ORDINANCE NO. 541 - A request of Country Club Village Homeowner's
Association to vacate that utility easementt less the southerly
fifteen (15) feet thereoft over the common area as depicted on the
map in the attached package. The utility companies have no objection
to this request. The Association wishes to construct a maintenance
building on this location.
ORDINANCE NO. 542 - A request of Mr. John Baldwin to vacate a
fourteen (14) foot utility easement as depicted on the map in the
attached package. The utility companies have no objection to this
request. A Rite Aid Drugstore is proposed for this site.

ORDINANCE NO. 543 - A request of Seminole County School Board to annex
that property behind City Hall which was purchased for a potential high
school site. This property is depicted on the map in the attached
package. The P&Z Board recommended favorable action on this request
at their meeting of January 20t 1993. The Board also agreed that this
could be presented to the Commission before they approve the minutes
of that meeting.
OAK FOREST SURVEY - A discussion of the survey that the Homeowners'
Association wishes to send to the residentst and the associated costs.
A sample survey with costs will be distributed later this wee.

I am requesting the vacating of the utility easement portion
of common ground area located behind Lots 1, 2, 3 and 4
Country Club Village, Unit one, as recorded in Plat Book 22,
Page 4, Seminole County, Florida.
However, we would like to replace it with a fifteen foot
utility easement parallel to the southerly line of the Common
Area.

All Utilities are willing to vacate this area and their re-
sponses are enclosed. Also enclosed are copies of the Plat
Map of the Common Area involved.

Attached is the proposed survey, map depicting areas to be maintained
and estimates of cost. Mr Haines will be present at the Commission

(east of Tuscawi11a Road) and the City Attorney should check it out
for legal content.

THE TUSCAWILLA PLANNED UNIT DEVELOPMENT TWO (2) SEPARATELY DESIGNATED
COMMUNITIES, THOSE BEING TUSCAWILLA AND OAK FOREST. A SURVEY LIKE THIS IS BEING
SENT TO ALL PROPERTY OWNERS WITHIN THE TUSCAWILLA PUD THAT RESIDE WITHIN THE CITY
LIMITS. THE FUNDS RAISED FROM EACH COMMUNITY SHALL BE SEGREGATED AND SHALL BE
SPENT FOR THE MAINTENANCE ONLY OF THOSE COMMON AREAS IN EACH COMMUNITY.
THE CITY OF WINTER SPRINGS IS SURVEYING THE RESIDENTS OF OAK FOREST TO DETERMINE
THE OAK FOREST PROPERTY OWNERS' PREFERENCE AT THIS TIME ON COLLECTING ASSESSMENT
FROM PROPERTY OWNERS IN OAK FOREST WITHIN WINTER SPRINGS FOR PURPOSES OF FUNDING
MAINTENANCE AND UPGRADES OF ENTRANCE WAY'S AND COMMON AREAS WITHIN OAK FOREST.
THE ANTICIPATED COST ON AN ANNUAL BASIS WILL BE $29,340 THIS COST WILL BE DIVIDED
EQUALLY AMONG ALL PROPERTY OWNERS IN OAK FOREST. THERE ARE CURRENTLY 815
PROPERTY OWNERS IN OAK FOREST THEREBY THE ANTICIPATED EXPENSE, DIVIDED ON A
MONTHLY BASIS ON YOUR WATER BILL IS ANTICIPATED TO BE $3.00 PER MONTH.
THE FUNDS WILL BE COLLECTED ADMINISTRATIVELY BY THE CITY OF WINTER SPRINGS WHICH
WILL THEN PLACE THEM IN A SEPARATE AND SPECIAL ACCOUNT. THE EXPENDITURE OF THESE
FUNDS WILL BE CONTROLLED BY THE CITY AND BOARD OR COMMITTEE COMPOSED OF FIVE (5)
MEMBERS, ONE WHICH SHALL BE A MEMBER OF THE STAFF OF THE CITY OF WINTER SPRINGS
AND THE REMAINING FOUR SHALL BE PROPERTY OWNERS FROM THE COMMUNITY OF OAK FOREST,
WHO SHALL RECOMMEND EXPENDITURES TO THE CITY. THESE DIRECTORS SHALL SERVE
'WITHOUT COMPENSATION AND SHALL PREPARE ON AN ANNUAL BASIS A PROPOSED BUDGET WHICH

