CITY OF WINTER SPRINGS
FEBRUARY 10, 1992
The Regular Meeting of the City Commission of the City of Winter Springs, Florida,
was called to order by Mayor Philip A. Kulbes at 7:30 p. m.

For the invocation Commissioner Torcaso asked for a moment of silent prayer. The
pledge of allegiance to the flag was led by City Attorney Frank Kruppenbacher.
Approval of minutes of January 27, 1992:
There were no additions or corrections to the minutes of Jan. 27, 1992 - the minutes
stand approved as presented.
Public Comment:
Mike Kocak, Mt. Laurel Drive, spoke about the article in the Orlando Sentinel
regarding the borrow pits. He said what he was objecting to was the possibility
the water rates might be raised.
. John Ferring, Oak Forest, spoke about the article in the Orlando Sentinel about
Seminole County sending out a newsletter, and he spoke about our newsletter.
General Agenda:
Public Hearing for Ord. No. 515, vacating, abandoning and closing the southern 5
ft. of that 7~ ft. utility easement, (Highlands Sec. Two, Tract D) etc. Second
Reading:
Attorney Kruppenbacher read Ord. No. 515 by title only on second reading.
Kulbes recessed the Commission Meeting and opened the public hearing. No
for or against the ordinance. Mayor Kulbes closed the public hearing and
the Commission Meeting.

Public Hearing for Ord. No. 518, providing for addition of sub-section (C) to
Chapter 12; Motor Vehicles and Traffic, Art. II. Administration Section 12-31.
Failure to obey citation, etc. Second Reading:
Attorney Kruppenbacher read Ord. No. 518 by title only on second reading. Mayor
Kulbes recessed the Commission Meeting and opened the public hearing. Mr. Denning,
Pebble Beach Circle asked if there is a limit of the accrued fines before it goes
to the State. No one spoke for or against the ordinance. Mayor Kulbes closed
the public hearing and reconvened the Commission Meeting.

Motion was made by Commissioner Kaehler to adopt Ord. No. 518. Seconded by Commissioner

Deersong-Request of SALA, Inc. for Commission Waiver to Section 9-157 of the Code
(private streets to not meet design/construction and inspection standards of private
streets):
Manager Rozansky explained this request is before the Commission because they did not
meet a certain portion of the Code, and the portion of the Code they did not meet
allows the developer or the applicant to come to the Commission and ask for a waiver.
City Engineer, Leonard Kozlov, explained Deersong is a private subdivision of low
income housing. A homeowners association will be responsible when they take control.
Mr. Kozlov explained the soil cement compression strength test did not meet the Code
Standard in Section 9-201(3) (a) (2). Mr. Kozlov offered Mr. Sabetti two solutions to
the problem, one was a four year bond for removal and replacement of the road in case
there is a problem with it along with taking more cores just before the four year bond
expires to be tested for compressive strength and the other alternative would be to
put another inch of asphalt on the surface, which would cost approximately $8,300.00.
Mr. Sabetti of SALA, Inc. was present and his attorney Bill Osborne was present and
both spoke to the Commission.
Motion was made by Commissioner Kaehler for denial of waiver to Sec. 9-157. Seconded
by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Donnelly,
aye; Commissioner Kaehler, aye; Commissioner Torcaso, aye; Commissioner Jonas, aye;
Commissioner Langellotti, aye; motion carried.
Mayor Kulbes called a recess at 8:40 p. m. and called the meeting back to order at
8:50 p. m.
Mayor Kulbes announced that SALA, Inc. would like to present a proposal for a solution
to this problem. Mr. Sabetti's brother said they would like to put another one inch
of asphalt on top of the existing asphalt to bring the subdivision into an acceptable
level.
Deersong-Commission Approval to record Plat and Covenants:
Don LeBlanc, Land Development Coordinator, explained the plat and the covenants have
been reviewed and approved by the City Attorney, but certificates of occupancy will
not be issued until the City Engineer posts a letter with the Building Department
stating that all is acceptable.
Motion was made by Commissioner Langellotti to approve the recording of the plat and
covenants contingent upon the completion of a one inch overlay meeting the City
standards and approval by the City Engineer and certificates of occupancy will not
be issued until the Engineer's concerns are met. Seconded by Commissioner Donnelly.

