Attached is a letter from Scott C. Thompson regarding the above
referenced. The Staff (Archer, Govoruhk, Holzman, Kozlov, LeBlanc and
Lockcuff) met on September 16, 1991 and discussed this item. Koch
was unable to attend, but submitted the attached memo.
In addition to Koch's memo, I have personally visited the Truss Plant
and asked them to utilize the 2nd Street right-of-way for all
west-bound traffic on S.R. 434. The reason for this is to decrease
traffic on Orange and Brantley Avenues.
The consensus of the Staff is that this right-of-way not be vacated
until such time as the School Board purchases the property. Or, if
the County approves this vacation, a caveat be added that the
School Board not have to pay extra monies for this vacated right-of-
way.

SUBJECT: Request to Vacate Second Street
I recommend the City oppose the vacating of the portion of Second Street
requested by the attorney for the Joyce property for these reasons:
(1 )
The land adjacent to the north of the proposed vacation is
the property the School Board is purchasing for a high school.
Vacating the road and giving the land to the current property
owners could raise the price of the land.

(2) At the east end of Second Street there is property that would
be cut off from access to a public road. Lots 25 and part of
24 south of the railroad and north of this street (owned by
Button) do not have access to Brantley Avenue without crossing
the railroad. Their only unrestricted access is to the west
over Second Street to S.R. 434.
If this road is vacated it should be after the School Board owns the
high school site so the land will transfer to them without cost and
after consideration is given to access for the Button property.

To Whom It May Concern:
I am writing on behalf of Mrs. Clara D. Joyce, owner of Lot 23
and the westerly 235.50 feet of Lot 24, Block "B" of D.R. Mitchell's
Survey of the Levy Grant, and Cresent View Enterprises, Limited, the
owner of adjacent Lots 19, 20, 21 and 22, all located off State Road
434 just west of Tuscawilla Road by the Winter Springs City Hall, to
inform you of their intention to petition Seminole County to vacate a
portion of a right-of-way adjoining the southerly boundary of the
above-mentioned lots. The right-of-way in question is the platted but
unopened right-of-way of unspecified width now known as "Second
Street" highlighted in yellow on the attached copy of the relevant tax
map.
Because Second Street adjoins the northerly boundary of Lot 27, I
am writing to inquire whether the City, as the owner of Lot 27 as
indicated on the tax rolls, would have any objection to the vacation
of the portion of Second Street in question. Please contact me if you
have any such objection. As this matter must be completed as soon as
possible, I would appreciate the earliest possible response.

Staff Review, Middle School "AA" (Indian Trails)
The above referenced was held on September 10, 1991. C. Conklin, I. Boyles
and D. Lavender represented the project. Staff members present were Alamina,
Artman, DeWitt, Govoruhk, Holzman, Koch, Kozlov, LeBlanc and Lockcuff.
The project representatives were told that the Commission was attempting
to schedule a workshop with the School Board as quickly as possible to
discuss the issue of the connection fees.
At present, the dryline sewer system has been approved by D.E.R., but the
same agency has denied the water distribution system permit. It was brought
to the attention of the client that our Code does not allow construction to
commence until all systems have been approved by the concerned agency. This
is stated in Section 9-l77(a) of the Code.

The client was reminded that the school will have a second access, on the
east .side of the property, in 1996 (scheduled).
The Building Department has requested, for records purpose, that a letter be
sent stating that the School Board is responsible for self-inspection. It
was also requested that a periodic status report addressing work done and
inspected be sent.
The City wishes to receive two sets of the architectural plans - one for the
Building Department and one for the Fire Department.
The School Board will install the traffic regulatory signs and the City will
certify them.
Total construction is expected to take one (1) year and will be phased.