1. The above matter is on the February 8, 1993 agenda for your
consideration. I had requested the developer provide me with
some documentation prior to February 1, 1993 for you to review,
however, as of this date I have not received a response.
2. I did however receive a copy of a letter dated January 28,
1993 from Mr. Theodore Bolin commenting on my letter of January
25, 1993. I received a copy of the letter from Mr. Kozlov who in
turn had obtained it from Commissioner Kaehler. I have since
received a memorandum from the Utility Director commenting on the
Bolin letter of January 28, 1993.

I met wi th the representatives of Chelsea Pare on November 6, 1992.
Their initial request was for me to inunediately draft a letter to
the Board of Adjustment requesting a varIance to the wet bottom
pond ordinance as the stormwater pond easement was on City
property. After determining the location of the existing easement,
I advised them that the area in question was part of the same
parcel that contained Sam Smith Park and any actions would have to
come through the Parks and Recreation Department and the City
Manager. No mention was made of an easement swap up to this time
and it is ludicrous to suggest that I have "no interest in"
property activity irrunediately adjacent to the wastewater faciHty.
Mr. Robinson and Mr. Herbert then revealed some drawings that had
three options for stormwater ponds. Mr. Bol in is correct In
stating that I indicated that the single pond design was the best.
It was by defaul t, as the other two were not acceptable In my
opInIon. Mr. Robinson then requested a letter favoring the single
pond design which at the time reminded me of some of the high
pressure sales tactics I have encountered elsewhere. After walking
the property in question, I understood why the letter was requested
at that time.
Mr. Rolin IS correct in stating that I indicated we had no plans
for expanSIon of the wastewater facility in that area. We do not
have plans for expansion in our five year projection. However,
after walking the areas around the our facility and discovering the
predominantly swampy area that will constrain any expansion plans,
which will inevitahly occur, I recognized that the area in question
would be a very logical direction of expanSIon. Any support I
\wuld gIve to attempts to relinquish use of this property would
hnve shown a lack of foresight on my part.

objections based on the information that I was not, aware of at our
initial meeting. This included the fact that the Sam Smith Park
parcel was conveyed to the City as part of the acqUIsItIon of
Seminole Utility and was technically an asset of the utility.

It should be noted that no information was provided to me prior to
our meeting and that they were unable to leave me any of the
drawings to which we had given a cursory review. We have also not
received any conceptual drawings for Phase III of Chelsea Parc to
verify that "less destruction to land and forest areas" would occur
as opposed to the addition of lots.

Mr. Bolin states that in late October or early November "Not one
Member had an objection to developing this Consolidated Retention
Pond from an Engineering or Technical feasibility standpoint." The
first time anything was submitted that I could review from a
technical or feasibility standpoint was November 10, 1992 which
contained 36 "X24" drawi ngs reduced to 8 1/2"Xll" sheets. It was my
understanding that we were reviewing a conceptual proposal as no
f'ngineering or technical data has been suhmi t.ted and would not be
submitted until such time as the Commission gave conceptual
approval.
While Mr. Bolin questions my word, I question the accuracy of the
generalized representations which were made to me. Specifically, I
was told that the existing easement and proposed easement were
similar when in fact the existing easement is a bog and the
proposed easement is usable property. Also, it was indicated to me
that the new easement would be slightly larger which is true if you
consider an almost quadruple exchange of easement rights a slight
1ncrease.
It is unfortunate that the Mr. Bolin has interpreted the
hospitality that I tried to convey in the spirit of cooperation
into "warm responses" for his proposal and "favorabl e support" . I
was merf'ly trying to give them guidance into the correct procedures
for submitting t.heir proposal for review. It is my understanding
that all Developers have the right to make proposals for staff
review and subsequent recommendations to the City Commission. Mr.
Bolin hCls misconstrued my cooperation with his initiative as being
unequi vocal support as he apparent ly also did with Mr. LeBlanc and
Mr. Kozlov in his initial proposal.

low and wet and contains an existing stormwater pond.

interest of the Water and Sewer Department.