On the abortion issue, Attorney Kruppenbacher said he is going to send the pictures
to some legal people in Washington for a solution to this problem.
City Manager Richard Rozansky:
1990-91 Audit Report-Management Letter/Comments/Review/Acceptance:
Manager Rozansky said the Auditors are present this evening to discuss his answer
to the Management Letter. Manager Rozansky said the letter more or less agrees
with what they said. The Management Letter and Manager Rozansky's answer must be
sent to the Auditor General within 30 days after acceptance.
Motion was made by Commissioner Torcaso to accept the audit as prepared by Coopers
and Lybrand. Seconded by Commissioner Langellotti. Discussion. Vote on the motion:

Sec. 4-12 of the Charter, Appointment of auditor for 1991-92 FY:
Manager Rozansky said he wanted to thank Coopers & Lybrand for their very good audit,
. and he wanted to thank Mr. Martin and his department for the good budget and audit.
Motion was made by Commissioner Kaehler to confirm the prior appointment of Coopers
& Lybrand to complete the audit for 1991/1992. Seconded by Commissioner Torcaso.
Discussion. Vote on the motion: Commissioner Jonas, aye; Commissioner Langellotti,
aye; Commissioner Donnelly, aye; Commissioner Kaehler, aye; Commissioner Torcaso, aye;
motion carried.
Reports: Manager Rozansky said he was going to appoint Tim Lallathin as Fire Chief
on Feb. 11, 1992.
Manager Rozansky said he accepted the bid on the Blower in the amount of $93,065.
He said the park is coming along nicely. He said he has been given a deed to a piece
of property on Winter Springs Boulevard near the Tennis Villas; it is about 3/4 of an
acre, and he said we could make a community park there if the Commission so desired.
He said he would put it on the next Agenda for Commission's consideration, and would
provide them more information.
Manager Rozansky said today the bids were opened for the Fire Station No. 1 Addition.
Three bids were received, Cornerstone in the amount of $121,700; Lynch Construction
in the amount of $159,903 and Schmitt Builders in the amount of $99,800.
Commission Seat IV - Terri Donnelly:
Appointment to Districting Commission: Commissioner Donnelly appointed Carrie Weaver,
subject to her approval.

Commissioner Donnelly said she had the opportunity to hear Bill Sadowski from DCA.
He said a lot of the things that we are going through now are going to be subject
to change, its going to be an on-going growing process.
Commissioner Donnelly invited everyone to the HBA Meeting, Friday morning at 8:00
a.m. and the subject is concurrency. She said on Thursday she has a meeting with
Representative Stone regarding S.R. 434.
Commission Seat I - John V. Torcaso:
Commissioner Torcaso said he is against the "Voter Control of taxes".
Commission Seat V - Cindy Kaehler:
Commissioner Kaehler asked the Finance Director what information he has received from
Cablevision as of this date, and Mr. Martin answered nothing. Mr. Martin is to send
a letter to Cablevision asking the names of all subscribers in Winter Springs, and what
services they have.
Commission Seat II - Don Jonas:
Commissioner Jonas asked about the extension that was granted on the park. Mr.
LeBlanc explained the 42 days incorporated all the time extensions which have been
granted. He explained the City cannot grant a partial certificate of occupancy and
DOT will not allow us use of the park until such time as we have an approved entryway.
Commissioner Jonas asked if would have a problem with the water supply because of our
investment of trees and shrubs. Mr. LeBlanc said right now there is no problem.
Manager Rozansky said they are working on the reuse line as fast as they can.

Commission Seat III - John Langellotti:
Commissioner Langellotti said he has received several phone calls about the borrow
pits and he just wants the public to know that the City Commission knows absolutely
nothing except for the one visit of that gentleman that came here. We have not
received any information.
Commissioner Langellotti said Father Bluett has offered the soccer league the use
of their field while the work is being done at the Trotwood Park.
Commissioner Langellotti said he met with Rep. Frank Stone last Friday and he is
going to Tallahassee Tuesday, and he has an appointment with DOT about the entryway
to the park.
Mayor's Office:
Mayor Kulbes said he appointed Mr. H. MIckey Barrett to the Transportation Committee
of the E.C.F.R.P.C.