The engineering plan for the new school on Tuscawilla Road was reviewed
by this office regarding traffic circulation only, since site standards
are not subject to our authority.
As schools are now required to comdY with local government comprehensive
plans, and our plan states we will enforce the County's level of service on
Tuscawilla Road, inquiry was made to the County Planning Office concerning
the effective date of the concurrency management system in their newly
adopted plan. They advised concurrency will not be implemented until
March 1992, therefore, this school is not subject to it.
The School Board was informed that a secondary access will become available
just to the north of this site when a segment of the City's loop system is
constructed between Tuscawilla Road and S.R. 434. The City will receive
funds from the new one cent sales tax that was approved by referendum in
July. It is anticipated that approximately $1.8 million will be allocated
to the City by 1996 for this project.
The City will coordinate with the School Board and adjacent property owners
to acquire right-of-way east of the school to provide access to the new
road.

103.2.5 Site Drawin&s. Drawings shall show the location of the proposed
building or structure and of every existing building or structure on the
site or lot. The Building Official may require a boWldary line survey prepared
by a qualified swveyor.

103.3 examination of Documents
103.3.1 Plan Review. The Building Official shall examine or cause to be
examined each application for a permit and the accompanying documents,
consisting of drawings, specifications, computations and additional data,
and shall ascertain by such examinations whether the construction indicated
and described is in accordance with the requirements of the technical codes
and all other pertinent laws or ordinances.
103.3.2 Affidavits. The Building Official may accept a sworn affidavit from
a Registered Architect or Engineer stating that the plans submitted conform
to the technical codes. For buildings and structures the affidavit shall state
that the plans conform to the laws as to egress, type of construction and
general arrangement and if accompanied by drawings showing the structural
design, and by a statement that the plans and design conform to the requirements
of the technical codes as to strength, stresses, strains, loads and stability.
The Building Official may without any examination or inspection accept
such affidavit, provided the architect or engineer who made such affidavit
agrees to submit to the Building Official, copies of inspection reports as
inspections are performed and upon completion of the structure, electrical,
gas, mechanical or plumbing systems a certification that the structure, electrical,
gas, mechanical or plumbing system has been erected in accordance with
the requirements of the technical codes. Where the Building Official relies
upon such affidavit, the architect or engineer shall assume full responsibility
for the compliance with all provisions of the technical codes and other
pertinent laws or ordinances.
103.4 Issuing Pennl1s
103.4.1 Action on Permits. The Building Official shall act upon an application
for a permit without unreasonable or unnecessary delay. If the Building
Official is satisfied that the work described in an application for a permit
and the contract documents tiled therewith conform to the requirements
of the technical codes and other pertinent laws and ordinances, he shall
issue a permit to the applicant.
103.4.2 Refusal To Issue Permit. If the application for a permit and the
accompanying contract documents describing the work do not conform
to the requirements of the technical codes or other pertinent laws or ordinances,
the Building Official shall not issue a permit, but shall return the contract
documents to the applicant with his refusal to issue such permit. Such
refusal shall, when requested, be in writing and shall contain the reason
for refusal.

A "NOTICE OF DENIAL OF USE OF GENERAL PERMIT" was issued by the
DER on August 9, 1991 1n response to the City withdrawing
commitment to the water system extension application. A new
submittal will be required for permitting the water system.
A permit to construct a dryline sewage collection/transmission
system was issued by the DER on August 29, 1991. The final
connection to the manhole on Trotwood Boulevard will not be made
as part of this permit. No wet connection shall be made without
the separate written approval and flow allocations by DER and the
Utility.

All markings on roadways are to be thermoplastic and conform with Roadway
and Design Standards specification issued by F.D.O.T.. Request a copy of
Tuscawilla Road as approved by Seminole County Engineers.
Handicap Parking will be line painted in blue with the International Wheelchair
symbol painted in blue in the parking space, with the proper signage per Florida
Statute placed at the head of the parking space. Additional $250.00 fine sign
will be provided by Winter Springs Public Works Department.
Recommend all parking spaces and roadway markings within the project will be
white thermoplastic paint.
Recommend the buildings be equipped with fire and burgular alarms, and proper
exterior lighting for security purposes.
All signs will be installed by the School Board/Contractor and inspected by
Winter Springs Public Works Department for conformity to Florida Statutes.