A meeting to discuss the above referenced was held on January 20, 1993.
In attendance were the City Manager, Kern, Kozlov, LeBlanc, Lockcuff
and Taylor.
NOTE: This request has to do with Chelsea Pare, formerly Braewick.
A brief history: An off-site easement for stormwater management was
granted to the initial developer of Braewick by Winter Springs Development
Corporation in February 1987. This easement is on property acquired
in April 1990 through the purchase of Seminole Utility by the City.
Now, Quest Properties (the new developer/owner of the Braewick project)
is requesting that this easement be abandoned and given to the City in
return for another easement on City-owned property. This action is
estimated to benefit the owner by the addition of six (6) lots which is
not now in the plans.
The Utility Director stated that the property requested will probably be
needed for future expansion of existing facilities. A letter, with a
plat depicting what is presently on site, will be given to the City
Manager.
Also, a resident once requested that the City deed him property next to
his house. This was not, and is not, a buildable lot. The City Attorney
stated that this was not permissable. If ever the City wanted to dispose
of property it would have to be advertised for bids.
The consensus at this meeting was that this request not be granted.
The City Manager will send a letter to the developer stating this position.
If the developer is not in agreement, he is to notify the Manager and he
in turn will attempt to put it on the agenda for Commission action at
their meeting of February 8, 1993.

Dear Mr. Bolin:
Your letter of November 30, 1992 was reviewed briefly and it was noted
that there is a bogus statement you have made on page 2 of your letter
under the heading Rationale for Favorable Consideration and Approval of
the Proposal.
In your letter, you make the statement " ... These preliminary
proposals A, B 6( C were reviewed by Mr. Leonard Koslov, Mr. Don LeBlanc and
Mr. Kip Lockcuff. Of all the plans, they preferred Plan C, with the wet pond
retention area wholly on the Park Property". At no time did I make any
preference for any plan. Your statement is incorrect, untrue and bogus and
has no basis of fact.
I categorically reject any and all false statements you have made on
this issue.
It would be most proper for you to re-issue a letter expressing your
withdrawal of this statement from your letter of November 30, 1992.

Upon review of the three proposed plans for the "easement
consolidation", I see no benefit to the City or its' constituents
on any of the proposals. After originally meeting with the
Chelsea Parc representatives, I walked the area and discovered
that existing easement area contains standing water and IS
definitely a wetlands area.
The City property is high and dry and could be used for multiple
purposes relating to the utility, such as an effluent storage,
effluent pumpIng, or activities related to the wastewater
operation. With a multitude of wetlands surrounding the
wastewater plant, I would highly recommend that the City not
relinquish usable property for additional wetlands.
Also, we do not have a copy of the executed easement in our files
and I would suggest that this be provided to the City as part of
the Developer's submittal.

RE: REQUEST FOR CONSOLIDATION OF RETENTION PONDS TO
SERVE CHELSEA PARC at TUSCAWILLA, IN ACCORDANCE WITH
THE PROPOSAL SUBMfITED TO THE CITY MANAGER ON
NOVEMBER 30TH, 1992.
Summary of Events concerning the evaluation of water retention
areas to serve the projed.
.
1. Review of Original plans as Villages of Braewick at Tuscawilla
indicated that several different and noncontiguious areas were to be used
for multiple water retention ponds.
They could be built under existing codelordinances and rules of the
City and St. Jolms Water Mgt District.
Their construction CRITERIA appeared to be put them where you
can, not a thoughtful Put theDl where we PLAN.
Multiple sites(as many as 4 separate ponds) requiring flow patterns
and water routes to collect water or drain the areas to be built through
heavily forested areas, with little apparent thought for the environment,
and certainly not creating anything which could promote people use,
benefit enjoyment and beautification.
This plan was apparently favored by government agencies because
they had always been done like this.
2. Due to the Partner's acute sensitivity to leaving the world better than he
fOWld it,. Bob Robinson insisted that we develop a more meaningful and
environmentally sensitive plan. One that would not haphazardly scatter
these retention areas over the landscape.
Serious study of the matter was conducted and alternatives were
considered. It was determined by consultants and others with experience
in the field, that a single consolidated retention area could provide a better
solution than disrupting multiple pristine forest areas with clearing of
trees and digging ponds. The solution cried out to support the fact that

