HomeMy WebLinkAbout2006 09 07 Public Hearings Agenda Item 200 BOARD OF ADJUSTMENT AGENDA ITEM 200 Consent Informational Public Hearing X Regular S~ptember 7. 2006 Meeting Mgr. / Dept Authorization REQUEST: The Community Development Department is removing from the Board of Adjustment consideration a request for a conditional use to allow a Seminole County park at Jetta Point, pursuant to sections 20-33 and 20-234 of the City Code of Ordinances, in order to provide an alternative methodology for receiving public input for designing, approving, and constructing a park. PURPOSE: The purpose of this agenda item is to remove from consideration, as a conditional use, a request by Seminole County to' construct a park at Jetta Point, an area located on the south side ofSR 434, just west ofthe Greeneway (SR 417) and adjacent to an existing Cross Seminole trailhead. The majority ofthe county site is located within the City of Winter Springs (some of the southern part is located within the City of Oviedo - not part ofthis conditional use). CONSIDERATIONS: The City and Seminole County have been discussing provision of a public park at the site for years. Upon review ofthe application, staff discovered that, although at least one halfofthe subject property is within the C-I zoning district, a portion of the subject property is included within the Tuscawilla Planned Unit Development (PUD). Some of the PUD property has a Commercial Future Land Use (FLU) designation and some has a Medium Density September 7, 2006 Public Hearing Item 200 Page 2 Residential FLU designation. The conditional use request only applies to the area located within the C-I zoning district, but does not apply to the pun portion ofthe site. The City Attorney was notified that a portion of the site is within the Tuscawilla pun and has identified an efficient alternative methodology to receive public input and provide an appropriate approval process in a timely manner. This item is being removed from conditional use consideration to allow for this alternative (a joint planning agreement). Since the item was noticed to the public, a public hearing is being held to announce the change. Additional information will be provided at the BOA meeting. RECOMMENDATION: The City Attorney and staffrecommend the proposed conditional use for a public park at Jetta Point be removed from consideration, to allow for an alternative methodology proposed by the City Attorney.