Whether Mixed-In-Place or a Central Plant Mix, it has been known for
decades that the results of compressive strength tests performed upon test
specimens molded in the field or at the jobsite, will not produce the same
results as test specimens molded in the Laboratory or at the Plant, just
im mediately after water has been added to the soi I-cement mixture. Long
term experience and research clearly indicates that lower compressive
strength results from field test specimens is very common and is to be
expected, and does not diminish the overall quality, durability or life of the
soi I-cement base structure. My many years of experience have indicated
that if specimens molded in the field achieve at least 60% to 70% of the
PCA Minimum Laboratory Design 7-day compressive strength, then the soi 1-
cement materials are reacting normally and have sufficiently hardened or
become durable enough where they can be paved and the road opened to
traffic. FOOT's current minimum acceptance criteria, is sixty (60) percent
of the minimum specified laboratory design strength. Thus materials
designed for a minimum laboratory strength of 300 psi at 7 days should have
a minimum in-place field compressive strength of 180 psi.
The current City of Winter Springs Code does not clearly state whether the
minimum design strength was to be achieved by Laboratory Design or Field
Test Results. Based upon current local standards and practices, people in
the Industry would automatically assume this means Laboratory Design and
not Field Test Results. The results of test specimens molded in the field
are used for Qual ity Control purposes, and to evaluate whether or not the
in-place soils-cement materials have sufficiently hardened to a degree where
the roadway can be paved and open to traffic. Interpretation of the City's
Code to mean that the in-place materials must have a minimum compressive
strength of 300 psi at 7-days would be inconsistent with Industry standards
and practices, grossly unfair, and totally unnecessary from an Engineering
Design or performance point of view.
The only way to consistently meet the City's standards, as currently being
interpreted by the City Engineer, is to change the Industry standards. This
wi II require notifying all Design Engineers, Road Bui Iders, Testing
Laboratories, and Soi I-Cement Suppl iers that materials suppl ied to the City
of Winter Springs must meet a higher than normal standard. To ensure that
the Central Plant Mixtures will consistently meet a minimum compressive
strength of 300 psi at 7-days in the field, the Testing Laboratories wi II have
to establ ish new Mix Designs, with higher cement contents that would meet
at least 500 psi at 7-days in the Laboratory. Thus 60% of the minimum
Laboratory Design should yield a minimum of 300 psi in the field. These
higher cement contents, however wi II result in higher road construction costs,
and more extensive development of shrinkage cracks that will be reflected in
the pavement surface. Thus from an economic and aesthetic point of' view,
we feel that such changes in current local design and construction practices
would be not only uneconomical, but ill-advised.
As to the DeerSong Apartment Project (nee Indian Ridge Apartments) lleing
developed by Sala, Inc., our Firm did provide soi I-cement construction
monitoring services to their Contractor, Gopher Util ities, in October of 1991.
As indicated in our Progress Report No. 4 of November 20, 1991, the results

field ranged from 185 to 190 psi. Soil-cement Mix Designs prepared by
Jammal & Associates of Winter Park, Florida, for the supplier, Sloan
Construction Company, indicated that the materials with a cement content of
5.0% would meet both the normally accepted 300 psi Laboratory Strength
Design and Brush Loss Criteria. Our field tests further indicated that the
in-place materials had been satisfactorily compacted to the required degree
and thickness. In sum mary, the results were satisfactory and consistent with
normal local standards.
It is important to note that the DeerSong Apartment Project consisted of the
construction of a driveway and parking lot which will be privately owned and
maintained. The parking lot and driveway wi II not be exposed to high speed
or high density traffic with heavy wheel loads. On February 4, 1992,
Jammal & Associates reported the results of two test specimens cored from
the_ pavement' area. The compressive strength results were 375 psi and 500
psi, respectively, at an age of about 3.5 months. These test results clearly
indicate that the in-place soil-cement base, materials are continuing to
increase in strength with time, and are reacting normally and should be
accepted as such without any further restrictions or provisions.
I trust that this letter is complete and sufficient for your needs, and that it
accurately documents the Professional Engineering opinions expressed by
myself, and others in the Industry during our meeting.
