Kulbes at 7:30 p.m. Roll Call: Mayor Philip A. Kulbes, present Deputy Mayor Paul P. Partyka, present City Manager Richard Rozansky, present City Attorney Frank Kruppenbacher, present Commissioners: Cindy Kaehler, present Don Jonas, present John Langellotti, present Terri Donnelly, present The invocation was given by Commissioner Terri Donnelly and the pledge of allegiance to the flag was led by Commissioner John Langellotti. Approval of minutes of Regular Meeting of Feb. 11, 1991: On page 4, under "Request of Marjorie Malich", the minutes are to be amended to reflect the complainant, Mr. Marvin Moore, 120 Camphorwood, was present and spoke against the request. The minutes stand approved as amended. There was no public comment. General Agenda: First reading of Ord. No. 501, vacating, abandoning and closing all that portion of road right-of-way, known as Orange Ave., lying south of and adjacent to Lot 9 and Lot 10 and north of Lot 11, Blk. B, D.R.Mitchell Survey, etc.: Attorney Kruppenbacher read Ord. No. 501 by title only on first reading. Resolution No. 660, granting authorization to apply for a public railroad/highway grade crossing, etc.: Attorney Kruppenbacher read Resolution No. 660 by title only. Motion was made by Commissioner Kaehler to adopt Resolution No. 660. Seconded by Commissioner Partyka. Discussion. Vote on the motion: Commissioner Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; Commissioner Partyka, aye; Commissioner Kaehler, aye; motion carried. City Manager Richard Rozansky: Tuscawilla Parade of Homes: Manager Rozansky said the Parade of Homes will start March 6, 1991 and end March 26, 1991. They are asking to be allowed to put certain signs up throughout the City and leave them up for the two week period, then they will take them down. Unless the Commission has some problems, Manager Rozansky said he is going to approve the request as he does every year. Appointment to Pension Plan Board of Trustees: Manager Rozansky said the appointment of Mr. Michael Jones as Trustee expires this year, and he does not wish to be reappointed. To follow the policy of the past, Mayor Kulbes would replace Mayor Grove as Trustee. A resolution will be prepared for the next meeting. . Regular Meeting, City Commission, Feb. 25, 1991 Page 2 90-91-10 Commissioner Langellotti suggested looking into pension plans to see if there are any plans that are better than ours. Manager Rozansky said he had no problem with people who really know what they are doing with pension plans and let them look at our plan. Winter Springs Water & Sewer East Percolation Ponds/Disposal of Drums: Manager Rozansky said he just wanted to bring the Commission up to date as to what is happening with the drums. He said they visited the site and a company is coming in to test the drums. The County has been notified. After the testing is done a report will be made then we will have to arrange for containment if there are any leaking drums. We are limiting access to the site. The first phase is the sampling, phase 2 is the testing and phase 3 will be the removal. Manager Rozansky said he sent a letter to Attorney Tom Lang outlining what he is going to do. Manager Rozansky said he would like to bring the Commission up to date on the golf course. He said after the last meeting Attorney Kruppenbacher prepared a letter to Mr. Binford asking for some five or six items to begin the study on appraisals and agreements. On Feb. 19th Manager Rozansky received a letter from Mr. Wood indicating they had a serious buyer. Manager Rozansky and Attorney Kruppenbacher are going to meet with Mr. Wood to discuss the various agreements, and Manager Rozansky said he will report back at the next meeting. . Monthly reports have been distributed. Manager Rozansky suggested the Commission review the Finance Report. He said he is beginning to prepare the new Budget, and possibly revise the 1990-91 Budget. Manager Rozansky said he spoke with Mr. Akers regarding Winter Springs Water & Sewer West; it appears the market may be favorable to do a refunding on the last bond issue. Manager Rozansky said they tried to get the funds to increase our disposal capacity by means of connection fees, but the Commission ruled they did not want us to collect them. He said he would like to go for the major portion which would bring in about $1,400,000 which would go for treatment for disposal of water, put our system in, and help us with the park entrance improvements and several other improvements. Mr. Gary Akers, Southeastern Capital Group, spoke to the Commission. He said interest rates in the bond market have dropped drastically the past month. He said they have been reviewing the City's 1985 Water & Sewer Revenue Bonds for the past couple years and this is the first market situation that provides a very good opportunity for the City. Mr. Akers reviewed the booklet he provided to the Mayor and Commission. Motion was made by Commissioner Langellotti to put the refinancing subject on the Agenda. Seconded by Commissioner Partyka. Discussion. Vote on the motion: Commissioner Langellotti, aye; Commissioner Partyka, aye; Commissioner