WORKSHOP MEETING
CITY COMMISSION
NOVEMBER 18, 1991
The Workshop Meeting of the City Commission of the City of Winter Springs, Florida,
was called to order by Mayor Philip A. Kulbes at 7:00 p. m.
Roll Call:

Commissioners:

Discussion of street lights in private subdivisions:
Don LeBlanc, explained that he obtained the dedication blocks for all the private
subdivisions and covenants addressing the utilities. This information along with a
letter and the condominium statute, FS 718 have been distributed and a copy has
been given to the City Attorney.
Gene Lein, Winged Foot Circle East in Country Club Village, said he appreciates
having this Workshop to discuss the subject of street lights. He read from his
brief statement, asking the Commissioners to grant relief to those citizens of
Winter Springs who have been doubly taxed. He said they must pay for their street
lights through their homeowners association dues, and it is his contention that
is unfair. He said to his knowledge there are no City documents that prohibit the
City of Winter Springs from maintaining street lights in all areas within the
boundaries.

Commissioner Partyka said if all the lights were paid by the City that would be an
additional expense of $80 to 90,000 dollars which would increase the millage rate
and increase taxes for everyone.
Commissioner Jonas said the decision is going to have to be made by this Commission
as to what route they want to take. He said street lights are a different entity in
themselves. He said in the City there is really only one private sector and that is
Bear Creek Estates. Commissioner Jonas said when you buy into a private section you
should buy knowing all the rules and regulations.
Attorney Bricklemeyer explained our subdivision regulations are structured in a way
that differentiate between private subdivisions and public subdivisions.
Commissioner Partyka asked City Attorney Frank Kruppenbacher are there any legal
restrictions in terms of taking lighting over by the City if the City so chooses?
Attorney Kruppenbacher said that he thinks it is a policy decision, and if the
Commission's decision is they would like to do that, he recommended that he be
authorized to ask the Attorney General if the Florida Constitution or any Florida
Statutes would be in any way violated by the City embarking upon this.
Shirley Gray, Casa Park Circle, Mike Coursin, Casa Park Circle, Dick Denney, resident,
Jack Ruff, Winged Foot Circle West, all spoke in discussion.

Attorney Kruppenbacher will bring back at the next meeting a rough draft of a letter
to be sent to the Attorney General for the Commission's approval.
Mayor Kulbes called a recess at 8:45 p. m. and called the meeting back to order at 8:55
p.m.

Comprehensive Land Use Plan:
Manager Rozansky explained that the firm of Henigar & Ray from Ocala and Crystal
River have been selected to assist on the Plan. The cost will be between six and
ten thousand dollars. Manager Rozansky said a letter has been provided to the
Commission from the City Planner regarding the enormous amount of data in the Plan
that has been forwarded to Henigar & Ray for review/action.
John Horan, former member of the Planning and Zoning Board spoke about the work
the Planning & Zoning Board did on the Plan.
Manager Rozansky said the Plan will be on the Agenda for the next meeting.
Commissioner Partyka said this was his last meeting on the Commission.
Meeting was adjourned 9:15 p. m.
