REGULAR MEETING
CITY COMMISSION
CITY OF WINTER SPRINGS
NOVEMBER 8, 1993
The Regular Meeting of the City Commission of the City of Winter Springs, Florida,
was called to order by Mayor Philip A. Kulbes at 7:30 p.m.
Roll Call:
Mayor Philip A. Kulbes, present
Deputy Mayor John V. Torcaso, present
City Manager John Govoruhk, present
City Attorney Frank Kruppenbacher, present
Commissioners:
Don Jonas, present
John Langellotti, present
Terri Donnelly, present
Cindy Kaehler, present
The Winter Springs Veterans of Foreign Wars Post 5405 presented new flags to the
City. This was their annual presentation of flags to the City.
The invocation was given by Commissioner Terri Donnelly.
Approval of minutes of Oct. 25, 1993: there were no additions or corrections; the
minutes stand approved as submitted.
Public Comment:
Richard Denny, Pebble Beach Circle West, thanked the City for the Appreciation Dinner
given for all the Boards. He spoke about the annual Holiday decorating contest to
be held by the BOWS Board.
Isabella Laub, Blue Spruce Court, was concerned when she heard the Winter Springs
Police are not allowed to put more than 50 miles a shift on their cruisers. She
said if she is wrong she would like to be corrected.
Ray Laub, Blue Spruce Court, refuted a statement made by a Commissioner in reference
to the common areas of Tuscawilla.
General Agenda:
Request of Sullivan Properties:
Attorney Mike Jones explained that Sullivan Properties would like to seek the
agricultural exemption on the property on SR 434 with the commercial classification
in the PUD. Since its inception the use has been agricultural until RTC took it
over a couple years ago and they did not apply for the agricultural exemption.
Attorney Kruppenbacher asked Attorney Jones that he is in no way interpreting that
if the Commission should say we do not interpret this to be a breach of the Agreement,
that you are in no way interpreting it as authorization to proceed with any form of
activity on the property. Attorney Jones answered none other than the planting of
the trees-agricultural uses.
The Commission deemed there was no action to be taken because they did not perceive
the notice that they were giving to be a breach of the agreement that had been
reached.

filing an agricultural exemption.

Approval of Firefighters Contract:
Attorney Kruppenbacher explained there are four items which differ in the contract
this year from last year. They are the shift swaps which would now permit employees
to swap shifts in conjunction with their vacation in lieu of vacation.
Art. 12 working in or out of a higher classification which provides that if an
employee is requested and directed to work in a higher classification for three
or more complete shifts then they would receive compensation of $10.00 per shift.
Art. 15 is vacation leave which requires that a full shift be taken off;
Art. 39 on wages would provide a 3% increase.
Attorney Kruppenbacher said the firefighters were professional and quite cooperative
in trying to do what was best and understanding the needs of the management of this
City.
Motion was made by Commissioner Torcaso to approve the Firefighters Contract.
Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner
Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; Commissioner
Kaehler, aye; Commissioner Torcaso, aye; motion carried.
Highland Lake Phase I-Approval to record Plat and Covenants:
Don LeBlanc, Land Development Coordinator, explained this is the first phase of the
subdivision that is being built at the end of MacGregor Road in the Highlands. At
this time Mr. DiMarco is working on getting a Letter of Credit from the bank, and it
is to be ready on Thursday. Mr. LeBlanc asked the Commission approve with the con-
tingency that it not be recorded until such time that we get the Letter of Credit,
or to disapprove the project whichever they desire.
Motion was made by Commissioner Kaehler for approval of the Plat and Covenants for
Highlands Lake with the understanding that there will be a Letter of Credit before
it is officially platted and approved. Seconded by Commissioner Langellotti.
Discussion. Vote on the motion: Commissioner Langellotti, aye; Commissioner Donnelly,
aye; Commissioner Kaehler, aye; Commissioner Torcaso, aye; Commissioner Jonas, aye;
motion carried.
Opening of Vistawilla Drive/Plat Recording and Bond Acceptance:
Attorney Kruppenbacher explained the developer tended the final calculations that
their consultant estimated regarding the credit for traffic impact fees for
Vistawilla Drive. Based upon the figures that were tended by their consultant
compared with the initial figures that the City had, there was a difference of some
$500,000. A meeting will be held to have this reconciled.
Paul Partyka, Oswego Court, spoke about the speed humps and the money that was given
by the developer to construct them. Commissioner Kaehler said as soon as they start
building and the certificates of occupancy are issued, the speed bumps need to be in.
The Land Development Coordinator explained the developer gave the City the money to
be used for whatever they wanted to use it for because at the time there were liability
suits going on because of the bumps.

Contract with Cody & Associates~Approval/Disapproval:
Attorney Kruppenbacher explained this is a request for the City Commission to
authorize the City Manager to expend up to $10,000 for the engagement of Cody &
Associates to do a comprehensive study of the employee benefits. Attorney
Kruppenbacher is to check to see if it is necessary to go out for bid, and this
will be brought back to the Commission.
Mayor Kulbes called a Workshop Meeting on the Comprehensive Plan Amendments for
November 15, 1993, at 7:00 p. m.
Commission Seat IV - Terri Donnelly:
No report.
Commission Seat V - Cindy Kaehler:
Commissioner Kaehler asked Attorney Kruppenbacher about the legal interpretation
for her question on Ord. No. 552 that she had on Oct. 25, 1993. Attorney
Kruppenbacher said the ordinance should be covered at the Nov. 15th Workshop and
Attorney Bricklemyer is to be prepared to discuss it.
Commission Seat I - John V. Torcaso:
Commissioner Torcaso reminded everyone to attend the Holiday Parade on November 21,
1993.

No report.
Commission Seat III - John Langellotti:
Commissioner Langellotti asked if the money that is being collected for the stormwater
system could be used for sweeping the streets. Manager Govoruhk will check into it.

Mayor Kulbes announced the Swearing In Ceremony will be held on Monday, December 6,
1993 at 1:30 p.m.
Mayor Kulbes spoke about getting the maps distributed. A recommendation was made
. that the maps be given to the Homeowners Associations so they can be distributed.

Mayor Ku1bes asked the City Manager to look into getting new microphones as people
have been complaining they can not hear the commissioners.
Mayor Ku1bes talked about a telephone call he received regarding the latest Winter
Springs Bu11etin.~
