RE: Public Hearing on Settlement Agreement
Here is some information on the public hearing we need to schedule for December
14th. regarding the Comprehensive Plan settlement agreement. This comes from
the revised Chapter 163.3184(16), F.S.
1) The public hearing must be advertised at least ten (10) days in advance.
2)
The ad must state the date, time, place of the meeting, the subject of the
meeting, and the place where the settlement agreement may be inspected by
the public. The ad shall also advise that interested parties may appear
at the meeting and be heard regarding the agreement.
3)
The ad can be in the legal section and does NOT have to be one-quarter
page, and does NOT have to include a map (as we are not changing the
permitted uses of land or changing the land use categories).
After going through this public hearing, the City will then proceed with the
adoption hearing, which requires another advertisement of a similar format, and
another public hearing. This adoption hearing shall be advertised at least five
(5) days prior to the hearing.
I'll keep an eye on this and provide you with the necessary copy for the ads.

Comprehensive Plan Settlement Agreement
This afternoon, I spoke with Stephanie Callahan, an attorney with
the DCA's Office of General Counsel, who stated that our proposed
plan changes to bring the city into compliance seem adequate. On
Thursday, 12 November, she will hand deli ver a motion for a
continuance of the scheduled DOAH hearing. In addition, her staff
is preparing the stipulated settlement agreement which will be
forwarded to Frank Kruppenbacher by early next week.
The following steps are required to settle this matter:
The Office of General Counsel of the DCA prepares five (5)
copies of the finalized stipulated settlement agreement and
transmits them to the City.
2) The original notice of intent plus the negotiated changes to
the plan are exhibits to the agreement.
1)
3) The City must hold an advertised public hearing at a
commission meeting prior to signing the agreement.
4) The finalized agreement must be signed by the chief elected
official and then returned to the DCA, where the agreement
will be presented to Secretary Shelley for final approval and
signature.
5) Once the agreement has been signed by the Secretary, a motion
for abatement of the hearing will be filed with the Division
of Administrative Hearings.

NOTICE is hereby given that the City of
Winter Springs, Aorida, will hold a pub-
lic hearing on December 14, 1992, at
7:30 p.m., or as soon thereafter as pos-
sible, in the Commission Chambers
City Hall, 1126 East S1ate Road 434:
Winter Springs, Florida, and to amend
the Winter Springs Comprehensive Plan
pursuant to a compliance agreement
between the City and the Aorida De-
partment of Co/TImunity Affairs to bring
the plan into compliance with the re-
quirements of Chapter 163, Part II, Aor-
ida StaMas. The proposed plan amend-
ment will be available for public review
at the City Clerk's Office, City Hall, dur-
ing the hours of 8:00 a.m. and 5:00 p.m.
Interested parties may appear at the
hearing and be heard regarding the ap-
proval of the agreement.