with ONB POND, a more functional single retention facility could be
created which would provide:
Less destruction to land and forest areas
An attYactive water feature could be constructed in the West
portion of Sam Smith Park
A hand cleated and constructe~ nature trail could further beautify
and embellish this beautiful park like area and open it up for
the enjoynlent of the families of Winter Springs
Certainly a more functional and aesthetically appealing single pond
.
Trying carelully to follow protocol and follow the correct procedure, this
concept program was discussed with members of the Winter Springs City
Staff. 1his Was done in late October 1992 and early November 1992. Not
one Memoo: had an objection to developing this Conso&lated Retention
Pond from an Engineering or Technical feasibility standpoint. On
November 6, 1992 Mr. Robinson and Mr. John Herbert, Engineer for
Chelsea Pare met with The City Engineer. At the beginning of the
meeting, the City Engineer was asked if there were any plans for the future
expansion of the sewer treatment facility surrounded by the Sam Smith
Park. He said an emphatic no, none in the works and not being
contemplated. He suggested We present this concept to Mr. Lockcuff,
which we did shortly afterwards. The City Engineer agreed that other
than his own personal objection from a POLICY standpoint, it could be
done fronl an engineering standpoint and did offer the city better unified
control of the outfall structure, and since the Chelsea Pare Homeowners
Association would maintain it I that would solve the maintenance aspect
of it.
A few days later, we met with Mr. I<ipton Lockcuff, he too indicated that
the City of Winter Springs had no expansion plans for the Sewer Treatment
Facility which would involve this piece of property. He in fact determined
that they had no interest in or responsibility for this property since this
Was Park Property. He even advised us to get in touch with the Park
Board and Mr. Rozansky, The City Manager as he would be the signatory
to an agreement to create any easement lor Chelsea Pare to use the area.

We further asked him which of the 3 alternative plans he favored, and he
willingly affirmed that the single water facility was the best of those under
consideration. He was asked if he would indicate his expression of
support for this single pond in writing, just in a simple statement such as a

. We solicit your understanding and examination of the proposal and are
confident it merits favorable action to enable this consolidation of retention
ponds.
Chelsea Pare is anxious to see this valuable asset be added to the Sam
Smith Park and is willing to contribute the construction of the complete
facility, as well as the hand cleared and constmcted Nature Trail through
this outstanding natural forest setting, all done to enhance the area and
provide an area for learning and enjoyment, while complimenting the park
facility without cost to the City of Winter Springs or the taxpayers.

hand written note. He did not initially deny this request, but after further
discussion about the review process to go before the City Engineer and the
City Manager, he said he would like not to put hJs support in writing, but
he would be in favor of the single pond plan. We accepted this decision
willingly, feeling that his word was sufficient.
We have patiently waited for more than 3 months since om initial
presentations were made, and 1 1/2 months since our final written
proposal was submitted to the Qty Manager on 30 November 1992 as
suggested by the City Engineer.
Due to the warm response of Mr. Lockcuff and his favorable support, and
knowing that the City Engineer had found no technical or engineering flaw
in the conceptual plan, we discontinued further consideration of other
plans for water retention facilities. We broke off discussions with the
Tuscawilla Country Dub owner Mr. Jim Mikes.

Now comes the surprise letter from Mr. Lockcuff, as provided by the City
Manager on 25 January 1993, which indicates a novel new use of the park
property. It is difficult for us to imagine that the potential use, now set out
by Mr. Lockcuff, could have come to the forefront so quickly. We don't
question anyone's right to change their mind, we just wonder why such a
long delay in responding to our urgent November request and this
response being totally inconsistent with previous statements of support.
TIlls request was made to enable us to move forward to appear before the
Board of Appeals for a variance. No timely response was made.
We are now confronted with the Wldesirable task of having to overcome
this Budden burst of written negative response to this well conceived and
mutually beneficial plan. One which will benefit the People of Winter
Springs and the municipality itself, while going a long way to preserving
rather pristine stands of forests and unspoiled vegetation and attendant
animals.

We respectfully submit that the proposal for a consolidated water
retention area is not only fully justified by the significant facts of the
matter, but should be required rather than 3 or 4 individual retention
ponds in the area.
