Agenda Item, Request for Temporary Office
The applicants, Kirk and Kristen Keith, have requested permission
to place a mobile office on that property along Highway 17-92
(south of Shepard Road) as shown on the attached map. The Staff
met on this on August 28, 1990 and had no major problem (see
attached minutes).
Also attached are the applicants' request, property owner's agreement,
site plan and temporary office brochure.

The above referenced was held on August 28, 1990. Kirk and Kristen Keith
represented the project. Staff members present were Artman, Holzman, Koch,
Kozlov, LeBlanc, McKinney, Sexton and Taylor.
This project is to open an outdoor showroom/sales office for outdoor
furniture along Hwy. 17/92.
Traffic regulatory signs and the arbor ordinance were discussed.
The developer is in contact with D.O.T. in regards to the road cut on 17/92.
The parking lot will be gravel (non-compacted). One handicapped slot (12'x20')
which will have a partial, solid surface for wheelchairs.
There was discussion on the proposed office building. It must be a mobile
structure or a permanent one, with a minimum of one restroom, and must meet
all handicap requirements. Electricity must be underground. The nearest
water is a well to the rear of the property about 300' away. A septic tank
will be required.
The display area for the larger furniture will be surrounded by split-rail
fencing while the smaller pieces will be within an area already surrounded
by a chain link fence. There will be landscaping and security lights.
The property owner's permission will have to be obtained before any improvements
can be made. If the office is mobile, Commission approval is required.
All the above criteria must be met before a permit is issued. The Building
Official will monitor this.

To the City commissioners of winter Springs;
We (Kirk and Kristen Keith) request the use of a Florida approved
mobile office on Lot 12, Block B, for the purpose of selling swing
sets, gazebos, sheds and outdoor furniture, a business modelled
after Shore Furniture that has been successfully operating in
Baltimore Maryland for more than eight (8) years. The reasons for
our request are as follows:
1. Most of the products are large outdoor items and are meant to
be displayed outside; therefore, a building to house our
product will not be immediately essential to our business.
2. The economy of a mobile office will allow us to start the
business much sooner.
3. We are a new business, so as of this time we are unsure of
what kind of building we will need or where a permanent
building would best suit the display area . with a mobile
office we will have the time and ability to see how displays
look set up different ways, see how much of a demand we have
for office space, and determine the quantity of space we will
need in the future for a permanent structure.

The mobile office is Florida approved and very appealing to the
eye, (Please see the attached brochure). We will also build a deck
in the front and landscape around it. The office is equipped with
a restroom that will accommodate the handicapped and is skirted
around the bottom.

I have recently been informed by Winter Springs Code Enforcement Officer AI
White that a situation exists on my personal residence property that may be in
violation of city ordinance 17-1. Officer White has issued me a citation, however, due
to the circumstances surrounding this matter, he has suggested that I bring it to your
attention to secure Commission approval. The property in question is lot #203, unit
3 (800 Dyson Drive) in Tuscawilla. This lot is located on the northwest corner of the
Dyson Drive and Shetland Avenue intersection. The house fronts on Dyson (the south
boundary of the property), while Shetland Avenue represents the east boundary of the
property.
The situation in question is a line of landscape rocks on my lawn along Dyson
and Shetland. These rocks are approximately 12 inches in diameter (football to soccer
ball sized), and are spaced approximately 12 to 15 feet apart. They have been placed
there to protect both my property and city property, as noted in the accompanying
attachment. I am requesting that the commission grant approvai for these rocks to
remain in place on my lawn. I have considered very carefully the arguments for and
against these rocks, and have summarized them in the attachment. If it is necessary
for me to present my case in person at a future commission meeting, please advise
me. I will be happy to meet with you to discuss this issue.

Summary of Problems Causing Placement of Landscape Rocks
For many years I have had a few serious problems with traffic on Shetland Avenue.
The problems, their results, and remedies are:
Problem: My house, which fronts on Dyson, has a considerable amount of
wooded area which shields its view from Shetland. Assorted vehicles often
choose to park on the lawn surface that abuts Shetland, or simply make U-
turns on the lawn surface. Because of the afternoon shade afforded by the
adjacent wooded portion of my property, this area seems to be a popular place
for delivery truck drivers and U.S. postal vehicle drivers to park and eat lunch.
Lawn maintenance workers have also repeatedly chosen to park their vehicles
and trailers on this section of my lawn while they service Shetland property
owners. Even the Winter Springs police department has found it to be a
convenient place to park and set up their radar (I favor the radar-I would
welcome the police to park on my paved driveway rather than the lawn).

Result: The continual traffic turned a grassy area into a churned up sand pit,
overgrown with weeds. It reached the point where it was impossible for me
to run my lawn mower through this area. I simply had to let it continue to
become more and more an eyesore. Periodically the weeds would be mowed
down by what I suspect was a city or county crew with heavy duty equipment
that could negotiate the churned up sand (of course, that equipment was heavy
enough to compound the problem). Gradually, erosion caused the berm of the
road to lower to about 6 inches below the paved surface. This coupled with
continued vehicular traffic from the paved surface to the berm caused the road
surface to begin to crumble at the edges. In some places more that a half foot
of pavement had crumbled away.
Problem: On many occasions vehicles traveling south on Shetland and turning
right (west) onto Dyson have found that they can change an abrupt 90 degree
turn (which requires a considerable reduction in vehicular speed) into a more
gradual (and consequently quicker) turn by simply cutting across my lawn.