Kaehler, aye; Commissioner Jonas, aye; motion carried. . Motion was made by Commissioner Langellotti to direct the City Manager, City Attorney and Mr. Akers to proceed with the necessary paperwork for refinancing. Seconded by Commissioner Donnelly. Attorney Kruppenbacher said he has received the Quit-Claim Deed executed by A. B. Scarlatta giving us the property at 110 Flamingo Avenue. He said he has advised the City Manager against our formally accepting the property until a consultant looks at the property to make sure there is nothing environmentally hazardous there. Attorney Kruppenbacher said he intends to proceed to file a lawsuit against a Mr. Armando Guarin, 602 Anhinga Road, Winter Springs, regarding the problem with the garage door. Attorney Kruppenbacher spoke to the Commission regarding the taxing district. Moti Khemlani, President of the Tuscawilla Homeowners Association, spoke about their concerns to the entrances of Tuscawilla. Attorney Kruppenbacher suggested that Mr. Khemlani, the City Manager and himself get together and discuss their concerns and then try to figure out how it can be done. Tom Freeman, Tuscawilla, spoke to the Commission. He said what their Committee had in mind was an ordinance of general application which allows any subdivision or any particular area to provide for a user tax which would be applicable to any area of the City and subject to a referendum of the people. It would provide for a budget by a Board of Trustees that could be selected either by the Councilor the homeowners themselves by a public election and would have a cap on it. The budget that they would adopt would be subject to public notice. It could be part of the overall City budget or could be adopted separate and apart. Mr. Freeman explained as the City of Winter Springs grows it is going to be incumbent to the people who have the responsibility in the given areas to keep those areas up. He said the developers are leaving and, and what we would like to do is pick up the responsibility and to provide for a user tax to keep up the landscaping, the entrances, parks and all those things that make the quality of life of the highest standards. Mr. Freeman said the body that has the responsibility and ability to incorporate and give us this responsibility is the legislative body of the City of Winter Springs. This legislative body can adopt this ordinance. It can be of general application. Commission Seat V - Paul P. Partyka: Commissioner Partyka said he would have an appointment for the Board of Adjustment at the next meeting. Commissioner Partyka thanked Chief Govoruhk, Glenn Whitsett and the Police Department, Gil Artman and the Mayor for doing an outstanding job on Saturday for the Tuscawilla Trot. Commission Seat I - Cindy Kaehler: Commissioner Kaehler spoke about the CALNO Legislative Policy Statment that will be presented to the Legislature. One of the items was to insure that schools be in- cluded in concurrency requirements for all growth management plans; also, that we insure that lottery funds be used for enhancement of education; support legislation which promotes urban infill by requiring more stringent public facility and service provision requirements in rural areas than required in urban areas. . . . ... Regular Meeting, City Commission, Feb. 25, 1991 Page 4 90-91-10 Commission Seat II - Don Jonas: Commissioner Jonas spoke about his conversation with Mr. Hughes regarding a site for a high school in our City. Commission Seat III - John Langellotti: Commissioner Langellotti asked if the Code could be revised to speed up the process of Code enforcement. Commission Seat IV - Terri Donnelly: Commissioner Donnelly spoke about reviewing the tax watch booklet. She said the introduction suggested three alternatives to approaching the development of the City Budget and she said she would like to solicit some suggestions and input from the Commission before we get far into it. Mayor's Office: Mayor Kulbes asked the Commission to consider the motion that was made at the last meeting to limit meetings to 11:00 p.m. and to possibly rescind that motion. Mayor Kulbes also suggested having a resolution passed to give credit to any service man or woman who lives in Winter Springs who is head of a household to eliminate their water and sewer bill for the time they are serving our Country in the Persian Gulf . Mayor Kulbes also spoke about the letter that was sent to our Building Official on Feb. 21 and another letter was sent to the City Manager. The man was complaining that he had received no response to his letter. Mayor Kulbes said I think its common courtesy to respond to the man's letter. Meeting adjourned 9:14 p.m. Mayor Kulbes called the meeting back to order. Attorney Kruppenbacher asked, if we can legally do it, you want us to proceed to give a credit to the people in the service overseas if it is either the husband, or the wife, or the man or the woman? Mayor Kulbes answered that is correct. Chief Govoruhk stated the matter of Mr. Guarin was not a violation of deed restriction; the certificate of occupancy was for a model home, never for a single family home.
