This has come about because of the Tuscawilla Settlement Agreement.
The entire Agreement is vested by the Vested Rights Special Use
Permit 93-03. The properties covered by the Agreement and the
Permit are now owned by a minimum of three (3) corporations.
This Amendment, if approved, will allow one owner to further vest
the rights to his property, thus insuring that if any other owner
covered by the Permit takes an action that would nullify the
Permit, his property would still retain all rights under the
Agreement.

AN ORD I NANCE AMEND I NG THE CITY OF WINTER SPR I NGS, FLOR I DA
ORD I NANCE NO. 534 REGARD I NG THE PROCEDURES FOR DETERM I NAT I ON
OF VESTED RIGHTS; ESTABLISHING A PROCEDURE FOR VESTED RIGHTS
DETERMINATIONS FOR INDIVIDUAL PARCEL OWNERS WITHIN A MASTER
PLANNED PROJECT; PROVIDING SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Chapter 163, Part I I, Florida Statutes,
entitled
the Local Government Comprehensive Planning and Land Development
Regulation Act, as amended (the "Act"), allJOwers and requires the
City Commissioners of the City of Winter Springs to plan for the
City's future development and growth, and to adopt and amend
comprehensive plans, or elements or portions thereof, to guide the
future growth and development of the City; and

WHEREAS, the City Commissioners conducted public hearings
relating to the adoption of the City of Winter Springs Comprehensive
Plan and adopted the same by City Ordinance 513 on April 27, 1992
(the "Plan Adoption Date"); and
WHEREAS, Section 163.3202(1), Florida Statutes, requires the
City to adopt or amend and enforce land development regulations that
are cons i stent wi th and ilT'P 1 ement its adopted Call>rehens i ve Plan; and
WHEREAS, Section 163.3194(1)(b), Florida Statutes, requires
that all land development regulations enacted or amended by the City
of Winter Springs shall be consistent with the adopted Comprehensive
Plan, and any land development regulations existing at the time of
adoption which are not consistent with the adopted Comprehensive
.
Plan, or element or port i on thereof, sha 11 be amended so as to be
consistent; and

WHEREAS, the Comprehensive Plan envisions that the City of
Winter Springs shall adopt an administrative process for detenmining
whether a person's right to develop is vested, and the City of Winter
Springs established that process by adopting Ordinance No. 534; and
WHEREAS, the City Commission of the City of Winter Springs
desires to make certain revisions to Ordinance No. 534.
NCW, THEREFORE, BE IT ORDAINED BY THE CITY cot-t1lSSION
OF THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I - Section I I(A) of Ordinance No. 534 is hereby amended to
add subsection (9) which shall read as follows:

9. Individual parcel owners within a larger project may rely on
and be governed by a Vested Rights Special Use Penmit covering
the overall project. Such an individual parcel owner may also
apply for a vested rights detenmination for his parcel only.
If an individual parcel owner receives an independent Vested
Rights Special Use Penmit for his parcel, such an individual
Vested Rights Special Use penmit shall establish and govern the
vested rights of that parcel, notwithstanding the prior or
later approval of a Vested Rights Special use Penmit for the
larger project of which the parcel is a part. A substantial
deviation detenmination under Sections IV(C) and (D) hereof for
a parcel governed by such an individual Vested Rights Special
Use Penmit shall be based on the proposed changes to the
individual parcel. A substantial deviation detenmination for a
vested project encompassing more than one development parcel
shall be evaluated based on the proposed changes to the parcels
governed by the project's Vested Rights Special Use Penmit,
exclusive of any development within parcels governed by an
individual Vested Rights Special use Penmit.
SECTION I I - SEVERABILITY
If any section, phrase, sentence or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not effect

the validity of the remaining portions thereof.

SECTION III - EFFECTIVE DATE
This Ordinance shall take effect upon its adoption by the
City Commission.

Recordation of Plat and Covenants
The developer of Georgetowne Unit III wishes to record the plat and
the covenants before completion of the proj ect. The items
remaining to be completed are the perimeter wall and the sidewalk
along Northern Way. In this regards, the developer has deposited
with the City a Performance Cash Escrow in the amount of~91,3~.49
to guarantee that these two (2) items will be built. 19~3b'l.W
Approval of this request by the Commission does not constitute
acceptance of any portion of this project. This will come at a
later date, once the wall and sidewalk have been built, the City
Engineer approving the as-builts and a Maintenance Bond furnished
to the city.
The city Attorney has reviewed all documentation regarding this
project and found them to be satisfactory. Please see attached.

SUBJECT:
Wall and Sidewalk Construction Costs, Relating to
Proposed Performance Bond for Georgetowne III.
Doug Eshelman; of George Wimpey of Florida, Inc; submitted
the cost of construction of 1,630 feet of privacy wall
($77,221.49) and 2,160 feet of sidewalk ($14,148.00) for the
subject project on October 6, 1993. A review of these costs
found them to be accurate.
It is recommended that a 100 percent Performance Bond in the
amount of $91,369.49 be submitted to the City to cover the cost
of the wall and sidewalk.

Georgetowne Unit III
I have completed a review of all of the Georgetowne Unit
III documents produced.
All of Don's comments should be incorporated. I do
recommend we revise the provision on requiring City approval prior
to amendment to homeowner documents. I recommend we require
notice to the City prior to any amendments becoming effective, and
that NO amendment shall violate any Federal, state, County or City
law, statute, ordinance, or code. In all other respects the
documents are approved subject to revisions to incorporate Don's
comments.
