Kram~~~t6 . . . . l, ~ WINTER SPRINGS IDGH SCHOOL An Interlocal Agreement between the City of Winter Springs and the School Board of Seminole County This INTERLOCAL AGREEMENT (the "Agreement") is made and entered into by the CITY OF WINTER SPRINGS, a body corporate existing under the laws of the State of Florida (the "City") and the SCHOOL BOARD OF SEMINOLE COUNTY, FLORIDA, a body corporate existing under the laws of the State of Florida (the "School Board"). WHEREAS, the parties to this Agreement have determined to collectively utilize their individual powers in the public interest to promote the expeditious development of Winter Springs High School and to provide for the mutual use of recreational and educational facilities; and WHEREAS, Section 235.193(9), Florida Statutes, provides authority for a local governing body and district school Board to establish an alternative process for reviewing a proposed educational facility and site plan, and off-site impacts; and WHEREAS, Section 235.02, Florida Statutes, permits and authorizes the use of school buildings and school grounds as community centers; and WHEREAS, the City and the School Board serve the same public constituency; THEREFORE, in consideration of the premises and for good and valuable consideration, receipt of which is hereby acknowledged by both parties~ the parties hereby agree, stipulate, and covenant as follows: 1. This Agreement is entered into pursuant to the provisions of the Florida Interlocal Cooperation Act contained in Section 163.01, Florida Statutes. 2. In order to coordinate the planning of Winter Springs High School and comply with Section 235.193, Florida Statutes, the School Board will submit the following information on the property under review: a. legal description b. topograhical survey c.environmental survey and location of existing natural features including trees d. identification of existing soil types and conditions e. surrounding land use and zoning f. proposed site plan g. existing and proposed utilities h. proposed on-site and off-site improvements i. stormwater management plan, with drainage calculations j. identification of any proposed variances to specified standards of the Land Development Code, with explanations for request k. additional information that the City requests in order to identify and evaluate the site plan and its adequacy as it relates to environmental concerns, health, safety, and welfare, off site impact, and effects on adjacent property. The City staff will review the submitted documents, advise the School Board of deficiencies, and make recommendations to address the concerns. The revised submittal will then be scheduled for a public hearing before the City Commission at the earliest possible date. Following approval by the City Commission, school construction may proceed with normal utility and site development inspections. 3. Because the primary access to Winter Springs High School will be a Seminole County (the "County") facility,. the City will accept the County transportation concurrency evaluation and determination unless there is an overriding public safety concern. .... . 4. The School Board shall utilize the existing City ROW for Second Street as part of its entrance road, provided that the road will be open for public ingress and egress. The School Board shall have full maintenance responsibility for the facility and there will be no requirement for the drive to provide sidewalks or meet other public road construction standards unless mutually agreed to by both the City and the School Board. Portions of the ROW that are not used for the drive shall be vacated according to normal City and Statute provisions. . . . I, 5. The School Board and the City shall work with each other to facilitate FOOT's realignment and widening of SR 434 between SR419 and Tuskawilla Road. 6. The City and the Board will make available for the use of one another's functions their respective properties or parts of such properties which may include structures and land area, upon the City requesting in writing to the Principal of Winter Springs High School (the "School"), and the Principal in writing to the Recreation Director of the City, the scheduled times for the desired use of the particular property or facility. In the scheduling of events, City activities and authorized programs shall have first priority use of City recreational facilities, and the School events and programs shall have second. Following City review and approval oflocation and design, the Board shall develop and maintain a grass field (approximately 360' x 150') on the Central Winds Park site for band, football, and soccer practice . This site shall be available for School use weekdays from noon to 6:00 P.M. All other times the City may utilize the fields and schedule events and programs as it chooses. 8. Prior to mutual use of either City or Board facilities, the City and the Board shall agree to specified procedures for adequate supervision, manner of use and clean-up, repair of damages to facilities, indemnification, and charges. 9. This Agreement shall commence upon adoption by the City and the Board, whichever occurs last and shall continue for one year. The initial term shall be automatically renewed for additional one year terms commencing February 1 of each year and terminating January 31 of the succeeding year unless one party delivers a written notice of termination to the other party prior to January 1 of the year of termination. 10. Both parties to this Agreement agree not to discriminate against any person on the basis of race, religion, national origin, age, sex, disability or marital status in the use of facilities pursuant to this Agreement. Agreement shall be deemed to be a waiver of any other condition or subsequent breach, whether of like or different nature. , '\. 12. Each of the parties hereto hereby agree that they will execute and deliver such further instruments and do such further acts and things as may be necessary or desirable to cany out the purpose of this Agreement. .. .... ~.. r . . . . I, 13. Each provision of this Agreement is intended to be severable. If any term or provision hereof is illegal or invalid for any reason whatsoever, such legality or invalidity shall not affect the remainder of this Agreement. 14. This Agreement and the rights of the parties shall be governed by and construed or enforced in accordance with the laws of the State of Florida.
