?" Mayor Bush then remarked, "So, we will go with the 11th [March 2008]" - is the number one date -four o'clock." Manager McLemore noted, "If neither one of these dates work, we will bring back some other dates to you - I should know tomorrow." Mayor Bush said, "Commissioners, on the 10th [March 2008], is anyone going to be absent from the Meeting?" Deputy Mayor Gilmore stated, "I have to leave here at 6:30 p.m. sharp." Mayor Bush asked, "Is anyone else going to be absent on the 10th [March]?" It was noted that Commissioner Robert S. Miller would be out of town on that date. Discussion.
