Will it be built along the whole corridor? 10.how wide will the median be? how do you calculate where you make your cuts for our future growth and development plans? 11.What are the contemplated speed Iimits?WiII it remain constant through the whole corridor? 12. Will the city of Winter Springs be afforded any input of our ideas regarding beautification and setbacks? Note: I AM SURE THAT THERE ARE MANY OTHER QUESTIONS THAT OUR CITY MANAGER. This resolution seeks authority for the City to cross its conservation easement to enable the District to construct a public road connection to Winter Springs Boulevard. CITY of WINTER 51-':\:"1\,),) CITY MANAGEK RESOLUTION 94- ~ A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE DOVERA COMMUNITY DEVELOPMENT DISTRICT, REQUESTING THE ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA, AUTHORIZING THE EXECUTION AND RECORDING OF A WRITTEN CONSENT TO THE USE BY THE DOVERA COMMUNITY DEVELOPMENT DISTRICT, ITS ASSIGNS AND SUCCESSORS, OF CERTAIN REAL PROPERTY OVER WIlICH THE CITY OF WINTER SPRINGS HOLDS A CONSERVATION EASEMENT, FOR CERTAIN PUBLIC PURPOSES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on April 7, 1993, the City of Winter springs, Florida, was granted a ten foot (10') wide conservation easement over certain real property, more particularly described in Exhibit "A,II attached hereto and incorporated herein by this reference; and . WHEREAS, on September 17, 1993, said ten foot ( 10 ') wide conservation easement was recorded in the Public Records of Seminole County, Florida, at Official Records Book 2648, Page 0039; and WHEREAS, the Dovera Community Development Dis~r~ct, its , successors and assigns (the "District"), is a local unit ~f special- purpose government, created pursuant to the provisions of Chapter 190, Florida statutes (1991), and by Ordinance 92-7, adopted by the Board of County commissioners of Seminole County, Florida; and WHEREAS, pursuant to Chapter 190, Florida Statutes, and the Interlocal Agreement between seminole County, Florida, and the- District, the District is authorized to construct infrastructure improvements, including, but not limited to, roads, roadway and other . drainage collection and water management systems, bridges, water --supply and distribution, structural improvements, parks and .. . . . . ; , ,. HOLDS A TEN-FOOT WIDE CONSERVATION EASEMENT For and in consideration of One Dollar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of Winter Springs, Florida, a Florida municipal corporation (the "City"), hereby consents to the use, and , waives its rights to restrict the use, of those portions of that certain real property described in Exhibit "A," attached hereto and incorporated herein by reference, which portions are described in Exhibit "B," attached hereto and incorporated herein by this reference, by the Dovera Community Development District, its successors and assigns (the "District"), for the public purposes of constructing infrastructure improvements, including roadways, utilities, drainage and other appurtenant uses thereto, and dedication of such public infrastructure improvements, if deemed appropriate by the District, to other governmental agencies, and use of such public infrastructure improvements by the general public. Such rights granted to the District under this, Written Consent by the City shall be deemed to run with the land and perpetually and irrevocably inure to the benefit of the District's assigns and successors in interest and/or title. . . . . . To the extent that the District hereafter obtains a fee interest in the real property described in Exhibit "B" as a successor in interest to the Grantor, the District shall be deemed released from the Conservation Easement, to the extent of the activities 'consented to herein, pursuant to Section 704.06, Florida , Statutes.