Result: Again, the vehicular traffic across this corner contributed to a
deterioration of the lawn surface and road pavement edge along Dyson near the
corner. In addition, there is a low profile concrete and steel catch basin on that
corner that has been struck by such vehicles on several occasions. In one
recent incident the catch basin suffered severe damage (concrete footers
knocked out of alignment, top safety screen knocked loose), requiring a crew
from Winter Springs Public Works Department to spend a day making repairs.

Remedies: In late June and early July some major repaving was performed in
Tuscawilla. Among the streets repaved was Shetland Avenue. At that time
I decided to make another attempt to get the property looking good again. The
lawn areas of my property abutting the road surfaces were resodded at
considerable expense to me. One day after the sod was laid, a moderately
sized section of sod was ripped up and two sprinkler heads were destroyed by
vehicular traffic. It was apparent to me that laying the sod would be a
temporary fix, for it was just a matter of time before the destruction would
begin again. I placed the previously described landscape rocks to convey the
message to motorists that this was my lawn and not a parking lot. They say
"drive on the road surface, and not on the lawn." Essentially they serve the
same purpose as the formed concrete curbing that exist in various other parts
of Tuscawilla.
Potential Questions, Concerns, and Responses

Prior to placing the rocks in their current positions, I thoroughly thought through these
problems, their solution, and any concerns they might raise. These are summarized
below.
Concern: Do the rocks obstruct or hinder vehicular traffic?
Response: Because of their size, the rocks would not impede vehicular in an
emergency situation. Their profile is low enough that a car can simply ride over
them if forced to leave the road surface. They present less of an impediment
to motor vehicles than does the formed concrete curbing that is present in
many areas of Tuscawilla.
Concern: Are these rocks potentially hazardous to motor vehicle traffic?

Response: The rocks pose no apparent hazard to motor vehicle traffic for, as
noted above, their profile is low enough for cars to ride over them. In addition,
they are considerably less dangerous to motor vehicles than the abundance of
concrete, brick, and stone mailboxes that are so prevalent within Tuscawilla.
They are also considerably less dangerous than the approximately 30 foot tall
pillar of concrete holding a streetlight directly adjacent to the road surface on
the previously described corner of Dyson and Shetland.

Concern: Are these rocks potentially hazardous to pedestrian or bicycle traffic?
Response: Again, I find these rocks to be less of a hazard than the formed
concrete curbing. If a bicyclist were forced off the road surface by a motor
vehicle, the 12 to 15 foot spacing of the rocks would afford plenty of
opportunities to simply ease off the road surface and onto my lawn. In those
areas of Tuscawilla with the formed concrete curbing, a bicyclist in a similar
position would have no avenue of escape, and would stand a good chance of
bouncing off the curbing and into the path of the motor vehicle. Pedestrians
who need to evade traffic would have no trouble stepping over, around, or
between these rocks.
Concern: Do these rocks pose a liability hazard to the city of Winter Springs
or to me personally?
Response: I am not a lawyer, and even if I were I would not be able to predict
with certainty the results of any civil litigation. However, one would think that
they would pose no more concern than the previously mentioned concrete
curbing, concrete telephone poles, catch basins, or mail boxes (or hard paved
surfaces, for that matter) that exist throughout Tuscawilla. I talked with the
agent who handles my homeowners insurance, and he indicated that I should
not be concerned since I am merely protecting my personal property.
Furthermore, all the legal descriptions that I have for this lot indicate that the
rocks are not on city property. The legal description indicates that utility
easements exist on all sides of the property except those sides of the property
that abut street right of ways.
Concern: Am I in violation of a city ordinance?
Response: I am not convinced that I am. The ordinance on which I was
originally cited was Article I, Section 17-1, Obstructing streets and sidewalks;
permit required. This ordinance indicates that it is unlawful to place on any
street or sidewalk any articles which may obstruct or hinder the traffic thereon.
I have certainly not placed anything on the street to obstruct or hinder street
traffic (vehicular or pedestrian), and there are no sidewalks in this section of
Tuscawilla to be obstructed. Pedestrians are still free to avoid the road surface
and walk on my lawn if they so desire. If I were to remove the rocks and the
condition of the property returned to its former state, I suspect that then I will
be in violation of the ordinance against maintaining an unkempt property.

IMPORTANT NOTICE
TO WINTER SPRINGS CITIZENS
Sanitation Pick-Up Survey
=
The State of Florida's Solid Waste Management Act requires the elimination of yard
waste from landfills by January 1, 1992. In order to meet this mandate, sanitation
customers throughout the City will be required to change the way in which yard waste
is disposed of. The present system is twice weekly combined garbage/yard trash pick-
up and once weekly recycling pick-up.

Canvassing Board
In accordance with Sec. 2-93 of the City Code the City Commission must
designate the Canvassing Board for the Nov. 5, 1991 Municipal Election.
The Canvassing Board will meet at 6:30 p. m. on Nov. 5, 1991 to canvass
the absentee ballots at the Office of the Supervisor of Elections, Seminole
County Services Building, 1101 East First Street, Sanford, Florida 32771.
The tabulating equipment test will be held on Friday, November 1, 1991 at
3:30 p.m. at the office of the Supervisor of Elections Office, Seminole
County Services Building. The Canvassing Board must attend or they can
designate a member of the Board to attend.
