SPECIAL MEETING
CITY COMMISSION
JUNE 29, 1998
The Special Meeting of June 29, 1998, was called to order by Deputy Mayor Cindy Gennell at
6:38 p.m. in the Commission Chambers.

II. EXECUTIVE SESSION: DISCUSSION WITH LEGAL COUNSEL TO DISCUSS
MATTERS RELATED TO THE LAWSUIT: PARTYKA VS. CITY OF WINTER
SPRINGS.
There was discussion regarding the status of this planned Executive Session. Attorney Robert
Guthrie said that he would recommend not having this session, as the Order that they were waiting
for had not yet come in.
There was discussion about different kinds of meetings, and discussion ensued regarding when they
could schedule another Executive Session. Attorney Guthrie recommended Monday, July 6, 1998,
(prior to the already scheduled Budget presentation) for another Executive Session.
Attorney Guthrie announced to those in attendance, that beginning at 6:30 p.m. on July 6, 1998,
there would be an Executive Session, followed by the Budget Presentation. He further announced
who would be in attendance, and other particulars related to this meeting. Deputy Mayor Gennell
mentioned that a new Agenda should be posted.
City Manager Ronald W. McLemore advised the Commission that Attorney Bruce Blackwell is
interested and available to speak to the Commission. With agreement of the Commission, it was
agreed that Mr. Blackwell would address the Commission on Wednesday, July 8, 1998 beginning
at 3:00 p.m.
Commissioner Michael S. Blake mentioned that the upcoming July Special Meetings would not have
public input, and Manager McLemore agreed.
Deputy Mayor Gennell told those in attendance that she had heard of some unhappy "smokers" at
the Senior Center. There was much discussion about this subject. Manager McLemore was very
concerned about any changes to the order. Commissioner David McLeod asked if a "NO
SMOKING" sign could be posted facing the park, and Commissioner Blake added that there really
are three separate operations at that location. Attorney Guthrie also said that he felt that the order
should not be modified, and perhaps a sign such as "NO SMOKING BEYOND THIS POINT"
should be posted.

Commissioner McLeod agreed with Manager McLemore. Commissioner Gennell stated that it was
the consensus of the Commission to not make any changes to this Emergency Order.
Commissioner McLeod asked what the Police Department had to go on, regarding this order? He
further asked if the Police Department "Had a clear-cut memorandum from Mr. Guthrie or
yourself'? There was further discussion regarding this matter. Commissioner McLeod then said
"I'm just going to leave it to you Ron, because I think you should take that up with Chief Kerr,
because I think it's important that they do know how to write it". Manager McLemore said that he
would speak with Chief Kerr tomorrow.
Commissioner McLeod asked if the "Trails" was considered a park? He further asked if there were
"NO SMOKING" signs posted? Manager McLemore felt that this probably had not been done, as
the "Trails" is County property; however, he said that he would check with the County tomorrow
about getting this done.
III. AT THE CONCLUSION OF THE EXECUTIVE SESSION, THE COMMISSION
MAY TAKE A PUBLIC VOTE ON EXECUTIVE SESSION ISSUES.
No action.
The Special Meeting was adjourned at 7:55 p.m.
